Reporting Requirements for
Persistent Bio accumulative Toxic (PET) Chemicals

chemicals. Therulealso includes modifications to certain
reporting exemptions andrequirements for the chemicals
newly subjecttothe lower reporting thresholds. These
PBT chemicals are of particular concern not only
because they are toxic butalso because they remain in
the environment for longperiods of time, are notreadily
,
destroyed, and build up or accumulatein body tissue.
The new rule is effective January 1, 2000.
Therefore, the new requirements apply for
TRI reports on releases and waste man-
agement for the year 2000, which must be
submitted to the Agency by July 1, 200L
EPAhas eliminated the de minimis exemptionforthe
PBT chemicals in the table below. However, this action
willnotaifecttheappUcabiliiyofthecfem/n/OTw exemp-
tion to the supplier notification requirements (40 CFR
372.45(d)(l)). EPAhas also excluded all PBT chemi-
cals from eligibility forthe alternate thresholdofl million
poundsforreportingonFomAandeliminatediange
. reporting foron-site releases and transfers off-site for
furtherwastemanagementforthePBT chemicals
affectedbythisrule. Inlhenewrule EPA has also
provided guidance on the level of accuracy expected to
bereportedforPBT chemicals.

WHAT IS TRI AND HOW CAN I
OBTAIN MORE INFORMATION?
The Toxics Release Inventory Program was estab-
lishedunder section 313 of the Community Right-to-
Know Act of 1986 (EPCRA). It requires certain
facilities in covered SIC codes to report their releases
of certain toxic chemicals to the state andfederal
goveramentsiftheymanufacture,process,orother-
wiseusemore than established threshold quantities of
TRI-listed chemicals. Priortothisnewnilemakingon
PBTs the threshold quantities were 25,000 pounds for
manufacture or processing, and 10,000 pounds for
"otherwiseuse"of TRI-listedchemicals. This
rulemakingadds certainpersistent, bioaccumulative
toxic chemicals (PBTs) to the list andreduces the
reporting thresholds for thosePBTsand some others
on the TRI list. For more information on TRI,
