                  PROPOSED RULE TO LIST WOOD PRESERVING AND
                    SURFACE PROTECTION WASTES AS HAZARDOUS
     BACKGROUND INFORMATION

     Certain wastes from wood preserving processes are  currently
     regulated as hazardous under  RCRA.  However,  past  mismanagement of
     other  wastes from wood preserving processes and wastes from surface
     protection processes has been responsible for widespread
     contamination of soils, surface water, and ground  water.  As part
     of a recent settlement with the Environmental Defense Fund, EPA
     must propose to list as hazardous wastes from the  preservation of
     wood by December 31, 1988.


     ACTION

     EPA is proposing to list as hazardous certain wastes - F032, F033,
     F034,  and F035 - generated  by the wood preserving  and surface
     protection processes.   Section 3001(e) of HSWA mandates the EPA to
     list as hazardous additional  dioxin-containing wastes.  Wastes from
     wood preserving or surface  protection processes that use penta-
     chlorophenol typically contain dioxins.


     CONCLUSIONS

     Under  this proposal, these  wastes would be subject to the hazardous
     waste  management system requirements of RCRA.   These new listings
     would  prevent further  adverse environmental impacts resulting from
     the mismanagement of these  wastes.
