                    EPA Finalizes Listing of Wastes from
                    The Production of Carbamates and
                    Adds 58 Chemicals to the Off-
                    Specifications Product List
                    EPA is aware that the mismagamement of wastes from the
                    production of carbamates has caused contaimination of soils and
                    ground waster. Listing of these wastes will provide for sound
                    management of these waste streams.
       Background

       As part of EPA regulations to
       implement the Resource
       Conservation and Recovery Act
       (RCRA), EPA has published a list
       of hazardous wastes that
       includes hazardous wastes
       generated from specific sources.
       This list has been amended
       several times and is published in
       40CFR261.32.

       In addition to the list of
       hazardous wastes generated from
       specific sources, EPA has also
       published under RCRA a list of
       unused commercial chemical
       products or manufacturing
       chemical intermediates that are
       hazardous wastes if they are
       discarded or intended to be
discarded. EPA has periodically
amended this list and it is
published in 40 CFR 261.33.
This list is commonly known as the
Off-Specifications Product List.

Under the Comprehensive
Environmental Response,
Compensation and Liability Act
(CERCLA), EPA has also published
a list of hazardous substances and
reportable quantities. Under
CERCLA, a hazardous substance
has a reportable quantity of one
pound unless adjusted by
regulation. Any unregulated
release of more than one pound
of the listed substance must be
reported. This list is found at
40 CFR 302.4.

Action Being Taken

EPA is amending the list of
hazardous wastes generated from
specific sources to include six
additional wastes.

These six new wastes are:

• K156 - Organic Waste
(including heavy ends, still
bottoms, light ends, spent
solvents, filtrates, and
decantates) from the production
of carbamates and carbamoyl
oximes;

• K157  - Wastewaters (including
scrubber waters, condenser
waters, washwaters, and
separation waters) from the
production of carbamates and
carbamoyl oximes;

• K158 - Bag house dust, and
filter/separation solids from the
production of carbamates and
carbamoyl oximes;

• K159 - Organics from the
treatment of thiocarbamate
wastes

• K160 - Solids (including filter
wastes, separation solids, and
spent catalysts) from the
production of thiocarbamates
and solids from the treatment of
thiocarbamate wastes;

• K161 - Purification solids
(including filtration, evaporation,
and crentrifugation solids), bag
house dust, and floor sweepings
from  the production of
dithiocarbamate acids and their
salts  (does not include K125 and
K126).
In addition, EPA is adding 58
specific materials to the list of
commercial chemical products or
manufacturing chemical
intermediates that are hazardous
wastes if discarded or intended to
be discarded.

Lastly, in order to coordinate the
RCRA and CERCLA rulemakings
with respect to new waste
listings, this rulemaking adds the
EPA Hazardous Waste Numbers
K156 through K161 and the 58
specific toxic and acutely toxic
products mentioned above to the
CERCLA list of hazardous
substances and establishes
CERCLA reportable quantities for
these materials.

By adding generic and specific
carbamate chemicals to RCRA
and CERCLA regulation, EPA is
moving to eliminate current gaps
between these regulations for
hazardous substances.  EPA is
taking this action in an effort to
speed first responder recognition
of the environmental hazards
posed by spills of carbamate
products.
