 State  Narrative  Language  For:   Antidegradation
  1. Levels of water quality necessary to protect existing and designated uses shall be maintained in
  surface waters of this state.
  2. If existing surface water quality is better than applicable water quality criteria established in these
  regulations, water quality shall not be lowered unless it has been determined, in accordance with procedures
  in K.A.R. 28-16-2Bf(c)(3), that the change is justified as a result of imortant social and economic
  development.
  3.(A) Existing water quality shall not be lowered by artificial sources in outstanding natural resource
  waters of unique significance listed in Table 1 of this regulation.
  (B) Except as provided in K.A.R. 28-16-28f(c)(3), no degradation of water quality by artificial sources shall
  be allowed that would result in harmful effects on populations of any threatened or endangered species of
  aquatic life or wildlife in a critical habitat as defined in the endangered species act of 1973 (PL 93-205) as
  amended, or in  K.S.A. 32-501 through 510 and K.A.R.  23-17-1 and K.A.R. 23-17-2.
  (0 Temporary sources of pollution complying with the provisions of K.A.R. 28-16-28c(d), and producing only
  ephemeral water quality degradation not harmful to existing and designated" uses, may be allowed.
  4. Implementation of these antidegradation provisions for thermal discharges shall be consistent with Section
  316 of the Clean Water Act.

State   Narrative   Language   For:  Toxics
 All surface waters shall be free, at all times, from the harmful effects of substances that originate from
 artificial sources and that produce any public health hazards or nuisance conditions, or impairment of uses.
 The harmful effects may result from any concentration of a substance that causes toxic effects, alone or in
 combination with other artificial or natural substances. Such substances shall be limited to concentrations
 in the receiving water that will not be harmful to human, animal, or plant life.

State Narrative Language For: Free From
 1. All surface w»ters shall be free, at all times, from the harmful effects of substances that originate from
 artificial sources and that produce any public health hazards or nuisance conditions, or impairment of uses.
  (A) The, harmful effects may result from:
  (i)    color producing substances;
 (ii)   heat or  acidic  or caustic substances;
 (iii)  visible  oil  and grease  and dissolved or  emulsified grease concentrations;
 (iv) deposits of solids, either organic or inorganic; floating materials attributable to municipal, indus-
 trial,  or  other  waste disposal  practices;
 (v) Taste and odor-producing substances that interfere with the production of potable water by reasonable
 water treatment processes, or impart unpalatable flavor to fish, or result in noticeable offensive odors in
 the  vicinity of  the water;
 (vi) Any concentration of a substance that causes toxic effects, alone or in combination with other artific-
 ial or natural substances. Such substances shall be limited to concentrations in the receiving water that

State Narrative Language For: Low Flow
 Low Flow - Classified surface waters shall be excluded froi the application of K.fl.R. 28-lo-28t(c) when the
 receiving streai flow is Jess than the greater of the seven-day 10-year low flow, or 1.0 cfs. The low flow
 exclusion shall also include consideration of the liniiui desirable streai flow established pursuant to

State Narrative Language For: Mixing Zones
 1. The water quality criteria listed herein shall apply beyond the lixing zone for each individual discharge,
 except that concentrations within the aixing zone area shall be laintained below acute toxicity levels for
 any paraieter or coibination of paraieters. The total area, or voluie, or both of.a receiving streai Issianed
 to iixing zones shall be liiited to that which will: mi^ma
 a) Hot interfere with biological coiiunities or populations of iiportant species to a degree which is
 daiaging to the ecosystei;  and
 b) Not disproportionately diiinish other beneficial uses.
 2. Zones of passage shall be provided wherever lixing zones are allowed. Such zones shall be continuous
 water routes of the voluie, area, and quality necessary to allow passage of free-swining and drifting
 organisas with no hariful effects on their populations.
Ln^!^6"! UT thi rati!! " Btrei- fl°H to ""charge is greater than 3:1 (flow:discharge), lixing zones
shall be huted to no lore than 1/4 of the cross-sectional area, or voluie of the streai, or both, leaving at
least 3/4 free as a zone of passage. .
4. In streais in which the ratio of streai flow to discharge is equal to or less than 3:1 (flowrdischarge),
ixing zones shall be established on a case-by-case basis. Bore stringent treatment technology lay be
required, when necessary, to protect the designated uses of the surface water segient and to otherwise teet
the requireients of these regulations.

threatened or endangered species.

Surface waters containing habitat types and biota cononly found or expected in
the area.

Surface waters containing biota liiited in abundance or diversity by the

waters. These waters are limited by lack of habitat due to natural deficiencies
or artificial modification including channelization and loss of riparian
vegetation.

The use of surface water after appropriate treatment, by public or private water

The use of treated or untreated effluent for groundwater aquifer recharge,
including accidental or incidental recharge as a means of disposal of sewage.

The use of surface water for non-consumptive purposes by industry, including
withdrawals for cooling or process water.

Recreation where the body may come into direct contact with water to the point
that ingestion is possible. This use includes swimming, skin diving, and water
