                      HOTLINE QUESTIONS AND ANSWERS
                  RCRA
 1. Subpart CC and Miscellaneous Unit
    Permitting

The regulations in 40 CFR Part 264,
 Subpart X, require that a miscellaneous unit's
 permit include the appropriate requirements
of Part 264, Subparts I through O, Subparts
AA, BB, and CC, if they apply to the unit
(§264.601). For example, a permitting agency
would incorporate the Part 264, Subpart CC
air emission standards applicable to tanks
into the permit of a tank-like miscellaneous
unit. If a state in which a miscellaneous unit
is located is authorized to implement Subpart
X miscellaneous unit requirements, but not
authorized to implement the Subpart CC air
emission requirements, who is responsible for
 implementing the air emission requirements
 segment of this unit's permit?

In this situation, the EPA Region is
responsible for writing the Subpart CC
 requirements into the miscellaneous unit's
 permit and implementing those requirements.
If a permit applicant's unit is subject to the
requirements of Part 264, Subpart CC, the
permitting agency will need to include those
provisions in the permit. This is because the
applicability of Subpart CC to miscellaneous
units is a requirement promulgated pursuant to
the Hazardous and Solid Waste Amendments
(HSWA) of 1984. However, if the state is not
authorized for the Subpart CC requirements, it
cannot write or implement that portion of the
permit. Therefore, under HSWA, the EPA
Region would write the Subpart CC provisions
into the unit's permit and would be responsible
for the implementation of the air emission
requirements. In this situation, the state would
only have the authority to regulate the
miscellaneous unit itself, and would not have
authority to implement and enforce the Subpart
CC provisions until the state receives
authorization for such provisions.
                 EPCRA
2. Reporting Toxic Chemicals Used as
    Treators on the Form R

Facilities subject to EPCRA §313 (40 CFR
Part 372) must report releases and other waste
management activities of toxic chemicals that
they manufacture, process, or otherwise use.
These facilities must report on-site waste
treatment methods and efficiencies for toxic
chemicals in waste streams in Part II, Section
7A, and the quantities of toxic chemicals in
wastes treated on site when the toxic chemicals
become chemically converted or destroyed in
Part II, Section 8.6. A facility purchases an
EPCRA §313 toxic chemical and uses it to
treat a wastestream on site. The toxic
chemical (the "treator") chemically converts
during the process of treating the on-site
wastestream. Is the facility required to report
the Section 313 treator toxic chemical as
"treated on site " in Part II, Sections 7A and
8.6 of the Form R?

When a facility treats a wastestream with a
toxic chemical that is not a waste or part of a

-------
 Hotline Questions & Answers
                                    May 1999
wastestream prior to its use as a treator, the
facility should not report the toxic chemical
(the treator) as "treated on site" in Sections 7A
or 8.6 of the Form R, even if it becomes
chemically converted or destroyed during the
treatment process; the facility should include
the amount of the* treator chemical used in this
process toward the facility's otherwise use
threshold. If, however, a facility treats a
wastestream with a toxic chemical that is,
itself, a waste or part of a waste stream prior to
the treatment process, the facility must report
the toxic chemical as "treated on site" in
Sections 7A and 8.6 of the Form R if it
 becomes chemically converted or destroyed
 during the treatment process.

 3. Processing vs. Otherwise Use
    Threshold for EPCRA §313

A facility subject to the reporting
 requirements of EPCRA §313 manufactures
shoes that contain two toxic chemicals when
they are distributed in commerce. Toxic
chemical A exists as an impurity in a raw
material that becomes part of the shoes. The
toxic chemical remains in the product, but
serves no specific function within it. Toxic
chemical B is a solvent in the adhesive that is
used to attach the soles of the shoes. Most of
 chemical B evaporates during the
manufacturing process, but small amounts of
this chemical remain in the shoes when they
are distributed in commerce. How can a
facility determine whether to apply the
processing or otherwise use threshold in these
 situations?

