The Toxicity Characteristic rule will bring a significant volume of
previously unregulated waste into the federal hazardous waste
management system. Businesses that take steps to reduce genera-
tion of these wastes may realize substantial savings in waste man-
agement costs. Tips on waste minimization practices are provided
below, along with contacts for more information.

The final Toxicity Characteristic
rule replaces the existing Extraction
Procedure Toxicity Characteristic
(EPTC) by adding 25 chemicalsto
the eight metals and six pesticides
onlhe EPTC list of constituents.
The rule also replaces the Extraction
Procedure (EP) leach test with the
Toxicity Characteristic Leaching
Procedure (TCLP). Regulatory levels
for the 25 new constituents are deter-
mined by the product of a health-
related concentration threshold and
a dilution/attenuation factor (DAF).
The DAF is derived using a new
ground-water transport model.
What the TC Rule
Means to Generators
Facilities that produce 1 ,000 kiio-
hazardous waste within a calendar
rnontiTare^lassified by EPA as haz-
ardous waste generators. For the sake

"Large Quantity Generators," or \
LQGs. LQGs are subject to more \
Stringent storage requirements under
federal law than their small quantity
generator (SQG) counterparts, who j
produce less than 1,000 kilograms,
but iriore than 100 kilograms of
ardouYwaste in a month.
Under the new rule, generators are
required to use the Toxicity Charac-
teristic criteria in place of the EPTC
when determining whether any haz-
ardous waste is produced by their
industrial processes. Some facilities
previously regulated as small quan-
tity generators may be brought into
the LQG category with this rule,
since the volume of "TC waste" gen-
erated must now be added to monthly
hazardous waste volume calculations.
Newly regulated LQGs are subject to
all generator requirements as outlined
in Title 40, Part 262 of the Code of
Federal Regulations (CFR).
The new rule might also affect
some businesses previously not sub-
ject to hazardous waste regulation.
These businesses are now required to
determine whether TC constituents
are present in their waste stream at or
above the regulated levels. If so, they
must comply with appropriate gener-
ator requirements.
Compliance Guidelines
Under the new rule, waste genera-
tors must determine whether one or
more of the TC constituents are pre-
sent in their waste at or above the
regulated levels. If so, LQGs must
take the following steps to comply
with the new rule:
1. Notify EPA and obtain an EPA
Identification Number (using EPA
Form 8700-12) within six months of
the rule's publication. Businesses that
already have an EPA ID Number for
their facility are not required to reno-
tifyEPA.
2. Comply with all on-site waste
storage requirements, including time
constraints (maximum 90 days) and
satellite storage regulations. Facilities
that have permits to treat or dispose
of their waste on site may require
permit modifications under this rule.

3. Ensure that a Uniform
Hazardous Waste Manifest (EPA
Form 8700-22) accompanies any
waste that is transported offsite.
Generators are legally responsible
for the proper disposal of their haz-
ardous waste. TC waste is subject to
all disposal requirements found in
Part 265 of the CFR; generators must
ensure that their waste is disposed of
only at properly permitted facilities.
LQGs must be in full compliance
with these requirements by Septem-
ber 25, 1990. Generators who fail to
take these steps are subject to fines
and other EPA enforcement actions.

Reducing Management Costs
Waste minimization means reduc-
ing the amount of waste your compa-

Uniform Hazardous Waste Manifest
Federal law requires that any facility that generates more
than 100 kilograms (220 pounds or approximately one-half of
a 55-gallon drum) of hazardous waste (or 1 kilogram of acute-
ly hazardous waste) in a calendar month use the completed
Uniform Hazardous Waste Manifest when shipping its haz-
ardous waste off-site.
Remember—you must use the Manifest of the state to
which you are sending the waste. If that state does not have its
own version of the Manifest, use the Manifest form of the
state in which you generated the waste.
If neither the state to which you are sending your waste
nor the state in which your waste was generated has its own
Manifest form, you may order Manifest forms from commer-
cial companies that produce the federal version of the
Manifest, or obtain copies from some hazardous waste treat-
ment, storage, or disposal firms.
Items 1 through 20 (and 21 through 35 on the continua-
tion sheet) constitute the federal portion of the Manifest form.
Items A through K comprise the state portion of the form.
When using a state form, follow the instructions provided
with that form. If you are not using a state form, ask your
state hazardous waste agency whether you must fill in items A
through K. Contact your state hazardous waste agency, your
hauler, and the facility that is to receive your waste shipment
to be sure you complete all the necessary items on the
Manifest.
