Unused Formulations Containing Sodium Pentachlorophenate are F027 The F027 hazardous waste listing includes discarded, unused formulations containing tri-, tetra-, or pentachlorophenol, as well as compounds derived from these chlorophenols (40 CFR §261.31). Does an unused chemical formulation that contains sodium pentachlorophenate meet the F027 listing when discarded? Unused formulations containing sodium pentachlorophenate meet the F027 listing when discarded. Sodium pentachlorophenate, a wood surface protectant used to prevent sapstaining in freshly cut lumber, is a compound derived from pentachlorophenol by dissolving pentachlorophenol in sodium hydroxide (58 FR 25706,25708; April 27, 1993). Chlorophenolic compounds and their chlorophenoxy derivatives, such as sodium pentachlorophenate, have serious adverse health effects (48 EB. 14514,14516; April 4, 1983). Formulations containing these compounds also contain chlorinated dioxins and dibenzofurans. For these reasons, wastes meeting the F027 listing are designated as acutely hazardous (50 FR 1978,1979-1982; January 14,1985), 2. Satellite Accumulation Standards as ARARs During the planning ofSuperfund remedial activities, any applicable or relevant and appropriate requirements (ARARs) need to be identified (40 CFR §§300.400(g) and 300.430(d)(3)). Only the substantive provisions of the ARARs, however, must be complied with during the activity. The substantive provisions of an ARAR are generally those requirements that pertain directly to actions or conditions in the environment, such as incinerator performance standards, land disposal restrictions (LDR) treatment standards, or hazardous waste storage standards (OSWER Directive 9234.2- 04FS). If the hazardous substance managed at a National Priorities List (NPL) site meets the definition of a RCRA hazardous waste, then any applicable substantive portions of the RCRA regulations will be ARARs. During a remedial action at an NPL site, a RCRA hazardous waste may be generated. The generator may wish to accumulate the hazardous waste at the initial point of generation (i.e., a satellite accumulation area) to avoid moving small amounts of hazardous waste to the main waste storage area. Can hazardous waste generated at a Superfund site be kept in satellite accumulation areas prior to being moved into accumulation tanks or containers in the main waste storage area? ------- Hotline Questions and Answers August 1994 The substantive provisions of the hazardous waste accumulation regulations in §262.34, including the satellite accumulation standards of §262.34(c), are applicable to hazardous waste generated at Superfund sites (and may be relevant and appropriate for other wastes). Hazardous waste at Superfund sites may accumulate in satellite areas that meet the requirements specified in the satellite accumulation standards of §262.34(c). That rule allows a hazardous waste generator to accumulate up to 55 gallons of hazardous waste or one quart of acutely hazardous waste at or near the point of generation where wastes initially accumulate. When 55 gallons of hazardous waste or one quart of acute hazardous waste has accumulated at the satellite area, the generator has three days to move the hazardous waste to the main waste storage area at the NPL site (i.e., a storage area meeting the more stringent design and operation requirements specified in §262.34(a)). Once the waste leaves the satellite area by being placed in tanks or containers at the main waste storage area it becomes subject to the substantive waste storage requirements, such as the secondary containment standards, of 40 CFR Parts 264 and 265, Subparts I and J (and other requirements in §262.34(a). than established thresholds. If a facility meets the criteria, its owners or operators must file MSDSs and Tier I and II inventory forms with their State Emergency Response Commission, their Local Emergency Planning Committee, and their local fire department. May a facility which maintains an on-sitefire department provide the information to that entity in lieu of making it available to the public fire department? Whichever fire department may have responsibility for the facility, regardless of its affiliation, should receive the reports. The purpose of the requirement to provide local fire departments with MSDS and inventory information is to better enable them to respond to emergency situations. If the on-site fire department is primarily responsible for responding to such an incident, it is appropriate that covered facilities forward the required information to that department. Facility owners or operators should also forward copies of