K052: Bottoms from Tanks Storing Leaded Gasoline at Petroleum Refineries According to 40 CFR §26132, the hazardous waste code K052 applies to "tank bottoms (leaded) from the petroleum refining industry." A variety of petroleum fractions including leaded gasoline are stored in product tanks at refineries. Bottoms from all of these tanks may contain lead. Does the K052 listing apply only to bottoms from tanks storing leaded gasoline, or does it apply to lead-containing bottoms from refinery tanks storing any petroleum fractions? EPA intended the K052 listing to apply only to bottoms from tanks storing leaded gasoline at petroleum refineries. The listing does not apply to bottoms from tanks storing other petroleum fractions, like diesel, even if those bottoms contain lead. Tanks bottoms that do not carry the K052 code can still be regulated under RCRA Subtitle C if they exhibit one or more characteristics of hazardous waste. EPCRA 2. Medical Exclusion Under EPCRA §§311 and 312 as it Applies to Doctors' Offices and Pharmacies EPCRA §§311 and 312 require facility owners or operators to file inventory reports detailing the name, amount, and location of hazardous chemicals present at a facility in excess of the established threshold quantities. Hazardous chemicals are defined by OSHA's Hazard Communication Standard, found at 29 CFR §1910.1200(c), which requires facility owners or operators to maintain material safety data sheets for all hazardous chemicals present at the facility. EPCRA §311(e)(4) and 40 CFR §370.2 exclude from the definition of hazardous chemical, "any substance to the extent that it is used in a research laboratory or a hospital or other medical facility under the direct supervision of a technically qualified individual." The EPCRA program has adopted the definition of a technically qualified individual from the Toxic Substances Control Act (TSCA) regulations found at 40 CFR §720.3(ee); the term includes any person who, because of education, training, or experience is capable of understanding the health and environmental risks associated with the chemical under the individual's supervision Does the EPCRA medical exclusion apply to chemicals stored and used at doctors' office<, and pharmacies? In order to be excluded from the definition of hazardous chemical, a substan^ ;• ------- Hotline Questions and Answers February 19.94' must be both under the supervision of a technically qualified individual and present at a medical facility. EPA interprets technically qualified individual to refer to those persons who are adequately trained in the research or medical fields, including doctors, nurses, and pharmacists. Further, both doctors' offices and pharmacies are considered medical facilities. When a substance is used by a physician or a pharmacist at either a doctors' office or a pharmacy, it does not meet the definition of a hazardous chemical and therefore should not be included in threshold determinations under §§311 and 312. The exclusion also applies to the storage of chemicals at these facilities prior to their use. The medical exclusion applies only to the specific substances meeting the above criteria, and dr^es not exempt the facility from the require ments of § § 311 and 312; any hazardous chemicals not meeting an exclusion must be applied toward the inventory threshold. Other exclusions commonly applicable to doctors' offices and pharmacies include those found at EPCRA §311(e)(l) and (3) exempting chemicals which are present in consumer form or which are regulated by the Food and Drug Administration. CERCLA 3. Mineral Spirits and the CERCLA Definition of Hazardous Substance Are mineral spirits considered petroleum derivatives and therefore excluded from the CERCLA definition of hazardous substance? CERCLA addresses cleanup of hazardous substance sites and response to emergencies involving releases of hazardous substances. CERCLA §101(14) specifically excludes petroleum from the definition of hazardous substance, consequently petroleum releases are not subject to CERCLA reporting and liability provisions. The petroleum exclusion includes "crude oil or any fraction" of petroleum unless the fraction is specifically listed or designated under the statute. Mineral spirits, also known as stoddard solvent, naphtha, or white spirits, are usually derived from refined petroleum distillates from the light end of crude oil but could possibly be derived from coal. Mineral spirits that are distilled from petroleum are considered petroleum for the purpose of CERCLA §101(14) and lerefore, are excluded from the definition of hazardous substance. Mineral spirits often contain substances, such as toluene, that are CERCLA hazardous substances. If these substances