Procurement Requirements Applicable to Government Agencies One of the primary objectives of the Resource Conservation and Recovery Act (RCRA) is to conserve valuable material and energy resources (§1003(a)). Because the collective purchasing power of federal, state, and local governments has significant potential to expand markets for products made with recovered materials, RCRA §6002 requires government procuring agencies, when purchasing EPA-designated items, to select items with the highest amount of recovered material content practicable. All federal agencies must review and revise all of their specifications for products to eliminate language which discriminates against the use of recovered materials. In addition, each procuring agency subject to §6002 must establish an affirmative procurement program for each item designated by EPA. How does a government agency determine whether or not it must comply with the requirements of §6002? A government agency should answer the following three questions to determine if it is subject to the requirements of §6002. First, does the government agency meet the definition of a procuring agency? The definition of procuring agency includes federal agencies, as well as state and local government agencies using federal funds, and their contractors. Specifically, RCRA §1004(17) defines a procuring agency as "...any federal agency, or any state agency or agency 'of a political subdivision of a state which is using appropriated federal funds for such procurement, or any person contracting with any such agency with respect to work performed under such contract." For purposes of this definition, the use of appropriated federal funds includes the use of federal funds commingled with state or local funds. The second question is, does the government agency purchase a product designated in an EPA guideline? The affirmative procurement program requirements in §6002 are limited to products specifically designated by EPA procurement guidelines. Procuring agencies, however, are encouraged to establish affirmative procurement programs for other available items made with recycled materials. In addition to designating which items are covered by §6002, EPA procurement guidelines provide recommendations for government agencies to carry out the responsibilities of §6002. To date, EPA has issued five procurement guidelines. The guidelines are found in 40 CFR Parts 248, 249, 250,252 and 253, and provide recommendations for the procurement of building insulation, cement and concrete containing fly ash, paper and paper products, re-refined lubricating oil, and retread tires, respectively. Finally, does the government agency purchase $10,000 or more worth of a product designated in an EPA guideline during the course of the current fiscal year or did the agency purchase $10,000 or more worth of a ------- Hotline Questions and Answers August 1993 designated item or functionally equivalent items during the preceding fiscal year? Each guideline specifies how "functional equivalence" should be interpreted to determine whether the government agency has reached the $10,000 threshold. If the answer to all three of the above questions is yes, the agency must comply with the requirements of §6002. It is intended for use at RCRA sites where contamination is marginal or primarily removed, and it may be feasible to build functional structures that can reduce some of the environmental hazards. Written to assist Regional and state personnel, the manual includes information on the corrective action program, suitable conditions for structural development, major categories of contaminated sites, design components and configurations, measures of effectiveness, and examples of sites. TITLE: "RCRA Environmental Indicators: FY 1992 Progress Report" AVAILABILITY: Hotline EPA ORDER NO.: EPA530-R-93-011 This report contains information about environmental indicators that help measure the progress of the RCRA program. There are 12 environmental indicators which span the three major goals of RCRA: waste minimization, safe management, and corrective action for solid and hazardous wastes. The report presents program goals, indicator reports from fiscal year 1992, and an outlook for fiscal year 1993. Examples of indicator topics include quantity of waste generated, trends in solid waste recycling, quantity and method of waste management, and facility violations. TITLE: "Environmental Fact Sheet: Large- Volume Wastes from Coal-Fired Electric Utilities Exempt as Hazardous Waste" AVAILABILITY: Hotline EPA ORDER NO.: EPA530-F-93-014 This fact sheet provides an overview of EPA's final determination that four large-volume wastes from coal-fired electric utilities will remain exempt from regulation as hazardous wastes. The specific wastestreams are fly ash, bottom ash, boiler slag, and flue gas desulfurization wastes. The fact sheet describes new data collected to supplement a 1988 Report to Congress which recommended continuation of the exemption. ------- New Publications August 1993 CERCLA TITLE: "Revisions to OMB Circular A-94 on Guidelines and Discount Rates for Benefit-Cost Analysis" AVAILABILITY: NTIS NTIS ORDER NO.: PB93-963 297 This memorandum announces Office of Management and Budget (OMB) revisions to the Circular A-94. The Circular A-94 provides guidance on benefit-cost analysis, lease purchase analysis, and the revised discount rate. The discount rate, which has been changed to seven percent, should be used for present worth calculations to determine the cost effectiveness of potential remedies in the remedial investigation/feasibility study (RI/FS). TITLE: "Superfund Accelerated Cleanup Model (SACM): Questions and Answers" AVAILABILITY: NTIS NTIS ORDER NO.: PB93-963 286 This bulletin provides answers to questions raised by the Regions on the implementation of the Superfund Accelerated Cleanup Model (SACM). TITLE: "Environmental Fact Sheet: 1998 Financial Responsibility Compliance Deadline for Underground Storage Tank Owners That Meet Certain Federal Criteria; Proposed Rule" AVAILABILITY: Hotline EPA ORDER NO.: EPA510-F-93-016 This fact sheet summarizes a proposed rule published on August 17,1993 (58 ER 43770), that proposes