United (States1 Environmental Protection Agency Office of Solid Waste and Emergency Response Publication 9320.7-051 September 1995 Background Information: National Priorities List, Proposed Rule and Final Rule Office of Emergency and Remedial Response Hazardous Site Evaluation Division (52404G) Intermittent Bulletin Volume 5, Number 2 (Proposed Rule) Volume 2, Number 3 (Final Rule) The U.S. Environmental Protection Agency (EPA) is proposing 12 sites to the National Priorities List (NPL) in a rule published in the Federal Register in September 1995. Of the 12 sites in Proposed Rule #19, all are in the General Superfund Section. These sites are in ten States. Michigan and New Jersey are each adding two sites, and a number of States are adding one site. In addition, EPA is withdrawing its proposal of one site to the NPL. The U.S. Environmental Protection Agency (EPA) is also adding eight sites to the National Priorities List (NPL) in a rule published in the Federal Register in September 1995. Of the eight sites in Final Rule #15, six are in the General Supertund Section and two in the Federal Facilities Section. The sites are in seven States and one U.S. territory. Under Executive Order 12580 and CERCLA Section 120, each Federal agency is responsible for carrying out most response actions at facilities under its own jurisdiction, custody, or control, although EPA is responsible for scoring Federal facility sites. The NPL identifies uncontrolled hazardous waste sites that warrant further investigation to determine if long-term "remedial action" is necessary. The sites in the General Superfund Section of the NPL are eligible for remedial action funded under the Comprehensive Environmental Response, Compensation, and Liability ACT (CERCLA), enacted on December 11, 1980, as amended by the Superfund Amendments and Reauthorization Act (SARA), enacted on October 17, 1986. SARA authorized a "Hazardous Substances Superfund" totalling $8.5 billion over 5 years to pay costs for overseeing work by those responsible for cleaning up waste sites, and to pay costs not assumed by responsible parties for cleanup at sites in the General Superfund Section of the NPL. In October 1990, SARA was extended to September 30, 1994 to provide an additional $5.1 billion. An appropriation by Congress for Fiscal Year 1995 authorized Superfund to continue to operate. EPA's goals for the Superfund program are to: Address the worst sites and the worst problems first Make sites safe by immediately controlling acute threats to people and the environment ------- Develop and use new technologies for more effective cleanups " EPA continually seeks ways to evaluate and clean up sites more quickly. The "Superfund Accelerated Cleanup Model" (SACM) involves several pilot projects aimed at streamlining the Superfund process. EPA will describe any changes to the process resulting from SACM as they are identified. This document provides background information on these rules and three lists: The names and locations of the 12 Proposed Rule #19 sites; The names and locations of the 8 Final Rule #15 sites; The 1,290 final and proposed NPL sites by state. CONTENTS OF RULES Eight sites in this proposed rule scored 28.50 or greater on the Hazard Ranking System (HRS), three sites are proposed based on ATSDR health advisory criteria, and one site is proposed based on its designation as a State top priority. Seven sites in this final rule scored 28.50 or greater on the HRS. The remaining site is added to the NPL based on ATSDR health advisory criteria. EPA's policy is to place Federal facility sites on the NPL if they have an HRS score of 28.50 or greater, even if the Federal facility also is subject to the corrective action authorities of the Resource Conservation and Recovery Act (RCRA) Subtitle C. In that way, those sites could be cleaned up under CERCLA, if appropriate. Final Rule 15 includes two Federal facility sites. EPA emphasizes that designating a site as Federal or non-Federal has no legal significance and is purely informational in nature. Such designation does not determine, or limit, the extent of any Federal agency's obligations under CERCLA Section 120. EPA solicits comments on the most appropriate designation of the site. OTHER SITE ACTIONS At the time of the last final rule (60 FR 27896, May 26, 1995), 1,237 sites were oq-the final NPL. With these rules, the number is increased to 1,238. Seven sites were deleted because no further response is required to protect human health and the environment. EPA is withdrawing its proposal of one site due to comments on the proposal and other information submitted to the Agency: Plymouth Avenue Landfill, Deland, Florida. EPA is proposing to withdraw the following proposed site: Broward County - 21st Manor Dump, Fort Lauderdale, Florida. CONSTRUCTION COMPLFHON LIST EPA has developed the Construction Completion List (CCL) (58 FR 12142, March 2,1993) to better show the successful completion of Superfund response action at present or former NPL sites. The CCL is intended to enhance public understanding of the status of cleanup progress at sites. The CCL now totals 304 sites. Cleanups at sites on the NPL do not reflect the total picture of Superfund accomplishments.
