1. Universal Waste Storage Time
Limits & Multiple Handlers
The universal waste management
standards of 40 CFR Part 273 outline
streamlined provisions for managing
universal wastes. Section 273.6 defines a
universal waste as hazardous waste batteries,
canceled pesticides, and mercury thermostats.
A generator of universal waste, or a facility
that receives universal waste from off site and
sends the waste to another universal waste
participant, may meet the definition of a
universal waste handler. Facilities which
meet the definition of a universal waste
handler may accumulate universal waste for
up to one year from the date the waste is
generated or received from another handler.
Since handlers may then transport the
universal waste to other off-site handlers, can
each individual handler take advantage of the
one-year accumulation provision?
When universal waste is transferred and
accumulated by multiple handlers, each
individual handler may utilize the one-year
accumulation provisions of §§273.15 and
273.35, since each location at which universal
wastes are consolidated and/or collected is
regulated as a separate handler. Accumulation
of universal waste by a handler for a period
over one year may be allowed if the handler
can prove such activity is solely for the
purpose of accumulating quantities necessary
to facilitate proper recovery, treatment, or
disposal (§§273.15(b) and 273.35(b)).
2. Contractors and Hazardous Waste
Training Requirements
Pursuant to 40 CFR §§264/265.16, owners
and operators of hazardous waste treatment,
storage, and disposal facilities (TSDFs) must
ensure that facility employees complete a
training program that teaches them to perform
their duties in a way that ensures the facility's
compliance with the Part 264/265
requirements. Are contractors working at
TSDFs required to comply with the training
program requirement?
Section 260.10 defines facility personnel
as "all persons who work at, or oversee the
operations of, a hazardous waste facility, and
whose actions or failure to act may result in
noncompliance with the requirements of Part
264 or 265 of this chapter." Contractors
working at a TSDF are held to the same
standards as non-contract facility personnel
and therefore must complete the appropriate
training program.
In addition, because large quantity
generators (LQGs) of hazardous waste are
required to comply with the interim status
training requirements at §265.16
(§262.34(a)(4)), contractors at LQG facilities

that meet the definition of facility personnel
under §260.10 are also required jo_meet the
personnel training provisions. v
3. De Minimis Wastewater Mixtures
Sent Off Site
Section 261.3(a)(2)(iv)(D) of the hazardous
waste mixture rule stipulates that wastewater
(CCPs) or chemical intermediates listed in
§261.33, the discharge of which is subject to
§§307(b) or 402 of the Clean Water Act
(CWA), are not hazardous waste. If a
generator hardpipes a wastewater containing
de minimis losses of CCPs to an off-site
privately owned wastewater treatment facility
subject to the CWA, must the generator handle
the mixture as a hazardous waste?

Yes, the generator must handle the mixture
as a hazardous waste. The de minimis
exclusion for wastewater applies only to
mixtures of wastewaters and de minimis
amounts of CCPs that are sent to a facility's
on-site wastewater treatment system
discharging under §§307(b) or 402 of the
CWA (46 FR 56582; November 17, 1981).
Thus, if the generator decides to truck the
hazardous wastewater mixture off site instead
of using a pipeline, the shipment must be
delivered by a hazardous waste transporter and
be accompanied by a manifest (§262.20).
However, the manner in which the
wastewater is transported to the on-site
wastewater treatment unit does not affect the
exemption. For example, on-site trucking of
wastewater to an on-site privately owned
wastewater treatment system does not prevent
a de minimis CCP-wastewater mixture from
being exempt (PPC 9441.1991(13)).
4. Frequently Asked Questions on the
40 CFR Parts 264/265, Subpart CC,
Air Emission Standards
Are recycling units subject to the RCRA air
emissions regulations?
Subpart CC does not apply to recycling
units (i.e., units doing the actual recycling;
storage units preceding recycling can be.-
subject to Subpart CC) (61 FR 59931, 59935;
November 25, 1996). However, recycling
units at permitted and interim status treatment,
storage, and disposal facilities (TSDF) are
subject to Parts 264/265, Subparts A A and BB
(62 FR 64635, 64638; December 8, 1997).
Are listed hazardous wastes that meet
applicable LDR treatment standards
subject to Subpart CC regulations?
Listed hazardous wastes that meet LDR
treatment standards for the organics in the
waste are not subject to Subpart CC
regulations. Listed hazardous wastes with
treatment standards that address only inorganic
constituents may not benefit from this
exclusion. However, listed hazardous waste
containing both organic and inorganic
constituents may be exempt from Subpart CC
if it meets the LDR treatment standards for the
organic constituents in that waste (62 FR
64635, 64643-4; December 8, 1997).
Can hazardous waste be managed in units
when the control device is not operating?
The Subpart CC standards allow up to 240
hours per year for periods of planned routine
maintenance of a control device. During this
time, the hazardous waste may still be
managed in the unit, even though the control
device is not required to meet the performance
requirements for emission reduction (61 FR
59931, 59948; November 25, 1996).