to extend the financial responsibility compliance deadline for certain tank owners that meet federally determined criteria. The proposed rule asks for comment on whether to extend the financial responsibility deadline to December 31, 1998, from the current deadline of December 31, 1993, for a limited number of owners. The exclusion pertains to listed hazardous wastes with waste codes P003 and F005 generated at the facility. This rule is effective as of August 9,1993. "Regulatory Determination; Wastes from the Combustion of Coal by Electric Utility Power Plants" August 9,1993 (58 EB 42466) As required by RCRA §3001(bX3)(Q, EPA presented the final regulatory determination on four large-volume wastes generated by die combustion of coal at electric utility plants. The Agency will continue to exempt fly ash, bottom ash, boiler slag, and flue gas emission control waste from regulation as hazardous wastes under RCRA Subtitle G This rule is effective as of September 2,1993. "Hazardous Waste; Testing and Monitoring Procedures" August 31,1993 (58 EB 46040) EPA amended the RCRA hazardous waste regulations for testing and monitoring procedures. These amendments replace the current Second Edition, including Updates I and n, of the EPA- approved test methods manual Test Methods for Evaluating Solid Waste. Physical/Chemical Methods. EPA publication SW-846, by incorporating by reference the Third Edition into the RCRA regulations. This rule is effective on August 31,1993. PROPOSED RULES RCRA " Public Meeting of the Hazardous Waste Manifest Rulemaking Committee" August 25,1993 (58 EB 44799) As required by the Federal Advisory Committee Act, EPA gave notice of the next public meeting of the Hazardous Waste Manifest Rulemaking Committee. The purpose of the meeting is to finalize revisions to the uniform national hazardous waste manifest form and rule. The meeting is open to the public. "Hazardous Waste Management System; Testing and Monitoring Activities" August 31,1993 (58 EB 46052) EPA proposed to revise certain test methods used in complying with Subtitle C of RCRA. These new and revised methods, designated as Update n, are proposed to be added to the Third Edition of Issi Methods for Evaluating Solid Waste. Physical/ Chemical Methods. EPA publication SW-846. Comments must be submitted on or before November 1,1993. ------- Federal Registers August 1993 PROPOSED RULES OUST " Underground Storage Tanks Containing Petroleum; Financial Responsibility Requirements" August 17,1993 (58 MB 43770) EPA proposed a rule to allow certain members of the regulated community to become part of a new compliance group subject to a new financial responsibility compliance date of December 31, 1998. The members of the proposed group include petroleum marketers with 1 to 12 USTs at more than 1 facility, local governments, and Indian tribes that meet certain additional federal criteria. Comments must be received on or before October 1,1993. CERCLA "National Priorities List; Plymouth Harbor/ Cannons Engineering Site" August 25,1993 (58 EB 44804) EPA announced the intention to delete the Plymouth Harbor/Cannons Engineering Site in Plymouth, Massachusetts, from the National Priorities List This action is being taken because EPA and the Commonwealth of Massachusetts have determined that all appropriate CERCLA actions have been implemented and no further cleanup at the site is necessary. "Minnesota; Final Determination of Adequacy of State/Tribal Municipal Solid Waste Permit Program" August 16,1993 (58 Ffi 43350) Pursuant to RCRA §4005(cXl)(Q, EPA gave notice of a final determination of full program adequacy for Minnesota's municipal solid waste landfill permit program. The determination of adequacy is effective August 16,1993. "Consent Decree; Alaska Pulp Corporation" August 17,1993 (58 EB 43653) A Consent Decree in United States v. Alaska Pulp Corporation was lodged with the U.S. District Court for the District of Alaska on August 4,1993. The decree requires the defendants to remove all hazardous wastes from a dump in the Tongass National Forest in southeast Alaska. The decree also requires Alaska Pulp Corporation to clean up several areas contaminated with petroleum and to pay a civil penalty of $250,000. "Waste Isolation Pilot Rant Subcommittee; Public Meeting" August 18,1993 (58 EB 43891) EPA gave notice of a two-day meeting of the Waste Isolation Pilot Plant Subcommittee of the National Advisory Council for Environmental Policy and Technology on September 22 and 23, 1993, in Albuquerque, New Mexico. RCRA/CERCLA "Agency for Toxic Substances and Disease Registry; Health Activities Recommendation Panel" August 9,1993 (58 EB 42327) The Agency for Toxic Substances and Disease Registry (ATSDR) announced the availability of Fiscal Year 1994 funds to develop a research program to conduct site-specific health activities related to human exposure to hazardous substances at hazardous waste sites or releases. Environmental Waste Control. Inc.. was lodged with the U.S. District Court for the Northern District of Indiana on August 11,1993. The decree requires the defendants to reimburse EPA approximately $300,000 in response costs incurred in connection with the Four County Landfill in Fulton County, Indiana Comments will be received for a period of 30 days from the date of publication. CERCLA "Modified Consent Decree; Lowry Landfill Site" August 2,1993 (58 F_B 41104) A modified Consent Decree in IMsdJSiaJss v. City and County of Denver was lodged with the U.S. District Court for the District of Colorado on July 13, 1993. The decree requires an upgrade of water collection systems at the Lowry Landfill Site in Arapahoe County, Colorado, and that the defendants reimburse EPA $15,000 for violations of the existing Consent Decree. Comments will be received for a period of 30 days from the date of publication. "Consent Decree; Potter's Pits Site" August 2, 1 993 (58 FB 41 104) A Consent Decree in I Tnited S Skipper, et al. was lodged with the U.S. District Court for the Eastern District of North Carolina on July 16, 1993. The decree requires the defendants to reimburse EPA $230,000 in response costs incurred in connection with the Potter's Pits Site in Maco, North Carolina.
