While the Council on Environmental Quality in the Executive Office of the President is responsible for national management and general agency guidance, environmental impact statement decisions are often made on a regional or local level. In an attempt to fill an information void, the Federal Regional Council's Task Force on Environmental Impact Study has prepared this pamphlet to consoli- date information on Federal agencies involved in the EIS process. Specifically, the pamphlet lists, according to agency, the types of projects for which EIS's are prepared, the officials responsible for deciding whether or not an EIS will be prepared, and the organizational unit that prepares the EIS for the agency. The address of each agency is included as well as corresponding telephone numbers for inquiries regarding EIS preparation. Also, a cross-index is provided which categorizes project types and indicates the corresponding agency(ies) which may sponsor such projects. EIS Background and History In general, the National Environmental Policy Act has a threefold purpose: to declare a national policy which will encourage productive and enjoyable harmony between man and his environment; to promote efforts which will prevent or eliminate damage to the environment; to enrich the understanding of ecological systems and natural resources important to the Nation. As one means of implementing the above policies, Section I02(2)(c) of NEPA requires each Federal agency to prepare a statement of environmental impact in advance of each major action, recommendation or report on legislation that may significantly affect the quality of the human environment. Environmental impact statements serve to document the environmental consequences of a pro- posed action and to build into a Federal agency's decision-making process a continuing awareness of environmental considerations. NEPA established within the Executive Office of the President the Council on Environmental Quality (CEQ) assigned with the respon- sibilities to study the condition of the Nation's environment; to coordinate Federal environmental efforts and programs, and to see that all Federal activities take environmental considerations into account. The Council serves in an advisory Capacity to the President regarding environmental affairs. In addition, CEQ assists other agencies in determining the applicability of NEPA to agency actions and in promulgating agency procedures to meet NEPA requirements. ------- The EIS Process As early in the decision-making process as practicable, an agency prepares a draft impact statement for review by appropriate Federal, State and local agencies as well as the public. After comment from agencies and other interested parties, the statement is prepared in fina I form, incorporating all comments and objections received on the draft and indicating how significant issues raised during the commenting process have been resolved. Both draft and final statement are filed with CEQ and made available to the public. In addition to public and local agency comment, CEQ has designated which Federal agencies should review environmental impact statements according to the type of impacts involved. Impact statement reviewers comment on the environmental impacts of the proposed project with regard to their particular areas of expertise or jurisdiction by law, e.g. maintenance of air, water and noise quality standards, effects on plants and animals, etc. Besides the NEPA requirements, under Section 309 of the Clean Air Act, the Environmental Protection Agency (EPA) must "review and comment in writing on the environmental impact" of any legislation, action or regulation proposed by any Federal agency if it affects matters related to EPA's jurisdiction. EPA has integrated its Section 309 responsibility into the NEPA impact statement review process; reviews the proposed action with regard to public health, welfare, and environ- mental quality; and notifys CEQ on a weekly basis of their comments. CEQ publishes notice of all impact statements received on a weekly basis and EPA publishes notice of all impact statements reviewed on a bi-weekly basis in the Federal Register. CEQ has published guide-lines for preparing impact statements in the August I, 1973 Federal Register. The CEQ guidelines serve as a prototype used by each Federal agency to develop its own guidelines to meet Federal requirements for impact statement preparation and content. Agency guidelines should include such items as: the types of agency actions that require EIS's, type of information to be included in the EIS; the appropriate time and methods of seeking other agency and public comments, etc. In addition, CEQ guidelines specify that Agencies include procedures for providing public hearings on major actions with environmental impact, whenever appropriate, and for providing the public with relevant information, including alternative courses of action. Both NEPA and the CEQ guidelines explain what information must be included in impact statements. Accordingly, each Draft environmental impact statement must... a) describe the proposed action with information and technical data adequate to permit a careful assess- ment of the total environmental impact. - 2 - ------- b) discuss the probable impact on the environment including any direct or indirect consequences that may result from the action. c) include any adverse environmental effects that cannot be avoided d) present all alternatives to the proposed action that might avoid some or a I I of the adverse environmental effects. e) assess the cumulative long-term effects of the proposed action including its relationship to short-term use of the environment versus the environment's long-term productivity. f) discuss any irreversible or irretrievable commit- ment of resources involved in the proposed action. A Final EIS must include any substantial changes in the proposed action besides a discussion of problems and objections raised by other Federal, State and local agencies, private organizations ard individuals during the Draft EIS review process. - 3 - ------- U.
