United States Environmental Protection Agency Office of Solid Waste and Emergency Response Publication 9320.7-041 May 1993 v>EPA Background Information: National Priorities List Proposed Rule Office of Emergency and Remedial Response Hazardous Site Evaluation Division (OS-5204G) Intermittent Bulletin' Volume 3, Number 1 The U.S. Environmental Protection Agency (EPA) is proposing 26 sites to the National Priorities List (NPL) in a rule published in the Federal Register in May 1993. Of the 26 sites in Proposed Rule #14, 19 are in the General Superfund Section and 7 in the Federal Facilities Section. The sites are in 17 States. Virginia is proposing three sites; a number of States are proposing two sites. The status of the NPL (reflecting six site actions described later) is as follows: General Federal Total Proposed Proposed Rule #14 Previously Proposed Final Proposed Plus Final 44 (19) (25) 1,079 10 (7) (3) 54 123 1,202 1,256 EPA is not the lead agency at Federal facility sites, and its role at such sites is accordingly less extensive than at sites in the General Superfund Section. Under Executive Order 12580 and CERCLA Section 120, each Federal agency is responsible for carrying out most response actions at facilities under its own jurisdiction, custody, or control, although EPA is responsible for scoring Federal facility sites. The NPL identifies uncontrolled hazardous waste sites that warrant further investigation to determine if long-term "remedial action" is necessary. The sites in the General Superfund Section of the NPL are eligible for remedial action funded under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), enacted on December 11, 1980, as anyn/Wl by the Superfund Amendments and Reauthorization Act (SARA), enacted on October 17, 1986. SARA authorized a "Hazardous Substances Superfund" totalling $8.5 billion over 5 years to pay costs for overseeing work by those responsible for cleaning up waste sites, and to pay costs not assumed by responsible parties for cleanup at sites in the General Superfund Section of the NPL. In October 1990, SARA was extended to September 30, 1994 to provide an additional $5.1 billion. EPA's goals for the Superfund program are to: • Address the worst sites and the worst problems first • Make sites safe by immediately controlling acute threats to people and the environment • Develop and use new technologies for more effective cleanups EPA continually seeks ways to evaluate and clean up sites more quickly. The new "Superfund Accelerated Cleanup Model" (SACM) involves several pilot projects aimed at streamlining the Superfund process. EPA will describe any changes to the process resulting from SACM as they are identified. This document provides background information on the rule and two lists: ------- o The names and locations of the 26 new Proposed Rule #14 sites « The 1,256 final and proposed NPL sites by state CONTENTS OF RULE Two sites in this rule are subject to Subtitle C of the Resource Conservation and Recovery Act (RCRA). EPA's policy is, in general, not to place sites subject to RCRA Subtitle C corrective action authorities on the NFL because the owners can be forced legally to take such action under RCRA. However, certain categories will be listed if EPA concludes that doing so best furthers the aims of the NPL/RCRA policy and the CERCLA program - that is, cleaning up sites expeditiously while conserving CERCLA's fixed resources. One of these categories includes facilities where owners have demonstrated an inability to finance corrective action by invoicing bankruptcy laws. One site is in this category: o Onondaga Lake, Syracuse, NY Another site involves off-site contamination and air deposition of contamination at and from this site. EPA believes that not all-site related contamination may be addressable under RCRA Subtitle C. Therefore, this site will be further addressed under CERCLA: » National Zinc Corp., Bartlesville, OK All sites in this rule scored 28.50 or greater on the Hazard Ranking System (HRS). EPA's policy is to place Federal facility sites on the NPL if they have an HRS score of 23.50 or greater, even if the Federal facility also is subject to the corrective action authorities of RCRA Subtitle C. In that way, those sites could be cleaned up under CERCLA, if appropriate. This rule includes seven Federal facility sites. One site not listed in the Federal Facilities Section, the Blackbird Mine in Lemhi, ID, is located in part on Federally owned land. There is no separate category for mixed-ownership sites, and EPA considers it more appropriate to propose listing the Blackbird Mine in the General Superfund Section of the NPL. In particular, the sources of contamination on the Federal portion of the site arc few compared to the sources on private land, and contamination is not the result of activities of the U.S. Forest Service, which currently manages the Federal portion of the site. EPA emphasizes that designating a site as Federal or non-Federal has no legal significance and is purely informational in nature. Such designation does not determine, or limit, the extent of any Federal agency's obligations under CERCLA Section 120. EPA solicits comments on the most appropriate designation of the site. EPA proposes to change the names of two previously proposed sites: o Del Amo Facility, Los Angeles, CA, is to be renamed Del Amo Pits • American Shizuki: Corp./Ogallala Electronics and Manufacturing, Inc., Ogallala, NE, is to be Ogallala Ground Water Contamination EPA believes these names more accurately reflect the sites and solicits comment on these proposed name changes. OTHER SITE ACTIONS At the time of the last final rule (57 FR 47181, October 14, 1992), 1,208 sites were on the final NPL. Since then, the number has been reduced to 1,202 by several actions. These four sites were deleted because no further response is required to protect human health and the environment The sites are: o Pioneer Sand Co., Warrington, FL (58 FR 7492, February 8, 1993) « Arrcom (Dexler Enterprises), Rathdrum, ID (57 FR 61005, December 23, 1992) » Metal Working Shop, Lake Ann, MI (57 FR 61004, December 23, 1992) o Adrian Municipal Well Field, Adrian, MN (57 FR 62231, December 30 1992). One February 2, 1993 (58 FR 7189), this site was deleted based on deferral to RCRA Subtitle C corrective action authorities: 9 Waste Research & Reclamation Co., Eau Claire, WI Since the last rule, EPA has voluntarily removed this site from the NPL: » Lehigh Portland Cement Co., Mason City, IA. ------- CONSTRUCTION COMPLETION LIST EPA baa developed the Construction Completion List (CCL) (58 FR 12142, March 2,1993) to better show the successful completion of Superfund response action at present or former NPL sites. Hie CCL is intended to enhance public understanding of die status of cleanup progress at sites. The CCL now totals 161 sites, all but 1 from the General Superfund Section. Cleanups at sites on die NPL do not reflect the total picture of Superfund accomplishments. As of March 1993, EPA had conducted 2,884 removal actions, 822 of them at NPL sites.
