United States Environmental Protection Agency Office of Solid Waste and Emergency Response Publication 9320.7-041 October 1992 vvEPA Background Information: National Priorities List, Final and Proposed Rules Office of Emergency and Remedial Response Hazardous Site Evaluation Division (OS-5204G) Intermittent Bulletin Volume 2, Number 2 The U.S. Environmental Protection Agency (EPA) is publishing two rules in the Federal Register in October 1992 making changes to the National Priorities List (NPL): A final rule is adding 26 previously proposed sites to the General Superfund Section and 7 to the Federal Facilities Section. The 33 sites are in 20 States and Guam. Pennsylvania is adding six new final sites, followed by California and Washington with three each. The rule also deletes four sites. A second rule is proposing eight new sites to the General Superfund Section and one to the Federal Facilities Section. The nine sites are in seven States. Nebraska and New Mexico are proposing two new sites each. The rule also proposes to expand a site being added to the final NPL. These actions, together with other actions described later, bring the number of final sites to 1,208. Proposed sites total 28. Thus, there are 1,236 final and proposed NPL sites: 1,085 final and 25 proposed in the General Superfund Section 123 final and 3 proposed in the Federal Facilities Section EPA is not the lead agency at Federal facility sites, and its role at such sites is accordingly less extensive than at sites in the General Superfund Section. Under Executive Order 12580 and CERCLA Section 120, each Federal agency is responsible for carrying out most response actions at facilities under its own jurisdiction, custody, or control, although EPA is responsible for scoring Federal facility sites. The NPL identifies uncontrolled hazardous waste sites that warrant further investigation to determine if long-term "remedial action" is necessary. The sites in the General Superfund Section of the NPL are eligible for remedial action funded under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), enacted on December 11, 1980, as amended by the Superfund Amendments and Reauthorization Act (SARA), enacted on October 17, 1986. SARA authorized a "Hazardous Substances Superfund" totalling $8.5 billion over 5 years to pay costs for overseeing work by those responsible for cleaning up waste sites, and to pay costs not assumed by responsible parties for cleanup at sites in the General Superfund Section of the NPL. In October 1990, SARA was extended to September 30, 1994 to provide an additional $5.1 billion. EPA's goals for the Superfund program are to: Address the worst sites and the worst problems first Make sites safe by immediately controlling acute threats to people and the environment Develop and use new technologies for more effective cleanups ------- EPA continually seeks ways to evaluate and clean up sites more quickly. The new " Superfund Accelerated Cleanup Model" (SACM) involves several pilot projects aimed at streamlining the Superfund process. EPA will describe any changes to the process resulting from SACM as they are identified. This document provides background information on the two rules and five lists: o The distribution by State of the 33 new final sites o The distribution by State of the 9 new proposed sites * The names and locations of the 33 new final sites * The names and locations of the 9 new proposed sites * The 1,236 final and proposed NPL sites CONTENTS OF FINAL RULE Three sites in the final rule are subject to Subtitle C of the Resource Conservation and Recovery Act (RCRA). EPA's policy is, in general, not to place sites subject to RCRA Subtitle C corrective authorities on the NPL because the owners can be forced legally to take such action under RCRA. However, certain categories will be listed if EPA concludes that doing so best furthers the aims of the NPL/RCRA policy and the CERCLA program that is, cleaning up sites expeditiously while conserving CERCLA's fixed resources. One of these categories includes facilities where owners have demonstrated an inability to finance corrective action by invoking bankruptcy laws. These three sites are in this category: o McCormick & Baxter Creosoting Co., Stockton, CA New Hampshire Plating Co., Merrimack, NH * Petrochem Recycling Corp./Ecotek, Inc., Salt Lake City, UT All sites in this rule scored 28.50 or greater on the Hazard Ranking System (HRS), except for Austin Avenue Radiation Site, Delaware County, PA. It is being added to the NPL on the basis of Section 300.425(c)(3) of the National Contingency Plan (NCP), the Federal regulation by which CERCLA is implemented. Under this section, a site can be placed on the NPL if (1) the Agency for Toxic Substances and Disease Registry (ATSDR) of the U.S. Public Health Service has issued a public health advisory recommending that people be removed from the site, (2) EPA determines that the site poses a significant threat to public health, and (3) EPA anticipates that it will be more cost-effective to use its remedial authority (available only at NPL sites) than its emergency removal authority to respond to the site. On September 6, 1991, ATSDR issued a health advisory warning that the Austin Avenue Radiation Site poses a significant threat to public health because the site has no security, creating a potential for intruders to start a fire, which could spread radiation throughout the neighborhood. On February 7, 1992 (57 FR 4824), EPA proposed the site to the NPL. EPA's policy is to place Federal facility sites on the NPL if they have an HRS score of 28.50 or greater, even if the Federal facility also is subject to the corrective action authorities of RCRA Subtitle C. In that way, those sites could be cleaned up under CERCLA, if appropriate. This final rule includes seven Federal facility sites. The final rule deletes four sites from the NPL because no further response is required to protect human health and the environment. Deletions now total 44. The four sites are: o Big River Sand Co., Wichita, KS o Pagano Salvage, Los Lunas, NM ป EEC Trucking, Vestal, NY o Westline Site, Westline, PA The names of two sites in this rule have been changed based on additional information obtained since the sites were proposed: ฎ West Memphis Landfill, West Memphis, AR, has been renamed South 8th Street Landfill o Westminster Tract #2633, Westminster, CA, has been renamed Ralph Gray Trucking Co. The name of another site, previously placed on the NPL, has been changed. o Holton Circle Ground Water Contamination, Londonderry, NH, has been renamed Town Garage/Radio Beacon ------- CONTENTS OF PROPOSED RULE Two sites in the proposed rule are subject to Subtitle C of RCRA. The owner of this site has demonstrated an inability to finance corrective action by invoking bankruptcy laws: Spectron, Inc., Elkton, MD In addition, the RCRA status of one site is uncertain. To ensure expeditious cleanup, this site is being proposed to the NPL: Rinchem Co., Inc., Albuquerque, NM The proposed rule includes one Federal facility site, and also proposes to expand the Austin Avenue Radiation Site. "NPL COMPLETIONS" LIST In the last rule (FR 4824, February 7, 1992), EPA identified 65 NPL sites at which all remedial construction had been completed. As of October 8, 1992, Superfund has completed all construction at 149 NPL sites. REMOVAL OF FINAL SITES These three sites are no longer on < the final NPL pursuant to recent court actions: Kent County Landfill (Houston), Houston, DE Anne Arundel County Landfill, Glen Burnie, MD Salford Quarry, Salford Township, PA EPA has also voluntarily removed this site from the NPL: Murray-Ohio Manufacturing Co. (Horseshoe Bend Dump), Lawrenceburg, TN NPL FORMAT CHANGES EPA proposed to change how the NPL (Appendix B of the NCP) is presented in the Federal Register (56 FR 35840, July 29, 1991). In the past, Appendix B was arranged by HRS scores and presented in groups of 50 sites. As the NPL has grown over the years, that format has made it increasingly difficult to find individual sites. Almost all public requests for the NPL ask for a list presented by State, rather than by site rank and score. Because the primary purpose of the NPL is to inform the public about sites that are of sufficient concern to warrant further investigation under Superfund, EPA proposed to present Appendix B in a format similar to the lists of proposed and final sites in this document - that is, by State rather than in ranked groups. EPA received seven comments on the proposed new format, all favoring the proposal. Hence, Appendix B is presented in the Federal Register by State. As in the past, it is presented in two sections - General Superfund Section and Federal Facilities Section.