MSDSs and Tier forms to any other fire department that might be expected to respond to a chemical emergency at the facility. EPCRA 3. TITLE: "Reusable News, Summer 1994" AVAILABILITY: Hotline EPA ORDER NO.: EPA530-N-94-004 Reusable News is a quarterly newsletter that reports on municipal solid waste management issues. The Summer 1994 edition contains an article about a recycling project being implemented at the White House called "The Greening of the White House." It also addresses how the Federal Trade Commission (FTC) identifies manufacturers that incorrectly claim their products are environmentally friendly. This issue introduces "Recover America," a new program designed to bolster waste prevention in the U.S., and discusses views on municipal waste flow control presented by representatives from three communities. The newsletter also addresses a May 2, 1994, ruling by the U.S. Supreme Court stating that ash from municipal waste-to- energy combustion facilities is not exempt from RCRA hazardous waste regulation. TITLE: "Environmental Fact Sheet: EPA Simplifies Land Disposal Restrictions by Establishing a Set of Universal Treatment Standards, Finalizes Treatment Standards for 42 Newly Listed and Identified Wastes" AVAILABILITY: Hotline EPA ORDER NO.: EPA530-F-94-025 This fact sheet provides an overview of a rule streamlining the existing LDR treatment standards. The rule establishes treatment standards for 42 of the wastes listed or identified since the enactment of HSWA, as well as a set of universal treatment standards for over 200 constituents. TITLE: "Environmental Fact Sheet: Certain Hazardous Waste Slag Uses Now Subject to Regulation" AVAILABILITY: Hotline EPA ORDER NO.: EPA530-F-94-024 This fact sheet provides an overview of a rule prohibiting the use of hazardous waste-derived high temperature metal recovery (HTMR) slag residues. While prohibiting anti-skid and de- icing uses on land, the rule does not restrict HTMR slag use in compliance with 40 CFR §266.20 requirements, nor does it prohibit HTMR slag disposal in Subtitle D landfills ------- August 1994 New Publications provided the risk-based levels specified in §261.3(c)(2)aremet. TITLE: "Setting Priorities for Hazardous Waste Minimization" AVAILABILITY: Hotline EPA ORDER NO.: F-94-WMNA-S0002 Designed as a first step in implementing the Draft RCRA Waste Minimization National Plan, this document details a proposed hazard- based methodology for ranking wastestreams and industrial processes to receive EPA's top priority with regard to waste minimization. Also known as the "Draft Methodology Document," this document outlines the criteria used to develop the prioritization methodology. TITLE: "Appendices to Setting Priorities for Hazardous Waste Minimization" AVAILABILITY: Hotline EPA ORDER NO.: F-94-WMNA-S0002.A In support of the document entitled Setting Priorities for Hazardous Waste Minimization. EPA has compiled a set of appendices including a list of the 150 most frequently combusted wastes and a summary of prioritization systems studied in compiling this new methodology. CERCLA TITLE: "Superfund Technical Assistance Grant (TAG) Handbook: Procurement—Using TAG Funds" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-963 354 Technical Assistance Grant (TAG) funds are spent primarily on hiring technical advisors, grant administrators, and obtaining supplies, equipment, and other approved items. This handbook outlines the procedures that must be followed when spending grant funds. The federal regulations governing the selection of technical advisors and other products and services are designed to ensure that each group conducts all selection activities in a manner that guarantees maximum open and free competition. TITLE: "Military Base Closures: Guidance on EPA Concurrence in the Identification of Uncontaminated Parcels Under CERCLA §120(h)(4)" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-963 249 This memorandum addresses an approach EPA may use in determining whether a parcel has been properly identified by the military as "uncontaminated" and therefore transferable pursuant to CERCLA §120(h)(4). According to CERCLA §120(h)(4), only federal property on which no hazardous substances and no petroleum products or their derivatives were known to have been released, disposed of, or stored for one year or more, may be sold or otherwise transferred. To allow property transfers to occur more quickly, EPA has published examples of three categories of parcels where EPA would generally concur with the military designation of "uncontaminated." TITLE: "Superfund Chemical Data Matrix" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-963 