I. SIGNIFICANT QUESTIONS AND RESOLVED ISSUES—OCTOBER 1990
RCRA
1. Clarification of Section 262.34(a) Accumulation Time for Excess of
55-Galloa imit in Satellite Accumulation Areas
The owner/operator of a manufacturing company maintains a
generator satellite accumulation area pursuant to Section 262.34(c). The
operator has exceeded the 55-gallon accumulation limit and according
to Section 262.34(c)(2), has three days to remove this waste from the
satellite area and manage it either in a 90-day storage area as a large
quantity generator in compliance with Section 262.34(a), manage the
waste at an on-site permitted unit, or ship the waste off-site. Does the
90-day accumulation time for large quantity generators in Section
262.34(a) begin at the time the 55-gallon limit is exceeded or after the
three-day transition period in Section 262.34(c)?

The owner/operator has up to a 93-day accumulation time for the
excess waste generated at the satellite accumulation area (90-day
clock in Section 262.34(a), plus up to three days for waste transfer).
The March 24, 1986 Federal Register, which clarifies small quantity
generator provisions, states "...as soon as the 55-gallon limit has
been exceeded in any satellite area, any excess waste is subject to all
applicable RCRA requirements within three days. This means that
the 180/270 day on site accumulation provision for 100-1000 kg/mo.
generators applies to any excess waste three days after the 55-gallon
limit has been exceeded." (51 FR 10162). If the generator chose to
remove the waste from the satellite area before the three-day
transfer provision expired, he would subject the waste to the 90-day
clock provisions. For example, if the above operator chose to move
his excess waste from the satellite area after just one day, the 90-day
accumulation time in Section 262.34 would begin as the waste
entered the 90-day accumulation area, not after three days. The
generator has chosen not to utilize the other two days that were
available for transfer.

2. Regulatory Status of Petroleum Contaminated Media and Deb1"' Under
the Toxicity Characteristic UST Temporary Deferral
The owner/operator of a petroleum underground storage tank (UST) is
conducting a corrective action pursuant to Subpart F of 40 CFR Part 180.
During corrective action, sludges are removed from the inside of the
tank. These sludges exhibit the toxicity characteristic (TC) for benzene.
Pursuant to 40 CFR Section 261.4 (b) (10) "...(p)etroleum-contaminated
media and debris that fail the test for the toxicity characteristic of
Section 261.24 and are subject to the corrective action regulations under
Part 280 of this chapter..." are excluded from the definition of
hazardous waste. The preamble to the March 29,1990, Federal Register
does not explicitly define petroleum contaminated "media" and
"debris." (55 FR 11836). Would the deferral apply to those sludges that
are removed from the tank, or is the deferral intended only for
environmental media such as soil and ground water?

In the March 29 preamble, the Agency stated that "further
evaluation of the impacts of applying the TC to soils and ground
water contaminated by petroleum from UST's and subject to the
Subtitle I program is necessary in order to determine whether an
exemption for such materials is warranted...." (55 JFR 11836) The
deferral only applies to contaminated ground water, soil and debris,
but not to wastes such as sludges generated in a raw material storage
tank. Section 261.4(a) states "(a) hazardous waste which is generated
in a product or raw material storage tank,...is not subject to
regulation under Parts 262 through 265, 268, 270, 271 and 124 of this
chapter or to the notification requirements of Section 3010 of RCRA,
until it exits the unit in which it was generated,...." Therefore,
sludges removed from Underground Storage Tanks during
corrective actions pursuant to Part 280 Subpart F do not meet the
criteria of "media and debris" and, therefore, the deferral from TC
regulation does not apply.
NOTE: The June 29, 1990, Federal Register contains a clarification of
the deferral which states," (t)his exclusion applies only to
petroleum contaminated media and debris which exhibit the
TC for any one or more of the newly identified organic
constituents, and which are subject to corrective action under
Part 280." (55 FR 26986) Therefore, those constituents
previously regulated under the EP Toxicity rule (D004-D017)
and now regulated under the TC are not eligible for the TC
underground storage tank deferral even if they meet the
criteria of media and debris. A generator must still determine
if the media and debris is a characteristic hazardous waste for
the TC constituents D004-D017.

SARA Title III
3. SARA Sections 311/312 Medical Facility Exemption
Are chemicals used at nursing home facilities exempt from reporting
under SARA Sections 311/312 due to the medical facility exemption
under SARA Section 311(e)(4)?

