Mixed waste is waste that contains a hazardous waste component and a radioactive material component. A hazardous waste is either listed under 40 CFR Part 261, Subpart D, and/or exhibits a characteristic described in 40 CFR Part 261, Subpart C. Radioactive material must be classified as source, special nuclear, or byproduct material subject to the Atomic Energy Act of 1954 (AEA) (42 U.S.C. §201 etseq.). How is mixed waste regulated? Mixed waste is jointly regulated under both RCRA and the AEA. RCRA regulates the hazardous waste portion of the waste as any other hazardous waste, while the AEA regulates the RCRA-exempt radioactive portion (52 FR, 15939; May 1,1987). Who regulates mixed waste? Mixed waste is regulated by EPA, the Nuclear Regulatory Commission (NRC), and, the Department of Energy (DOE). EPA regulates the hazardous waste portion, while the NRC or DOE regulate the radioactive portion. The NRC typically regulates mixed wastes from commercial and non-DOE federal facilities, while DOE regulates materials from DOE facilities. Who generates mixed waste ? Mixed waste is typically generated by certain federal facilities, nuclear power plants, industrial sites, research laboratories, and medical institutions (Mixed Waste Incineration: (1) Background. EPA402-F-95- 004). Do the land disposal restrictions apply to mixed waste ? » Mixed waste, regardless of its type of radioactive element, is hazardous waste and consequently subject to RCRA hazardous waste regulations, including the land disposal restrictions. Treatment standards for hazardous wastes are found in §268.40 of the RCRA regulations. In some cases special treatment standards are listed for mixed wastes, such as for radioactive lead solids (D008) and elemental mercury contaminated with radioactive materials (D009). When no special standards are listed, the normal treatment standards for the particular waste code apply (55 FR 22644; June 1, 1990). How are any inconsistencies that may arise between RCRA and AEA regulation resolved? Section 1006 of the RCRA statute provides that if application of both RCRA and AEA regulations creates a conflict, the AEA regulation would take precedence to the extent of the inconsistency between the regulations (OSWER Directive 9541.00-6; also 52 FR 15940; May 1, 1987). ------- Hotline Questions & Answers February 1997 2. Delay of Closure Owners or operators of permitted and interim status treatment, storage, and disposal facilities (TSDFs) must comply with the facility closure standards in 40 CFR Parts 264/265, Subpart G, and the specific standards applicable to the unit in which they are managing hazardous waste. These closure standards require owners or operators to treat, remove from the unit or facility, or dispose of on site all hazardous waste in accordance with the approved closure plan within 90 days after receiving the final volume of hazardous waste or within 90 days after approval of the closure plan, whichever is later (§§264/265.113(a)). Owners or operators of surface impoundments, landfills, and land treatment units can delay the closure timetable beyond the 90 day period and allow the units to accept nonhazardous waste, provided they meet conditions in §§264/ 265.113(d). Can owners or operators of tanks, container storage areas, waste piles, or incinerators at permitted or interim status TSDFs delay closure in this manner as well? No. The delay of closure provisions of §§264/265.113(d) are limited to landfills, surface impoundments, and land treatment units. Owners or operators of tanks, containers, waste piles, and incinerators are not allowed to delay closure and accept only nonhazardous waste in such units (54 FR 33381; August 14,1989). In order for these units to accept nonhazardous waste after the last shipment of hazardous waste has been received, the owner or operator must first „ comply with all applicable closure standards - including removing and decontaminating all contaminated equipment, soils, and structures. These closure standards are compatible with the future use of such units, and closing them before receiving nonhazardous waste should not place an undue burden on owners or operators (54 FR 33381; August 14, 1989). 3. Universal Waste Consolidation Point Regulation The universal waste management standards of 40 CFR Part 273 outline the streamlined provisions for handlers, transporters, and destination facilities that manage universal wastes. Section 273.6 defines a universal waste as hazardous batteries, pesticides, and thermostats. A handler, defined as a generator of universal waste (i.e., any person, by site, whose act or process produces hazardous waste or whose act first causes waste to become subject to regulation) is allowed to accumulate waste on site for up to one year. If a facility is not a generator of universal waste, yet is receiving universal waste and functioning as a consolidation and/or collection point, would the facility be regulated under the universal waste regulations? Yes, the facility would be regulated under the universal waste regulations if it is consolidating and/or collecting universal waste from generators or other handlers. The definition of a universal waste handler includes facilities that receive universal waste from other handlers (§273.6). A facility is allowed to consolidate and/or collect universal waste, provided the waste is sent on to other handlers, recyclers, or treatment/disposal facilities (60 FR 25500; May 11, 1995). Moreover, if the facility has several locations at which universal wastes are consolidated and/or collected, each location would be regulated as a separate handler. Additional RCRA requirements may apply if the facility is handling other types of hazardous waste (i.e., non-universal waste). ------- February 1997 Hotline Questions & Answers 4. K061, K062, and F006 HTMR Slag Residues and Use Constituting Disposal What is the current status of the proposal on Standards for the Management and Use of Slag Residues