506 The Superfund Chemical Data Matrix (SCDM) is a source for factor values and benchmark values to be applied when evaluating potential National Priority List (NPL) sites using the Hazard Ranking System (HRS). TITLE: "Superfund Chemical Data Matrix: Appendix B Tables" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-963 507 This version of SCDM is a subset of the larger document described above. Appendix B contains tables of hazardous substance factor values and hazardous substance benchmarks for non-radioactive hazardous substances and radionuclides. Chemical data are not included. TITLE: "Update on SACM" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-963 237 This fact sheet reports on the use of the Superfund Accelerated Cleanup Model (SACM) in different EPA Regions. Activities include staff changes to encourage cross- program integration, reduction of the Site Inspection Prioritization (SIP) backlog, and a regional site evaluation process for screening newly discovered sites. TITLE: "Revised Interim Soil Lead Guidance for CERCLA Sites and RCRA Corrective Action Facilities" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-963 282 This interim directive establishes a streamlined approach for determining protective levels for lead in soil at CERCLA sites and RCRA facilities subject to corrective action. It does not establish a cleanup level, but defines a residential soil screening level of 400 ppm, and outlines a process for calculating site specific cleanup standards through the use of the Integrated Exposure Uptake Biokinetic Model for Lead in Children. EPCRA TITLE: "Title IILList of Lists: Consolidated List of Chemicals Subject to the Emergency Planning and Community Right-to-Know Act and §112(r) of the Clean Air Act as Amended" AVAILABILITY: Hotline EPA ORDER NO.: EPA500-B-94-002 Facilities that have specifically designated chemicals on site above certain thresholds or use chemicals above activity thresholds may need to report to their Local Emergency Planning Committee, State Emergency Response Commission, and EPA. The Title III List of Lists presents the chemical names, Chemical Abstract Service numbers, and applicable thresholds of many of the lists of chemicals subject to reporting under EPCRA and the Clean Air Act. The document contains the extremely hazardous chemicals, CERCLA hazardous substances, toxic chemicals, and Clean Air Act regulated substances. TITLE: "Explosion Hazard from Ethyl Ether in Disaster Hospital Kits" AVAILABILITY: Hotline EPA ORDER NO.: EPA550-B-94-001 Ethyl ether was distributed to states in the 1960s and 1970s as part of civil defense hospital kits. Originally intended as an anesthetic, the ethyl ether remaining in the kits should later have been disposed. Much of the chemical was not removed and now poses an explosive and toxic hazard. This fact sheet describes the specific hazards presented by the unstable chemical and the proper procedures for its disposal. ------- August 1994 New Publications OTHER TITLE: "Guide on Residential Lead-Based Paint, Lead Contaminated Dust, and Lead- Contaminated Soil" AVAILABILITY: NTIS NTIS ORDER NO.: PB94-963 284 This guidance was issued in response to concerns from EPA regional offices, state offices, and the general public about the hazards resulting from residential lead-based paint. "North Carolina; Final Authorization of Revisions to State Hazardous Waste Management Program" August 23,1994 (59 FR 43290) EPA responded to public comments regarding, and reaffirmed, its decision (59 FR 32177; June 23,1994) to approve North Carolina's hazardous waste program revisions. Final authorization for North Carolina's program revisions is effective August 22,1994. "Recyclable Materials Used in a Manner Constituting Disposal" August 24,1994 (59 FR 43496) EPA amended §266.20 so that certain uses of slag residues produced from the high temperature metal recovery (HTMR) treatment of electric arc furnace dust (K061), steel finishing pickle liquor (K062), and electroplating sludges (F006) are not exempt from Subtitle C regulations. EPA clarifies the definition of non- encapsulated uses of HTMR slags by specifying these uses to be the anti-skid/deicing uses. This action effectively prohibits anti-skid/deicing uses of HTMR slags derived from K061, K062, and F006 as waste-derived products placed on the land. This rule does not prohibit other uses of these slags that meet §266.20(b) requirements, nor does it prevent the disposal of HTMR slags in a Subtitle D unit if the residuals meet the risk- based exclusion levels specified in §261.3(c)(2). ------- Federal Registers August 1994 EPCRA "Trade Secrecy