2.  Generator Satellite Accumulation/Counting Requirements

A  generator accumulates hazardous waste in a satellite  accumulation area
pursuant to 40 CFR Section 262.34(c) standards. The generator also generates
other RCRA  hazardous waste elsewhere on-site.   When determining
generator status, must a generator count the waste collecting in the satellite
accumulation area or count it once it enters the generator storage area?

   To determine their generator status, generators must count all  hazardous
   waste generated at their facility in a calendar month. Wastes not included
   in the monthly determination are identified in Section 261.5(c).  These are
   wastes either not subject to regulation or subject to only the notification
   and reporting requirements in Sections 262.11, 262.12, 262.40(c) and 262.41.
   Wastes stored in  the satellite accumulation area are subject  to certain
   container standards (e.g., Sections 265.171, 265.172, and 265.173(a)).  These
   regulations are not among those listed in 261.5(c). Therefore, wastes in the
   satellite accumulation must be included in the generator's monthly waste
   quantity determination.

3.  Clarification of Electroplating Listings

The  background document which supported the listing of F006 initially
included  electroless  plating  within  the scope of  the  definition  of
electroplating. However, the December 2,1986 Federal Register (54 FR 43351)
clarified EPA's interpretation of the definition of electroplating as it  pertained
to the F006 listing. The clarification stated that electroless plating was not
considered an electroplating process.  Would electroless plating baths which
contain small concentrations of cyanide meet the F007 listing when disposed?

   3.  Clarification of Electroplating Listings (cont'd)

      No.  Although the December 2, 1986, clarification was written specifically
      for  the  F006 listing,  the  definition  of electroplating may be  applied
      analogously to the F007, F008 and F009 listings. Therefore, plating bath
      solutions from electroless plating operations will not meet the F007 listing
      when disposed. The bath would be regulated, however, if it exhibited one
      or more of the characteristics of hazardous waste.

4. Reinstallation of Previously Used Underground Storage Tanks

   A manufacturer removes one of his underground storage tanks (USTs) which
   stored diesel fuel in January of 1989. He subsequently uses this removed tank
   to replace an existing tank which stores petroleum for trucks. Since both of
   these tanks are located on the same facility and both were in existence on the
   effective date of the UST technical regulations (December 22,1988), would the
   replacement tank be required to  meet all the new tank requirements (i.e.
   notification, new tank performance standards, etc.)?

      The EPA promulgated  technical regulations for underground storage
      tanks  in the September  23, 1988 Federal Register.  (53 FR 37082) These
      regulations define a new tank system as "a tank system that will be used to
      contain an  accumulation  of  regulated substances and  for  which
      installation has commenced after December 22, 1988".  (53 FR  37196)
      Although the initial installation of the diesel  fuel tank in its first location
      was completed prior to December 22, 1988,  it was not the Agency's
      intention to exempt this tank from meeting new tank requirements when
      removed and subsequently reinstalled. Furthermore, in the June 4, 1986
      Federal Register (51 FR 20418) which promulgated interim prohibition
      regulations for USTs, the Agency explained,  "EPA also interprets Section
      9003(a)  as applying to  all new installations, including installation  of
      previously used tanks".  (51 FR 20420)  Therefore, the reinstalled UST
      would be required to meet the new  tank performance standards found
      under 40 CFR Section 280.20.

B. SARA Title III

  5. Section 313:  Notice of Noncompliance

  The ownership of a manufacturing facility changed hands during the course
  of the calendar year 1988.  The new owner (who is also the new operator)
  received a Notice of Noncompliance (NON) for a Form R that was submitted
  by the previous owner/operator for the calendar year 1987.  Since the current
  owner/operator was not the last owner/operator in calendar year 1987, does
  s/he have any responsibility for responding to the NON or retain any liability
  if no response is made?

    Both  the current and  previous owner/operator are responsible for
    responding to the NON and both retain liability if no response is made.  If
    the current owner/operator has in  their  possession  past  records that
    would allow them to respond to the NON, they should do so and address
    the ownership  change in an accompanying cover letter. This response
    must be sent to the EPA Reporting Center.

    If  the current owner/operator does not possess past records,  a response  to
    the NON must still be made by the  current owner/operator  and  in the
    following manner. The response must include a copy of the  NON and an
    accompanying cover letter explaining the ownership change, the lack  of
    past records, and an account of any attempts made to contact the previous
    owner.  The response to the NON must  be sent not only to  the EPA
    Reporting Center but also to the EPA enforcement official that signed the
    NON. Once this response and explanation is received by the EPA, it would
    be unlikely that  any further action would be taken against the current
    owner/operator.

  6. Section 313: Threshold Determinations/Processing

  A facility owner/operator begins a process in December 1988 by mixing a batch
  of toxic chemicals into their product formulation. The mixture remains in
  the vat until January 1989.  At that time, the mixture is packaged into quart
  containers and sent to their customers. For Section 313 threshold purposes,
  are the toxic chemicals in the mixture considered processed in 1988 or 1989?