Derived From High Temperature Metals Recovery (HTMR) Treatment ofK061, K062, and F006 Wastes, that was published in the Federal Register on December 29, 1994 (59 FR 67256)? EPA is presently reevaluating the proposed rule due to significant issues raised by public commenters, and EPA may withdraw, repropose, or request additional public comment on the proposed rule at a future time. In the meantime, the use of K061, K062, and F006 slag residues as anti-skid/deicing materials is prohibited (40 CFR 266.20(c) and 50 FR 43496; August 24, 1994). The use of K061, K062, and F006 slag residues as road bed material and other uses constituting disposal is subject to the requirements for hazardous waste-derived products applied to the land (§266.20(b)). UST 5. Temporary Closure of USTs The following Monthly Report Question replaces the Monthly Report Question published in the October 1989 Monthly Hotline Report. Does an owner/operator of a temporarily ^- closed existing underground storage tank (UST) have to permanently close the UST after 12 months of temporary closure if the tank is not upgraded, or would the owner/operator have until December 22, 1998, to comply with the upgrading requirements? Although the UST upgrading requirements allow owners/operators until December 22, 1998, to upgrade their USTs, this time frame does not apply to USTs closed temporarily for more than 12 months. When a UST system is temporarily closed for more than 12 months, owners/operators must permanently close the UST system if it does not meet either the performance standards for new UST systems in §280.20 or the upgrading requirements in §280.21, except that the spill and overfill requirements do not have to be met (§280.70(c)). Owners/operators of a temporarily closed UST must permanently close the substandard UST system at the end of the 12-month period in accordance with §§280.71 through 280.74 unless the implementing agency provides an extension to the 12-month temporary closure period (§280.70(c)). However, owners/operators must complete a site assessment in accordance with §280.72 before applying for an extension. EPCRA 6. Personal Use Exemption and Cafeteria Refrigerants Under EPCRA Section 313 A facility uses toxic chemicals in its cafeteria refrigeration units. The units enable the cafeteria to store food that will later be served to staff of the facility. Would these chemicals need to be included in EPCRA §313 threshold determinations? No. Under the personal use exemption "foods, drugs, cosmetics or other personal items containing toxic chemicals, including supplies of such products within the facility such as in a facility operated cafeteria, store, or infirmary" used by employees or other persons at the facility are exempt from threshold determinations (40 CFR 372.38(c)(3)). The ------- Hotline Questions & Answers February 1997 toxic chemicals used in the cafeteria refrigeration units, therefore, are exempt from threshold determinations and release reporting requirements. FINAL RULES RCRA "Military Munitions Rule: Hazardous Waste Identification and Management; Explosives Emergencies; Manifest Exemption for Transport of Hazardous Waste on Right-of-Ways on Contiguous Properties" February 12,1997 (62 FR 6622) EPA finalized a rule that identifies when conventional and chemical military munitions become hazardous waste under RCRA, and provides for the safe storage and transportation of such waste. The rule amends existing regulations regarding emergency responses involving both military and non-military munitions and explosives, and provides an exemption from the manifest requirements for certain hazardous.waste generators and transporters. This rule is effective on August 12, 1997. "Land Disposal Restrictions: Correction of Tables; Treatment Standards for Hazardous Wastes and Universal Treatment Standards" February 19,1997 (62 £B 7502) EPA published updated and corrected versions of the complete tables of hazardous waste treatment standards at §268.40 and universal treatment standards at §268.48 published in the Land Disposal Restrictions Phase ffl Final Rule (61 FR 15566; April 8, 1996). The updated tables incorporate all revisions to the treatment standards since the Phase III Final Rule, as well as technical corrections, including the removal of treatment standards for the 25 waste codes that were vacated by the November 1,-1996, court decision, Dithiocarbamate Task Force v. Environmental Protection Agency. This rule is effective on February 19, 1997. ------- Federal Registers February 1997 "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Amendment" February 20,1997 (62 FR. 7684) EPA amended 40 CFR Part 261, Appendix IX, to reflect changes in ownership and name for United Technologies Automotive, Inc., Jeffersonville, Indiana. This rule is effective on February 20, 1997. "Hazardous Waste Management System; Identification and Listing of Hazardous Waste; Final Exclusion; Correction" February 26,1997 (62 FR 8632) EPA corrected the July 18, 1996, final rule (61 FR 37397) which granted a petition submitted by United Technologies Automotive, Inc. (UTA), Dearborn, Michigan, to exclude conditionally, on a one-time, upfront basis, a certain solid waste generated by UTA's chemical stabilization treatment of lagoon sludge at the Highway 61 Industrial Site in Memphis, Tennessee. EPA corrected the delisting levels for the constituents of concern to a dilution attenuation factor (DAF) of 79 for 40,000 cubic yards. The document does not establish new binding requirements but will guide EPA's implementation of 40 CFR Part 191, Subpart A, at the WIPP. CERCLA "Notice of Open Meeting; State Voluntary Cleanup Program" February 13,1997 (62 FB 6775) A meeting was held on February 27, 1997, in Washington, DC, to solicit input on key principles for adequate state voluntary cleanup programs. These principles will be used in the development of a draft state voluntary cleanup program guidance which will be issued for public comment.