Claims; Change of Address" August 22,1994 (59 FR 43048) EPA announced a new mailing address to be used by facilities when submitting trade secrecy claims to EPA, and by petitioners when submitting petitions requesting disclosure of chemical identities claimed trade secret under §§303(d)(2) and (d)(3), 311,312, and 313 of EPCRA. The change is effective August 15, 1994. PROPOSED RULES CERCLA "National Priorities List (NPL); Additions" August 23,1994 (59 FR 43314) EPA proposed to add 10 new sites to the NPL, 6 sites in the General Superfund Section and 4 sites in the Federal Facilities Section. Final and proposed sites now total 1,296. Comments on these additions must be submitted on or before October 24,1994. CERCLA/DOI "Natural Resource Damage Assessments" August 8,1994 (59 FR 40319) The Department of the Interior proposed to amend the regulations for assessing natural resource damages resulting from a discharge of oil into navigable wasters under the Clean Water Act or a release of a hazardous substance under CERCLA. Comments must be received on or before November 7,1994. NOTICES RCRA "Waste Minimization Draft Methodology Document; Request for Comment" August 12,1994 (59 FR 41442) EPA announced the availability of the draft methodology entitled Setting Priorities for Hazardous Waste Minimization. "Expanded Public Participation and Revisions to Combustion Permitting Procedures; Reopening of Comment Period- August 15,1994 (59 FR, 41741) EPA reopened the comment period for the RCRA Expanded Public Participation and Revisions to Combustion Permitting Procedures proposed rule, which was published on June 2, 1994 (59 FR 28680). Comments must now be submitted on or before September 1,1994. "Hazardous Waste Management System; Land Disposal Restrictions" August 15,1994 (59 EB41741) Pursuant to RCRA §3004(h)(3), EPA proposed to approve the application submitted by Great Lakes Chemical Corporation, requesting an extension of the June 30,1994, effective date of the RCRA land disposal restrictions applicable to wastewater with certain waste codes. The determination of adequacy is effective August 16,1994. In this report, EPA examines the existing and emerging hazardous waste management planning needs of several states, describes planning practices designed to address those needs, and relates state observations on the relationship of their planning needs and activities to the Federal Capacity Assurance Planning Process. "Consent Decree; Gulf States Steel, Inc." August 25,1994 (59 FR 43859) A Consent Decree in United States v. Gulf States Steel. Inc.. was lodged with the U.S. District Court for the Northern District of Alabama on August 12,1994. The decree requires the settling party to pay $800,000 in civil penalties and use $300,000 to undertake pollution abatement projects. Comments will be received for a period of 30 days from the date of publication. "Puerto Rico; Final Determination of Adequacy of State/Tribal Municipal Solid Waste Permit Program" August 26,1994 (59 FR 44144) Pursuant to RCRA §4005(c)(l)(C), EPA gave notice of a final determination of full program adequacy for Puerto Rico's municipal solid waste landfill permit program. The determination of adequacy is effective August 26,1994. "Land Disposal Restrictions Treatability Variance; Citgo Petroleum" August 30,1994 (59 FR 44684) EPA proposed to grant a site-specific treatability variance from the land disposal restriction treatment standards for F037 and F038 nonwastewaters contained in a surface impoundment at the Citgo Corporation petroleum refinery located outside Lake Charles, Louisiana. "Definition of Solid Waste and Hazardous Waste Recycling; Open Meeting" August 31,1994 (59 FR 44987) EPA announced that two public meetings will be held to address recommended actions from an internal Agency task force for revising the regulatory definition of solid waste under RCRA. The first meeting will be held in Chicago, Illinois, on September 20,1994. The second will be held in Edison, New Jersey, on September 27, 1994. OUST "Iowa; Approval of State Underground Storage Tank (UST) Program" August 9,1994 (59 FR 40507) EPA intends to grant final approval to Iowa to operate a UST program in lieu of the federal program submitted on or before September 8, 1994. CERCLA "Consent Decree; Para-Chem Southern, Inc. Site" August 4,1994~(59 FR 39782) A Consent Decree in United States v. Para- Chem Southern Inc.. was lodged with the U.S. District Court for the District of South Carolina on July 22,1994. The decree requires the defendant to reimburse EPA for costs incurred in connection with the Para-Chem Southern, Inc. Site in Simpsonville, South Carolina.
