Our new focus is to provide information about evolving policy and guidance to RPMs. Individual ROD abstracts will no longer appear in the Update—they will be available in the ROD Annual Report and in the quarterly distribution of RODs. Brief summaries of ROD information and other statistics will be provided periodically. Two new columns will appear on a regular basis, "Policy Alert" and "Update on Guidance," providing summaries of topics of interest. A "Calendar of Events" will also be published. We hope this new format will make the ROD Update useful to RPMs as a reference tool. POLICY ALERT INTERIM POLICY ON FUNDING FOR GROUND WATER AND SURFACE WATER RESTORATION ACTIONS The Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), as amended by the Superfund Amendments and Reauthorization Act (SARA), draws a clear distinction between measures that are considered remedial action and those that are considered operation and maintenance (O&M). According to Section 104(c) of the Act, treatment or other measures initiated to restore ground or surface waters are considered remedial actions for a period up to 10 years. Activities performed to maintain the effectiveness of such measures beyond the 10-year period or after the remedial action is completed (whichever is earlier) are considered O&M. The Agency's current policy stipulates that the 10-year provision applies strictly to those actions initiated for the purpose of restoring ground or surface waters (e.g., removal of a contaminant plume via pumping and treatment to restore a drinking water aquifer). Ground or surface water remedial actions taken for purposes other than to restore these resources are not subject to the provision. Specifically, if the Agency determines that the most cost- effective means of providing an alternate water supply is to pump and treat contaminated ground or surface waters and supply the treated water directly to the community, the Agency would pay for the system's construction and any operational costs for up to 1 year to verify that the treatment system is operational and functional. However, the Agency would not pay for 10 years of operating the system as part of remedial action. This is consistent with the EPA policy that has been in effect since the start of the program. If such a system were part of a remedial strategy for restoring the aquifer to drinking water quality, the 10-year provision would apply. The Agency's policy concerning the 10-year provision will be outlined in the proposed NCP (along with other options) and will be finalized once comments on the proposal have been reviewed and any necessary revisions made. It is recommended that Regions consult with Headquarters prior to signing Records of Decision that involve funding of ground water remedies for up to 10 years when the treated water is to be used as a water supply. The term "alternate water supply" refers to both the provision of new supplies and treatment or distribution of existing supplies. It includes but is not limited to drinking water and household water supplies. This document provides a detailed discussion of and guidance for two levels of decisionmaking: (1) determining if an alternate water supply is needed and (2) selecting and providing an alternate water supply. It should be used in conjunction with other EPA guidance documents, technical reports, and references. Included in this document is a list of sites where alternate water supplies have been provided and the type of system selected. The Collection includes EPA reports, OSWER policy and guidance directives, legislation, regulations, and records of decision. The entire Collection may be accessed using a bibliographic database which runs on an IBM PC/AT or compatible using dBase III software. The database provides automated search and retrieval capability through a number of access points including keywords, title, abstract, sponsoring EPA office and date. The database and documents composing the Hazardous Waste Collection are available in the EPA Headquarters and Regional Libraries, the National Enforcement Investigation Center and the laboratories in Cincinnati, Edison, RTP, Ada and Las Vegas.
