1. Applicability of the Domestic
   Sewage Exclusion to FOTWs

  Under 40 CFR §261.4(a), certain materials
are excluded from the definition of solid
waste, and therefore exempt from RCRA
Subtitle C regulation. Section 261.4(a)(l)
excludes from the definition of solid waste
mixtures of domestic sewage and hazardous
waste that pass through a publicly-owned
treatment works (POTW). Can this exclusion
also, apply to waste mixtures that pass through
a federally-owned treatment works (FOTW)?

  Yes. The domestic sewage exclusion is
derived from the statutory definition of solid
waste, which states that solid waste "does not
include solid or dissolved materials in
domestic sewage" that pass through a publicly
owned sewer system (RCRA §1004(27)).
Unlike the regulatory domestic sewage
exclusion for POTWs, EPA has not yet
promulgated a regulation explaining
implementation of the domestic sewage
exclusion for FOTWs; thus the statute
controls. Because an FOTW is not a POTW,
the Federal Facility Compliance Act of 1992
(FFCA) amended this statutory exclusion to
apply to "any solid or dissolved material
introduced by a source into a federally owned
treatment works" (RCRA §3023(a)).

  Thus, solid or dissolved materials in
domestic sewage that pass through an FOTW
are excluded from the definition of solid
waste, provided the FOTW meets  the criteria
outlined in §106 of FFCA (RCRA §3023).
First, the FOTW must be a wastewater
treatment facility owned and operated by the
federal government in accordance with a
discharge permit under §402 of the Clean
Water Act (CWA) (RCRA.§3023(d)).
Second, the solid or dissolved materials must
be generated by a household or person that
generates less than 100 kg of hazardous waste
per month (RCRA §3023(a)(4)).  Third, the
material mixed with the domestic sewage
must be one of the following:

    1.  Subject to pretreatment standards
       under §307 of the CWA
    2.  Not subject to a pretreatment standard,
       but having a scheduled pretreatment
       standard applicable no later than seven
       years after the date of enactment of the
       FFCA
    3.  Not prohibited from land  disposal.

2. Shipments of Hazardous  Waste
   from the Island of Midway

  The regulations governing imports of
hazardous waste into  the United States from
non-OECD countries are found at 40 CFR
Part 262, Subpart F (40 CFR Part 262,
Subpart H, for OECD countries).  Would
shipments of hazardous waste from the island
of Midway to the contiguous United States
require compliance with the import
requirements?

  Petroleum-contaminated media and debris
that exhibit the toxicity characteristic for
hazardous waste codes D018 through D043
only, and that are subject to underground
storage tank (UST) corrective action, are
excluded from the definition of hazardous
waste (40 CFR §261.4(b)(10)). If sand is
removed from the inside of a closed UST
during corrective action, and the sand exhibits
the toxicity characteristic for benzene (D018),
is the sand excluded from RCRA Subtitle C
regulation under §26L4(b)(10)? '

  No, the sand removed from the UST does not
meet the §261.4(b)(10) exclusion. This
exclusion was intended to cover contaminated
debris and media such as soil, groundwater,
surface water, and air that have become
contaminated with petroleum substances as a
result of a release from an UST (58 F_R 8505;
February 12, 1993). The exclusion is not
intended to cover inert materials, such as sand,
that have been introduced into an UST for the
purposes of closure. Sand removed from an
UST would have to be evaluated upon
generation to determine if it is a hazardous
waste; if so, it must be managed under
applicable hazardous waste requirements.
  Under EPCRA, §3.1
facility must. make its. threshold determinations
as a single, unit based, on aJi^Q^^ed activities
at the facility^ A fqcjfefy that, n\ee.^-or, exceeds
                                            an
                                         chemical, aggregating any releases and other
                                         waste management of that chemical from each
                                         establishment. Alternatively, establishments
                                         within a multi-establishment facility may make
                                         submissions individually, provided that the
                                         separate submissions collectively account for
                                         all reportable activities occurring at the
                                         facility (40 CFR §372.30(c)). A facility subject
                                         to EPCRA §313 contains two establishments
                                         thai make individual submissions equaling the
                                         releases of the entire facility. Both.
                                         establishments process the same toxic, ,
                                         chemical, but one does not release, transfer,
                                         treat, recycle, or bunt the toxic chemical for
                                         energy recovery. Must this establishment
                                         report under EPCRA §313, even if the other
                                         establishment's submission effectively
                                         accounts for all reportable activities involving
                                         the toxic chemical from the entire facility?