are present na: 'ally or are added to petroleum-derived m:f .c;ral spirits in the normal refining process, then they would be excluded as petroleum as well. However, hazardous substances added to mineral spirits outside the refinery process or which increase in concentration solely as a result of contamination during use are not part of the "petroleum" and, thus, are not excluded from CERCLA regulation. In such cases EPA may respond to releases of the added substance, but not the mineral spirits itself. There are circumstances in which mineral spirits could be regulated as a hazardous substance. For instance, coal-derived mineral spirits would not qualify for the petroleum exclusion and potentially could be regulated as a hazardous substance. The programs differ significantly in size and material recovery rates and represent a cross-section of recycling programs in the country. The report is intended to provide other communities with information to improve their own programs. Topics include implementing waste prevention strategies, composting programs, improving residential and commercial recycling levels, and recycling and composting costs. TITLE: "List of Municipal Solid Waste Landfills" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-136 710 This report is divided into two sections. The first section contains the number of municipal solid waste sites per state and a list of any additional information that is available from each state, such as capacity infonnation, types of waste accepted, and permitting infonnation. CERCLA TITLE: "Superfund Guide: Clean Air Act Hazardous Air Pollutants Added to the List of CERCLA Hazardous Substance" AVAILABILITY: NTIS NTIS ORDER NO.: PB93-963 425 This fact sheet identifies the 52 Clean Air Act hazardous air pollutants that have been added to the list of CERCLA hazardous substances and are therefore subject to CERCLA notification requirements. Specifically, the fact sheet describes the reporting requirements and exemptions under CERCLA, and examines the reporting exemptions in relation to releases of ethylene glycol. TITLE: "Procedures to Ensure that CLP Laboratories are Not Paid for Non-Complaint or Unuseable Data" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-963 214 This directive reviews and emphasizes the procedures for ensuring that Superfund Contract Laboratory Program (CLP) laboratories are not paid for non-compliant or unuseable data. The directive also outlines the procedures that should be used when it is appropriate for the Agency to withhold payment. TITLE: "Meeting Summary: National Advisory Council for Environmental Policy and Technology Subcommittee on Radiation Cleanup Regulation" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-136678 This publication contains the meeting minutes for the first meeting of National Advisory Council for Environmental Policy and Technology, Subcommittee on Radiation Cleanup Regulation held on October 18 and 19,1993. This meeting provided advice to Administrator Browner on the issues associated with radiation cleanup regulations. OTHER pollution burden. The new executive order directs every federal agency to review its operations and publish a plan for addressing environmental justice concerns. The order also requires agencies to collect, maintain, and analyze information on the race, national origin, and income levels of areas surrounding certain federal facilities subject to EPCRA. The Administration believes that minority and low-income communities often bear a disproportionate share of the nation's ------- FEDERAL REGISTERS FINAL RULES RCRA "Alabama; Final Authorization of Revisions to State Hazardous Waste Management Program" February 1,1994 (59 EB 4594) EPA intends to approve Alabama's hazardous waste program revisions under RCRA. Final authorization will be effective April 4,1994, unless EPA publishes a prior action withdrawing this immediate final rule. Comments must be received on or before March 3,1994. "Identification and Listing of Hazardous Waste; Amendment" February 8,1994 (59 EB 5725) EPA amended 40 CFR Part 261, Appendix DC to reflect changes in ownership and name for the General Cable Company in Muncie, Indiana, and to delete exclusions that have been terminated. These changes are effective February 8,1994. 