What regulations apply to control devices
on Level 1 tanks? ____
\
The control device on a Level 1 tank must
remove or destroy organics in the vent stream
and operate whenever hazardous waste is
managed in the tank (§§264/
265.1085(c)(2)(iii)(B)). The closed-vent
system and control device need not be
designed and operated in accordance with the
requirements of §§264/265.1088.
Would a Level 2 tank which routinely vents
to an incinerator meet the definition of
pressure tank?
No, a tank which routinely vents to any
device or unit (other than to an emergency or
safety device) would not meet the definition of
a pressure tank. In order to meet the definition
of a pressure tank, all openings of the tank
must be equipped with closure devices that
function with no detectable emissions, and the
pressure tank must operate as a closed system
with, no venting, except to an emergency
device or safety device (§§264/265.1085(h)).

5. Suitable Dielectric Material for
Cathodic Protection
The underground storage tank (UST)
regulations of 40 CFR Part 280 require steel
tanks to be installed with cathodic protection.
As pan of the design requirements for cathodic
protection systems, owners and operators of
new steel tanks must coat the tank with a
"suitable dielectric material"
(§280.20(a)(2)(i)). Existing tanks that are
upgraded are not required to have a dielectric
coating. What is considered suitable dielectric
material for the purposes of the cathodic
protection standards? Is an asphaltic coating
considered a suitable dielectric material?
Section 280. 12 defines a dielectric coating
as a non-conductive material which is used to
electrically isolate UST systems from the
surrounding soils. A dielectric coating is
considered to be suitable if it is shown to
conform to an industry code or standard
established by a recognized industry group or
testing laboratory. To determine whether a
specific coating (e.g., asphaltic coating) meets
industry standards or codes (e.g., National
Association of Corrosion Engineers (NACE)
International Standard RP-0285). See note at
§280.20(a)(2).
CERCLA
6. Updated Interest Rates on
Superfund Cost Recovery Actions
EPA is authorized by CERCLA §111 to
expend Superfund monies to finance response
actions in order to facilitate cleanup of
Superfund sites. Tfie Agency can then take
enforcement action to recover costs from
potentially responsible parties (PRPs) at the
site pursuant to §107. When calculating
recoverable costs, may EPA charge interest on
the amount expended? If so, how is the
applicable interest rate calculated?
EPA is authorized to seek interest charges
on all amounts recoverable under CERCLA
§107(a)(4). Amounts recoverable under
§107(a)(4) include response costs not
inconsistent with the National Contingency
Plan. These include expenses incurred during
the process of conducting a removal action, the
remedial investigation/feasibility study, the
remedial design, and the remedial action. In

' addition, § 107(a)(4) authorizes Federal 1982 17.26%
agencies to recover damages for injury to, or 1983 11.32%

The interest rate used by EPA to assess 1990 8.47%
interest on outstanding PRP debts (costs 1991 7.99%
incurred by EPA while cleaning up Superfund 1992 5.70%
sites) is calculated by the Bureau of Public 1993 3.49%
Debt, Department of the Treasury (Treasury), 1994 3.36%
during August of each year. The interest rate 1995 5.63%
is based on the annual "yield" rate for the 1996 5.86%
Hazardous Substance Superfund (or Trust 1997 5.69%
Fund) when it is invested by Treasury in one- 1998 5.61%.
year U.S. Treasury MK (i.e., market based)
Bills. The MK Bills generally mature at the,
end of August and are subsequently reinvested
at this time for the following fiscal year. When
the Trust Fund! is reinvested, the yield rate
established for this investment becomes the
new interest rate for the new fiscal year (i.e.,
October 1 through September 30).
Accordingly, interest rates will change each
fiscal year.
When calculating cost recovery amounts,
EPA applies the interest rate from the date
EPA issues a demand letter or the date of any
fund expenditure. Interest is recoverable from
the date EPA incurred the costs (see U.S. v.
Bell Petroleum Services, Inc., 734 F. Supp.
771, 784). If a cost recovery action takes place
over a number of years, interest on the
outstanding balance is recalculated using the
new fiscal year's interest rate until EPA
receives full payment.

through 1998 are as follows:

deferral from RCRA organic air emission
standards, commonly known as RCRA

is limited to two existing hazardous waste
surface impoundments, and is conditioned on
the plant's compliance with air emission and

been developed under Project XL. The final
rule is effective on April 1, 1998, unless
relevant adverse comments are received on or
before March 27, 1998.

reporting burdens. The final rule expands the

§304 to include releases that result from land

types of mines not within the scope of the
reporting exemption are uranium, phosphate,
tin, zircon, hafnium, vanadium, monazite, and
rare-earth mines.