    "Process"  is defined as "the preparation of toxic  chemical, after its
    manufacture, for distribution in commerce." (40 CFR Section 372.3)  The
    Agency interprets the activity of processing to be reportable when the toxic

   chemicals are initially prepared.  Therefore, the amount of toxic chemicals
   mixed in 1988 would be added to the processing threshold determination
   for 1988 and any releases resulting from the mixing would need to be
   accounted for on the Form R for 1988.

7. Supplier Notification Requirements

The requirements  for supplier  notification  for  mixtures or  trade  name
products containing toxic chemicals is found  in 40 CFR Section 372.45. The
requirements specify in Section 372.45(a) that supplier notification is required
for persons who meet the following criteria:

1. Is in SIC codes 20-39;
2. Manufactures (including imports) or processes a toxic chemical; and
3. Sells or otherwise distributes a mixture or trade name product containing
  the toxic chemical.

When the second criteria says a "toxic chemical," does this refer to the toxic
chemical being distributed or to any toxic  chemical which is manufactured or
processed at  the facility?  For example, a person processes benzene at their
facility and also distributes a mixture containing xylene which they buy from
another facility.   The xylene is simply redistributed, not processed, by the
facility.  Is a supplier notification required for the mixture  which contains
xylene because the facility processed benzene?

   When the  second criteria says a "toxic chemical," it is referring to the toxic
   chemical in the  mixture which  is being  distributed from  the  facility.
   Therefore, a  facility owner/operator would not be responsible  for
   preparing a supplier notification for  a mixture which contains a toxic
   chemical which they did not manufacture or process. The requirement for
   developing a supplier notification  for  a  mixture is  ultimately  the
   responsibility  of the facility which processed or manufactured the toxic
   chemical in the mixture.

8.  Penalty Procedures

Under SARA  Title III are there any provisions for penalties levied against
violators of SARA Title in to be distributed to States and localities?

   SARA Title HI specifies that violators of the Act are liable to the United
   States, and therefore, fines levied under the Act are payable to the U. S.
   Treasury.  At present, EPA does not have any provisions for distributing
   these penalties to States and localities.

EPA proposes regulations to set standards
for the Disposal of Sewage Sludge. These
standards apply to publicly owned
treatment works (POTWs) and privately
owned treatment works that generate or
treat domestic sewage sludge.  Comments

This notice provides the Draft Guidance
to Hazardous Waste Generators on the
Elements of a Waste Minimization
Program. Comments on this draft will be

EPA is clarifying certain aspects of the pro-

EPA is granting a final exclusion from the
lists of hazardous wastes contained in 40
CFR Sections 261.31 and 261.32 for
specified waste generated by Clay
Equipment Corp., Cedar Falls, Iowa.

In accordance with Section 122(i) of
CERCLA, a proposed consent decree in
U.S. v. Printed Circuits. Inc., et al.. was
lodged with the U.S. District Court for the
Eastern District of Pennsylvania.

Under Section 122(g) of CERCLA, EPA has
agreed to settle claims for response costs at
the City Industries Site, Winter Park,
Florida, with the Agricultural Research
Service  of the U.S. Department of
Agriculture. Comments on the proposed
settlement will be considered until
September 1,1989.

EPA is proposing to modify the scope of
the F019 listing by excluding wastewater,
treatment sludges from the zirconium
phosphating step when this  phosphating
is an exclusive process in the aluminum
can washing process.  EPA is also
proposing to remove  these zirconium
phosphating wastewater treatment
sludges from Section 302.4.  Comments
on this proposal will be accepted until
September 5,1989.

EPA is amending portions of the closure
requirements under Subtitle C Parts 264,
265, and 270, applicable to owners and
operators of certain types of hazardous
waste facilities.  The rule allows, under
limited circumstances, a landfill, surface
impoundment, or land treatment unit to
remain open after the final receipt of
hazardous wastes in order to receive non-
hazardous wastes in that unit.  The final
rule  details the circumstances under
which this can occur.

EPA is promulgating the Reportable
 Quantities (RQ's) adjustment for six of
the 273 hazardous substances whose RQs
were proposed to be adjusted in a March
16,1987 NPRM. (52 FR 8140) These six
include: 1,4, dioxane, 2- ethoxyethanol,
ethylene oxide, 2-nitropropane,
perchloroethylene and saccharin.  The
rule  is effective immediately.

EPA is promulgating the RQ adjustments
for the 258 hazardous substances proposed
to be adjusted on March 16,1987 (52 FR
8140).  These adjustments were based on
evidence of a substance's carcinogenicity.
EPA is also delisting ammonium
thiosulfate from  the CERCLA list of
hazardous substances.

This notice announces a meeting of the
Science Advisory Board's Municipal
Waste Combustion Ash Subcommittee
