Box 1049, 1800 Hater Hark Drive Coluibus, QH 43266-0149 614-644-2856 State Narrative Language For: Antidegradation Existing instreai water uses as defined in Rule 3745-1-07 of the Adainistrative Code and designated in Rules 3745-1-08 to 3745-1-32 of the Ohio Adainistrative Code shall be iaintained and protected. No further water quality degradation which would interfere with or becoie injurious to existing designated uses is allowable. Waters in which existing water quality is better than the criteria prescifaed in these rules and exceeds those levels necessary to support propagation of fish, shellfish, wildlife and recreation in and on the water shall be Maintained and protected. However, the Director of the Ohio Environaental Protection Agency lay, after coapliance with public notice and intergovernmental coordination requireaents of any applicable statutes and regulations, and after due consideration of such technical, econoeic, social and other criteria as provided by sections 301'and 302 of the act, 33 U.S.C. sections 1311 and 1312,, choose to allow lower water quality. Degradation of water quality shall not interfere with or becoae injurious, to existing or planned uses, and the director shall require that the sost stringent statutory and regulatory controls for waste treatment be etployed by all new and existing point sources, and that feasible aanageient or regulatory prograas pursuant to sections 208 and 303 of the act, 33 U.S.C. sections 1288 and 1313, be applied to nonpoint sources. Present aibient water quality in state resource waters will not be degraded for all substances deterained to be toxic or to interfere with any designated use as deterained by the director of the Ohio Environiental Pro- tection Agency. All other substances shall be Halted to the criteria associated with each designated use, as outlined in Rules 3745-1-07 to 3745-1-32 of the Adiinistrative Code. Areas that do not seet general water quality standards as defined in Rules 3745-1-07 to 3745-1-32 of the Adiinistrative Code shall not be degraded as stated above for all such classified areas. State Narrative Language For: Toxics Free fros substances entering the waters as a result of huaan activities in concentrations that are toxic or harsful to huaan, aniaal, or aquatic life and/or are rapidly lethal in the iixing zone, Present aabient sater quality in state resource waters will not be degraded for all substances deterained to be toxic or to interfere with any designated use as deterained by the director of Ohio environaental protection agency. All pollutants or coafainations of pollutants not specifically aentioned in this rule, shall not exceed water quality criteria derived according to the procedures set forth in "Draft Guidelines for Deriving Nuaerical National Water Quality Criteria for the Protection of Aquatic Life and Its Uses," United States environaental protection agency, July 5, 1983, or, if insufficient data prevent the use of this procedure, shall not exceed, at any tiae, one-tenth, or, for pollutants or coabinations of pollutants which are known to be persistent toxicants in the aquatic environaent, one one-hundredth of the ninety-six-hour aedian tolerance liait (TLa) of LC50 for any representative aquatic species. However, aore stringent application factors shall be iaposed where justified by "Aufaient Water Quality Criteria," docuaents, United States environaental protection agency, 1980-, "Quality Criteria for Water," U.S. environmental protection agency, 1976; "Hater Quality Criteria 1972," "National Acadeay of Sciences" and "National Acadeay of Engineering,' 1973; or other scientifically based publications. State Narrative Language Fors Free From The Haters of the state shall be free froa: A. Suspended solids or other substances that enter the waters as a result of huaan activity and that settle to fora putrescent or otherwise objectionable sludge deposits, or that will adversely affect aquatic life; 3. Floating debris, oil, scua and other floating saterials entering the waters as a result of huaan activity in aaounts sufficient to be unsightly or cause degradation; C. Haterials entering the waters as a result of huaan activity producing color, odor or other conditions in such a degree as to create a nuisance; D. Substances entering the waters as a result of husan activity in concentrations that are toxic or haraful to huaan, aniaal or aquatic life and/or are rapidly lethal in the tixing zone; E. Hutrients entering the waters as a result of huaan activity in concentrations that create nuisance growths of aquatic weeds and algae. State Narrative Language For: Mixing Zones Hhere necessary to attain or aaintain the use designated for surface water by these water quality standards, the director aay establish, as a ter§ of a discharge periit or a perait to install issued pursuant to Chapter 3745-31 of the Adainistrative Code, a aixing zone -applicable to the non-theraal constituents of the point source discharge authorized by such perait. No aixing zone established by the director will: (a) Interdict the aigratory routes or interfere with natural aoveaents, survival, reproduction, growth, or increase the vulnerability to predation of any representative aquatic species; (b) Include spawning or nursery areas of any representative aquatic species; (c) IncluaVa public water