While a nursing home is treated like any other medical facility for
SARA Section 311/312 purposes, Section 311(e)(4) does not exempt a
medical facility from all Section 311/312 reporting. SARA Section
311(e)(4) exempts from the definition of hazardous chemical "(a)ny
substance to the extent it is used in a research laboratory or a
hospital or other medical facility under the direct supervision of a
technically qualified individual." This exclusion applies to
substances being used in the medical field at a nursing home (which
has, as part of its normal operation, medical care responsibilities for
its clients) to the extent that the substances are being used under the
direct supervision of technically qualified individuals. The term
"technically qualified" is interpreted to refer to individuals who are
adequately trained in the research or medical fields, as appropriate
(for example, doctors, nurses, research professionals, etc.). Thus,
this provision exempts only those chemicals used medically by
technically qualified personnel, and not the entire facility. Nursing
homes may have other hazardous chemicals which are not used for
medical purposes and are subject to reporting. For example, certain
cleaning supplies may be reportable under SARA Sections 311/312 if
threshold levels are met.

EPA is proposing a corrective action rule for solid
waste management units at facilities seeking a permit
under Section 3005(c). Comments were to be
accepted until September 25,1990. An August 24,
1990, notice extended the comment period to
November 26,1990.
This notice announces the availability of the Agency's
"Report to Congress on Special Wastes from Mineral
Processing," which is required by Section 8002(p) of
RCRA. EPA was to accept public comments on the
Report until September 28,1990. The Agency also
was to hold a public hearing on the Report on
September 25,1990. The comment period was
extended to October 19,1990, and the public hearing
was moved to October 17,1990, in a September 12,
1990 Federal Register notice. (55 FR 37540)
EPA is extending the comment period for the
Proposed Rule published in the Federal Register at 55
FR 30798-30884 (July 27,1990) which established
requirements for corrective action for solid waste
management units. The comment period will be
extended until November 26,1990.
Under Section 122(g)(4) of CERCLA, the EPA has
agreed to settle claims for past and further response
costs at the Powerville Landfill Site, Peach County,
Georgia in a De Minimis settlement with Eagle
Bridges Co. EPA will consider comments on the
proposed settlement for thirty days.
Under Section 122(g)(4) of CERCLA EPA has agreed
to settle claims for past and future response costs at
the Powerville Landfill Site, Peach County Georgia in
a De Minimis settlement with the U.S. Department of
Agriculture Research Services. EPA will consider
public comments on the proposed settlement for
thirty days.

Whitehall Municipal Wells site from the National
Priorities List and requests public comment on this
action. Comments will be accepted until October 30,

EPA announces its intent to delete the Union Scrap
Iron and Metal Co., site from the NPL and requests

DOJ gives notice of a proposed Consent Decree in
United States v. Certain Teed Corp.. lodged with the

(notice) and revised applications that Connecticut's hazardous
waste program does not satisfy all of the requirements
necessary for final RCRA authorization. However,
EPA may revise its tentative decision if Connecticut
can meet a set of conditions by November 15,1990. If
the State remedies these deficiencies and if no
significant new issues are raised during the comment
period, EPA intends to grant final authorization.
Comments will be received by COB on October 31,
1990. If a public hearing is necessary, comments will
be accepted until C.O.B. on November 1,1990.

EPA is proposing to grant a site-specific variance from
Land Disposal Restrictions (LDR); standards for F006
wastes generated by Craftsman Plating and Turnings
Corp and Northwestern Plating works in Chicago,
Illinois. Additionally, the Agency is proposing to
grant a site specific variance for LDR standards for
F011 and F012 wastes for Cyznokem in Detroit,
Michigan. Comments will be accepted until

EPA is granting a six month extension of the
August 8,1990, effective date of the hazardous waste
injection restrictions for American Cyanamid Co., in
Westwegs, Louisiana, and Celanese Engineering
Resins, Inc., Texas.
EPA requests public comment on a proposed
Administrative Order of Consent under CERCLA
Section 122(g) concerning the Ninth Avenue Dump
Site in Gary, Indiana. 85 Potentially Responsible
Parties (de minimis) involving a $6,500,000
reimbursement for past cost and future estimated
costs. Comments will be accepted until November 1,
1990.
EPA has issued continued guidance on procuring
products composed of recovered materials. This
notice addresses: 1) expediting EPA assistance to
procuring agencies; 2) EPA is examining possible
broad changes for printing and writing papers under
paper procurement guideline; 3) issues concerning
EPA advice to procuring agencies concerning specific
recovered materials under paper procurement
guidelines. EPA is seeking comment on these
guidelines. The deadline for submitting written
comments is December 3,1990.
The Department of Transportation (DOT) gives notice
of partial Consent Decree in United States v. Arthur
Bursey. et al. Decree deals specifically with
complaints against Tony and Rose Matarazzo.

as to defendant KJ. Quinn and Company, Inc.,
regarding past United States response costs ("Consent

This final rule amends the financial regulation under
40 CFR 280.91 (d). This modification changes the

additional requirement (280.91 (e)) for local
government entities. Under this new requirement,
these entitles will be required to comply with financial
responsibility requirements within one year of
publication of final regulations. These regulations are