If a toxic chemical component of a raw
material is incorporated into a product for
distribution in commerce, regardless of whether
it serves a function within that product, the
facility should apply the processing threshold.
However, if a toxic chemical is otherwise used
on site and some portion of the chemical is
incorporated into the final product, the entire
amount is considered toward the facility's
otherwise use threshold. None of this amount
is considered towards the processing threshold.

In this particular scenario, because toxic
chemical A is an impurity that is present in a
raw material and that is incorporated into a
product for distribution in commerce, the
facility has processed that toxic chemical. The
facility did not specifically add the toxic
chemical to the product, but the toxic chemical
was not removed from the raw material either.
Therefore, unless toxic chemical A is present
below its de minimis concentration, the entire
quantity of the chemical would be subject to
the 25,000 pound processing threshold.

Toxic chemical B, however, is involved in
a specific non-incorporative activity (as a
volatile component of the adhesive). The
entire quantity of toxic chemical B used in the
adhesive would therefore be subject to the
10,000 pound otherwise use threshold, even if
a portion of that chemical remains in the shoes
that are distributed in commerce.

federal agencies, and is intended to
complement the draft OECA policy "Federal
Facility Enforcement Policy in Response to
DOD Funding Shortages." This document has
three main parts: 1) promote an understandable
and consistent approach to setting priorities for
cleanup activities for federal facilities where
EPA is the lead regulator; 2) implement the
consensus recommendations reached by the
Federal Facility Environmental Restoration
Dialogue Committee (FFERDC) concerning
the role of risk and other factors in priority
setting; and 3) provide direction for the use of
tools developed by or that may be developed
by other agencies in sequencing work and
setting priorities for cleanup actions at federal
facilities.

 Program Revision for Corrective
 Action"
 May 4, 1999 (64 FR 23780)

 EPA authorized Missouri's hazardous waste

for corrective action. EPA published the rule
without prior proposal because the Agency
believes it is a noncontroversial amendment.
The final authorization will become effective
on July 6, 1999.
"Land Disposal Restrictions Phase IV:

 May 11,1999 (64 FR 25408)

EPA published a correction to five recent
land disposal restrictions. The rule corrected
and clarified five related rules EPA published
on May 12, 1997, May 26, 1998, August 31,
1998, September 4, 1998, and September 24,
1998. This rule makes technical corrections
and clarifications to these final regulations.

the Clean Water Act and Resource
    Conservation and Recovery Act; Final
    Rule"
    May 14,1999 (64 FR 26315)

EPA approved use of Method 1664,
  Revision A: n-Hexane Extractable Material
(HEM; Oil and Grease) and Silica Gel Treated
  n-Hexane Extractable Material (SGT-HEM;
  Non-polar Material) by Extraction and
Gravimetry (Method 1664) for use in EPA's
Clean Water Act (CWA) programs. EPA
deleted Method 9070, added revised Method
907IB, and incorporated Method 1664 by
reference for use in EPA's RCRA programs.
Method 1664 is approved for determination of
non-polar material (NPM) as silica gel treated
  n-hexane extractable material (SGT-HEM) to
support phaseout of use of CFC-113 for
determination of NPM in EPA's CWA and
RCRA programs. These actions are being
taken as a part of EPA's effort to reduce
  dependency on use of chlorofluorocarbons
(CFCs). This rule is effective June 14, 1999.

    May 26,1999 (64 FR 28387)

    EPA granted a site-specific treatment
variance from the land disposal restrictions
(LDR) treatment standards for two selenium-
bearing hazardous wastes to Chemical Waste
Management (CWM), Inc. EPA granted this
variance because the chemical properties of
these two wastes differ significantly from the
waste used to establish the current LDR
standard for selenium (5.7 mg/L TCLP) and
the CWM, Inc. has adequately demonstrated
that the two wastes cannot be treated to meet
this treatment standard.
