Subpart CC and Miscellaneous Unit Permitting The regulations in 40 CFR Part 264, Subpart X, require that a miscellaneous unit's permit include the appropriate requirements of Part 264, Subparts I through O, Subparts AA, BB, and CC, if they apply to the unit (§264.601). For example, a permitting agency would incorporate the Part 264, Subpart CC air emission standards applicable to tanks into the permit of a tank-like miscellaneous unit. If a state in which a miscellaneous unit is located is authorized to implement Subpart X miscellaneous unit requirements, but not authorized to implement the Subpart CC air emission requirements, who is responsible for implementing the air emission requirements segment of this unit's permit? In this situation, the EPA Region is responsible for writing the Subpart CC requirements into the miscellaneous unit's permit and implementing those requirements. If a permit applicant's unit is subject to the requirements of Part 264, Subpart CC, the permitting agency will need to include those provisions in the permit. This is because the applicability of Subpart CC to miscellaneous units is a requirement promulgated pursuant to the Hazardous and Solid Waste Amendments (HSWA) of 1984. However, if the state is not authorized for the Subpart CC requirements, it cannot write or implement that portion of the permit. Therefore, under HSWA, the EPA Region would write the Subpart CC provisions into the unit's permit and would be responsible for the implementation of the air emission requirements. In this situation, the state would only have the authority to regulate the miscellaneous unit itself, and would not have authority to implement and enforce the Subpart CC provisions until the state receives authorization for such provisions. EPCRA 2. Reporting Toxic Chemicals Used as Treators on the Form R Facilities subject to EPCRA §313 (40 CFR Part 372) must report releases and other waste management activities of toxic chemicals that they manufacture, process, or otherwise use. These facilities must report on-site waste treatment methods and efficiencies for toxic chemicals in waste streams in Part II, Section 7A, and the quantities of toxic chemicals in wastes treated on site when the toxic chemicals become chemically converted or destroyed in Part II, Section 8.6. A facility purchases an EPCRA §313 toxic chemical and uses it to treat a wastestream on site. The toxic chemical (the "treator") chemically converts during the process of treating the on-site wastestream. Is the facility required to report the Section 313 treator toxic chemical as "treated on site " in Part II, Sections 7A and 8.6 of the Form R? When a facility treats a wastestream with a toxic chemical that is not a waste or part of a ------- Hotline Questions & Answers May 1999 wastestream prior to its use as a treator, the facility should not report the toxic chemical (the treator) as "treated on site" in Sections 7A or 8.6 of the Form R, even if it becomes chemically converted or destroyed during the treatment process; the facility should include the amount of the* treator chemical used in this process toward the facility's otherwise use threshold. If, however, a facility treats a wastestream with a toxic chemical that is, itself, a waste or part of a waste stream prior to the treatment process, the facility must report the toxic chemical as "treated on site" in Sections 7A and 8.6 of the Form R if it becomes chemically converted or destroyed during the treatment process. 3. Processing vs. Otherwise Use Threshold for EPCRA §313 A facility subject to the reporting requirements of EPCRA §313 manufactures shoes that contain two toxic chemicals when they are distributed in commerce. Toxic chemical A exists as an impurity in a raw material that becomes part of the shoes. The toxic chemical remains in the product, but serves no specific function within it. Toxic chemical B is a solvent in the adhesive that is used to attach the soles of the shoes. Most of chemical B evaporates during the manufacturing process, but small amounts of this chemical remain in the shoes when they are distributed in commerce. How can a facility determine whether to apply the processing or otherwise use threshold in these situations? If a toxic chemical component of a raw material is incorporated into a product for distribution in commerce, regardless of whether it serves a function within that product, the facility should apply the processing threshold. However, if a toxic chemical is otherwise used on site and some portion of the chemical is incorporated into the final product, the entire amount is considered toward the facility's otherwise use threshold. None of this amount is considered towards the processing threshold. In this particular scenario, because toxic chemical A is an impurity that is present in a raw material and that is incorporated into a product for distribution in commerce, the facility has processed that toxic chemical. The facility did not specifically add the toxic chemical to the product, but the toxic chemical was not removed from the raw material either. Therefore, unless toxic chemical A is present below its de minimis concentration, the entire quantity of the chemical would be subject to the 25,000 pound processing threshold. Toxic chemical B, however, is involved in a specific non-incorporative activity (as a volatile component of the adhesive). CAA "Accidental Release Prevention Requirements: Risk Management Programs under Clean Air Act Section 112(r)(7); Amendments to the Worst- Case Release Scenario Analysis for Flammable Substances" May 26,1999 (64 F_R 28696) EPA amended the regulations regarding the worst-case scenario analysis for flammable substances in 40 CFR §68.25. Stationary source owners or operators are now be able to consider regulated flammable substances in the same manner as regulated toxic substances when determining the quantity released in a worst-case scenario. EPA also clarified its interpretation of CAA §§112(r)(l) and 112(r)(l 1) as they relate to DOT requirements. "List of Regulated Substances and Thresholds for Accidental Release Prevention; Stay of Effectiveness for Flammable Hydrocarbon Fuels" May 28,1999 (64 FR 29168) EPA announced a six-month stay of effectiveness of the Risk Management Plan (RMP) regulations under CAA §112(r) as they apply to flammable hydrocarbon fuels held in amount no greater than 67,000 pounds. The stay effects any processes that would qualify for the Agency's proposed an exemption from the RMP rule for such fuels. The stay is in addition to, and does not affect, the judicial stay of the rule for propane processes enacted on April 27, 1999. "New Jersey: Authorization of State Hazardous Waste Program" May 11,1999 (64 FR 25258) EPA determined the State of New Jersey's application for final authorization of its hazardous waste program satisfies all of the requirements necessary to qualify for final authorization. EPA and consolidated cases. Under this settlement, the Agency will be required to amend the regulations regarding the determination of the quantity of a flammable substance released in a worst-case scenario. EPA will accept comments for thirty days following the publication of this notice. "List of Regulated Substances and Thresholds for Accidental Release Prevention; Flammable Hydrocarbon Fuel Exemption" May 28,1999 (64 FR 29171) EPA proposed to exempt those processes containing less than 67,000 pounds of a flammable hydrocarbon fuel, and no other listed substance above its threshold quantity, from threshold determination. The exemption will not apply to processes that manufacture the fuel, contain more that a threshold quantity of another regulated substance, or processes connected to, or collocated with another covered process. Comments must be submitted on or before June 28, 1999, unless a hearing is requested by June 2, 1999. If a hearing is requested, it will take place on June 14, 1999, in Washington, D.C.