supply intake; (d) Include any bathing area where bath houses and/or lifeguards are provided; ' (e) Constitute sore than one-half of the width of the receiving watercourse nor constitute eore than one- third of the area of any cross-section of the receiving watercourse; (f) Constitute aore than one-fifth of the area of any cross-section of the iouth of a receiving watercourse (the louth constituting that area of the streaa froa the confluence upstreas for a distance five tiaes the width of the streaa at the confluence); (g) Extend downstrean at any tiae a distance tore than five tiaes the width of the receiving watercourse at the point discharge; Please refer to the 'EPA Hater Quality Criteria Suaaaries: A Coapilation of State/Federal Criteria" for additional eixing zone language for Ohio. OH-2 ------- OHIO Classification; Nuisance Prevention Harswater Habitat These Maters include acid line drainage streaes. where the infaima is substatial- ly degraded and other heavily polluted streaa segaents where the fauna is degraded and the potential aquatic life use is not being attained due to irretrievable, ian-induced conditions or the demonstration that aeeting criteria for the support of a balanced aquatic conaunity would cause substantial and widspread econoaic and social iapact. This designation aust be recoiiended in a written report approved by the Director. All streas segaents designated Nuisance Prevention will be reviewed on a triennial basis (or sooner) to deteraine whether the use designation should be changed. These are waters capable of supporting reproducing populations of warawater fish and associated vertebrate and invertebrate organises and plants on an annual basis. Liaited Marswater Habitat Exceptional Marawater. Seasonal Salsonid Habitat Coldwater ' Habitat Public Water Supply Agricultural Hater Supply Industrial Water Supply These are waters incapable of aeeting specific warswater habitat criteria necessary for the support of populations of fish and associated vertebrate and invertebrate organises and plants either on a seasonal or year around basis due to natural conditions, irretrievable, san-induced conditions or the deaonstra- tion that aeeting the criteria would cause substantial and widespread econoaic & social iapact. Criteria for the support of this use designation will be the saae as the criteria for the support of the use designation warawater habitat. However, individual criteria will be varied on a case-by-case basis and will supersede thecriteria for warawater habitat criteria will apply only to specific criteria during specidied tiae periods and/or flow conditions. These are waters capable' of supporting* exceptional or unusual'populations of wapawater fish and associated vertebrate and invertebrate organises and plants on an annual basis. These would include waters of exceptional cheaicl quality that support sensitive species of warawater fish, exceptionally diverse aquatic coaaunities, and/or outstanding recreational or cosaercial fisheries. In addition to those streaa segaents designated in rules 3745-1-08 to 3745-1-30 of the Adainistrative Code, all publicly owned lakes and reservoirs, except upgroung storage reservoirs, are designated exceptional warawater habitat. These are waters capable of supporting the passage of Salsonid froa October through Say and are water bodies large enough to support recreational fishing. This use will be in effect the aonths of October through May. Another aquatic life habitat use designation will be enforced the remainder of the year (June through Septeaber.) These are waters capable of supporting populations of coldwater fish and associated vertebrate and invertebrate organises and plants on an annual basis. These waters are not necessarily capable of supporting successful reproduction of salsonids and say be periodically stocked with these species. These are waters that with conventional treatnent will be suitable for huaan intake and seet federal regulations for drinking water. These waters are suitable for irrigation and livestock watering without treataent. These are waters suitable for coaaercial and industrial uses,- with or without treataent. Criteria for the support of the industrial water supply use designation will vary with the type of industry involved. OH-3 ------- OHIO Recreational Bathing Haters Priiary Contact Secondary Contact Recreation These use designations are in effect only during the recreation season, which is the period froa May first to October fifteenth, for all streaas except those designated seasonal salaonid hab'itat. The recreation season for streaas designated seasonal salaonid habitat is June first to Septeaber thirtieth. These are Haters that, during the recreation season, are suitable for s'wiaaing where a lifeguard and/or bathhouse facilities are present, and inlcude any additional such areas where the water quality is approved by the director. These are waters that, during the recreation season, are suitable for full body contact recreation, such as, but not liaited to, swisaing, canoeing, and scuba diving with einiaal threat to public health as a result of water quality. These are waters that, during the recreation season, are suitable for partial body contact recreation such as, but not liaited to wading with ainiaal threat to public health as a result of water quality.