'Identification and Listing of Hazardous Waste; Treatability Studies Sample Exclusion" February 18,1994 (59 FR 8362) EPA increased the quantity of contaminated media which are conditionally exempt from Subtitle C regulation when used in conducting treatability studies. This rule is effective February 18,1994. "Missouri; Interim Authorization of Revisions to State Hazardous Waste Management Program" February 23,1994 (59 EB 8545) EPA intends to approve Missouri's hazardous waste program revisions under RCRA. Final authorization will be effective April 25,1994, unless EPA publishes a prior action withdrawing this immediate final rule. Comments must be received on or before March 25,1994. UST "Underground Storage Tanks (USTs) Containing Petroleum; Financial Responsibility Requirements" February 28,1994 (59 EB 9604) EPA extended the date by which federally- recognized Indian tribes need to comply with financial responsibility requirements for petroleum USTs on Indian lands. The compliance date for these USTs is December 31,1998. CERCLA "National Priorities List (NPL) for Uncontrolled Hazardous Waste Sites" February 23,1994 (59 EB 8724) With this final rule, EPA added one site to the NPL. The NPL now has 1,191 sites, 1,068 in the general Superfund section and 123 in the federal facilities section. This rule is effective March 25, 1994. ------- Federal Registers February 1994 PROPOSED RULES RCRA "Standards for the Management of Specific Hazardous Wastes; Recyclable Materials Used in a Manner Constituting Disposal" February 23,1994 (59 EB 8583) EPA proposed to amend 40 CFR §26620, which contains provisions for conditionally exempting hazardous waste-derived products used in a manner constituting disposal from RCRA Subtitle C Comments must be submitted on or before March 25,1994. RCRA/GSA "General Services Acquisition Regulation; Contractor Identification of Products with Environmental Attributes" February 10,1994 (59 EB 6231) EPA requested comments on a proposed revision to the General Services Administration Acquisition Regulation. The proposed revision requires multiple award schedule contractors to identify supplies containing recovered materials, and to describe the environmental benefits associated with them. Comments must be submitted on or before April 11,1994. NOTICES RCRA " Extension of Comment Period on the Report to Congress on Cement Kiln Dust" February 11,1994 (59 EB 6640) EPA announced a two week extension of the comment penod on the recently released Report to Congress on Cement Kiln Dust EPA will hold a public hearing on the Report to Congress on February 15,1994. Comments must be submitted on or before March 8,1994. "North Carolina; Final Authorization of Revisions to State Hazardous Waste Management Program" February 16,1994 (59 EB 7641) EPA published a notice clarifying the approved list of authorities published in the January 27,1994, Federal Register (59 ER 3792) for final authorization of revisions to North Carolina's Hazardous Waste Management Program. Final authorization will be effective March 28,1994, unless EPA publishes a prior action withdrawing the immediate final rule. CERCLA "Radiation Cleanup Regulation Subcommittee; Public Meeting" February 2,1994 (59 EB 4920) EPA gave notice of a meeting of the Radiation Cleanup Regulation Subcommittee of the National Advisory Council for Environmental Policy and Technology on February 24, °°4, via conference call "Administrative Settlement; AERR Company Site" February 2,1994 (59 EB 4921) EPA proposed to enter into an administrative settlement under CERCLA § 122(i). The settlement requires the settling parties to reimburse EPA $488,867 for costs incurred in connection with the AERR Company Site in Jefferson County, Colorado. Comments must be submitted on or before March 4,1994. ------- February 1994 Federal Registers NOTICES "National Priorities List; Monroe Township Landfill Site" February 3,1994 (59 EB 5109) EPA announced the deletion of the Monroe Township T ^nHfill Site in Middlesex County, New Jersey, from the National Priorities List This action was taken because EPA and the State of New Jersey determined that no further cleanup under CERCLA was appropriate. "Superfund Evaluation Committee; Public Meeting" February 7,1994 (59 EB 5599) EPA gave notice of a meeting of the Superfund Evaluation Committee of the National Advisory Committee for Environmental Policy and Technology to be held on February 11,1994, in Arlington, Virginia. The subcommittee will offer comments on the proposed Superfund legislation and discuss its role in the reauthorization process. "Administrative Settlement; Black Forest Drums Site" February 8,1994 (59 EB 5768) EPA proposed to enter into an administrative settlement under CERCLA §122(i). The settlement requires the settling parties to reimburse EPA $22,000 for costs incurred in connection with the Black Forest Drums Site in Black Forest, Colorado. Schilling Site" February 8,1994 (59 EB 5768) EPA gave notice of a proposed de minimis settlement under CERCLA § 122(g). The settlement requires the settling parties to reimburse EPA $236,663 for costs incurred in connection with the E.FL Schilling Site in Ironton, Ohio.