                                          Yes. If an activity threshold is exceeded for
                                         the entire facility, and the establishments
                                         choose to report separately, then each
                                         establishment that manufactures, processes,
                                         otherwise uses, releases, or otherwise manages
                                         the toxic chemical as a waste must file a report.
                                         This is true even if the establishment does not
                                         release, treat, recycle, or burn the toxic
                                        " chemical for energy recovery on-site or off-
                                         site; they would merely report zero releases.
                                         However, an establishment does not have to
                                         submit a report for a toxic chemical which is
                                         not manufactured, processed, otherwise used,

5. EPCRA §313 and Toluene
   Diisocyanate (TDI)

  According to the Chemical Abstract Service
(CAS), the correct name for CAS number
26471-62-5 is "benzene, 1,3-diisocyan-
atomethyl-." The structural formula that  '''
describes this CAS number is as follows:

               bfueli diisocyanate (TDI) is
commonly manufactured as a mixture of
isomers (e.g., an 80:20 mixture of 2,4- and 2,6-
TDI). Even if the mixture is made up of the
specifically listed isomers (i.e., 2,4- and 2,6-
TDI), the listing "toluene diisocyanate (mixed
isomers)" still applies. The "mixed isomer"
listing is meant to include such mixtures. The
specifically listed 2,4- and 2,6- TDI isomers
should be reported individually if not present
as a mixture of TDI isomers.

  The "mixed isomers" listing covers not only
mixtures of 2,4- and 2,6-TDI; it covers the 3,5-
TDI isomer as well. If only the 3,5-TDI
isomer is present (either pure or mixed with
other non-TDI chemicals), that TDI isomer is
reportable under EPCRA §313 as "toluene
diisocyanate (mixed isomers)."
  This name and structure imply only that the
isocyanate groups must be one/three with
respect to one another and that the position of
the methyl group is not known. It should be
noted that neither the name nor the structure
imply that there is necessarily a mixture of
chemicals.  The EPCRA §313 list of toxic
chemicals (40 CFR §372.65) includes CAS
number 26471-62-5 with the name "toluene
diisocyanate (mixed isomers)." This name
implies no positional relationship of the
isocyanate groups with respect to  each other
or to the methyl group. In addition, the name
seems to imply that there must necessarily be a
mixture of compounds for this listing to apply.
For the purposes of EPCRA §313 reporting,
what compounds are reportable under the CAS
number 26471-62-5?

  For purposes of reporting under EPCRA
§313, "toluene diisocyanate (mixed isomers)"
includes any possible mixture of any toluene
diisocyanates in which the isocyanate groups

refining reforms; communicating more

 EPA corrected the effective date of a final
rule concerning the removal of obsolete solid
waste management guidelines, originally
effective March 3, 1997 (61 ES 69032;
December 31, 1996).  EPA inadvertently
failed to deliver a copy of the rule to each
House of Congress and to the Comptroller
General of the General Accounting Office
(GAO); Section 801 of CRA precludes a rule
from taking effect until such action is taken.
The revised effective date of the rule is
December 30,1997.

 EPA corrected the effective date of a final
rule approving revisions to Missouri's
hazardous waste program, originally effective
July 29, 1997 (62 FR 29301; May 30, 1997).
EPA inadvertently failed to deliver a copy of
the rule to each House of Congress and the
Comptroller General of the GAO; Section 801
of CRA precludes a rule from taking effect
until such action is taken. The revised

 EPA announced the deletion from the
National Priorities List of the surface portion
of the Prewitt Abandoned Refinery Superfund
Site in New Mexico. EPA published its intent
to delete the portion of the site on October 9,
1997 (62 £R 52674). EPA and the State of
New Mexico have determined that no further
response action by responsible parties is
appropriate for the surface portion of the site.

 Prevention; Final Rule"

 EPA has modified the rule listing regulated
substances and threshold quantities under
§ 112(r) of the Clean Air Act (CAA). EPA has
deleted the category of explosives from the list
of regulated substances, and has exempted
regulated flammable substances in gasoline
used as fuel and naturally occurring
hydrocarbon mixtures prior to initial
processing from threshold determinations.
The definition of stationary source was
modified to clarify the transportation
exemption, and the provision for threshold
determination for flammable substances in
mixtures was clarified. EPA believes these
changes will reduce duplication between other
similar requirements and focus accident
prevention efforts as required by §112(r) of
CAA.

Action" alternative identified in the final
environmental impact statement for the river
water system at the Savannah River site. DOE
will assess the need for future remediation

EPCRA

"Phosphoric Acid; Toxic Chemical
  Release Reporting; Community Right-
  to-Know"

  EPA is denying a petition to delete
phosphoric acid from the EPCRA §313 toxic
chemical list. EPA based this action on its
review of the petition and a determination that
phosphoric acid meets the listing criteria in
§313(d)(2)(C). The notice also discusses the
potential creation and addition of a phosphates
category to the §313  toxic chemical list.
Although EPA is not proposing to add a
phosphates category  at this time, it intends to
propose such a category in a separate
rulemaking at a later date.
