Dear Mr. Chairman:
Enclosed is the most recent update on the Environmental
Protection Agency's (EPA) implementation of the Safe Drinking
Water Act (SDWA), in response to your request for quarterly
updates in your letter of June 8, 1990, to Administrator Reilly.
Since our last report, EPA has made significant progress on
the implementation of the lead and copper rule. We have
completed guidance for public education and guidance for Federal
data reporting. The guidance on data reporting calls for the
first information on rule implementation to be reported to EPA on
September 1, 1992. This information will include the 90th
percentile lead values for systems serving more than 50,000.
EPA issued final guidance on enforcement of the surface
water treatment rule on June 26. The surface water treatment
rule is one of EPA's highest enforcement priorities. Under the
guidance, systems that fail to have filtration in place by the
June 1993 deadline will be considered significant noncompliers.
Under existing policy, EPA attempts to initiate enforcement
actions against significant noncompliers within six months.
The drinking water program formally established national
priorities for State program implementation in a guidance memo
dated June 15, 1992. The guidance will be used in negotiating
grant workplans and other implementation agreements with the
States. This guidance acknowledges that all State activities
cannot be completed immediately with current State resource
levels. The guidance will remain effective for five years.

The Phase"V Rule, establishing National Primary DrinJcing
Water Regulations (UPDWR) for an additional 23 contaminants, was
published in the Federal Register on July 17. This package
brings the total number of standards to 84. These standards,
along with the suifate standard, which was deferred, and the
future arsenic and radionuclides rules, will complete the list of
83 regulations listed in the 1986 amendments to the Safe Drinking
Water Act. The schedule for the deferred sulfate NPDWR is still
under discussion.
In ground water protection, I am pleased to report that EPA
has advanced the development and implementation of the
Comprehensive State Ground Water Protection Program with the
Deputy Administrator's release of the draft guidance for these
programs in early July. Over 2,000 copies of the draft were
distributed to Federal, State, and Tribal agencies, environmental
groups, businesses and other interested parties, and comments are
due in early September. We will apprise the Subcommittee of our
progress and further developments in implementing this key
element of EPA's Ground Water Protecti n Strategy.

1. SAFE DRINKING WATER ACT AMENDMENTS OF 1986
Section 1412
National Drinking Water Regulation^
• A Notice of Availability (NOA) of additional information for
the Phase V rule was published in the Federal Register on
November 29, 1991. The public comment period closed on
December 30, 1991. Approximately 25 comments were received.
The Phase V rule — which will establish National Primary
Drinking Water Regulations for 23 organic and inorganic
contaminants, was signed on May 18, 1992, and published in
the Federal Register on July 17', 1992. The sulfate portion
of the rule has been deferred. The schedule for completion
of the sulfate regulation is still being negotiated.
• The proposed arsenic rule has a court-ordered deadline of
November 30, 1992, for the Administrator's signature. The
final rule is projected for January 1995.
• EPA is required under a Consent Decree to propose Maximum
Contaminant Level 'Goals (MCLGs) and National Primary
Drinking Water Regulations (NPDWRs) for at least 25
additional contaminants by June 1993 (Phase VIA and VIB).
The disinfection by-product regulation (Phase VIA) is being
considered as a possible negotiated rule. If all parties
are amenable to negotiation, the process would begin in
October, 1992. Disinfection requirements for ground water
systems are being developed concurrently with Phase VI. A
draft rule for disinfection requirements for ground water
systems was distributed for public comment the week of July
20. The comment period closes September 30, 1992.
* The Administrator signed on May 8, 1992, a Federal Register
notice; staying the effective date of the MCLG and MCL for
aldicarb, aldicarb sulfoxide, and aldicarb sulfone, in
response to a petition and law suit filed by the
manufacturer. Following a risk reassessment, SPA will open
the MCLs and MCLGs for further public comment.

State Primar Enforcement
The U.S. Couxt of Appeals, District of Columbia Circuit, set
the litigation schedule for the remaining count of a lawsuit
filed by the National Wildlife Federation (NWF) related to
the primacy withdrawal language in the revised Public Water
Supply Supervision primacy regulations promulgated on
December 12, 1989. The NWF filed their opening brief on
this count in June and EPA filed a response brief on July
17. Oral arguments are scheduled for October 15, 1992. The
Court found in EPA's favor on February 15, 1991, on part of
the lawsuit, including the counts related to the extension
process .
Status of NPDHR Adoption as of July 31, 1992:

the rule into State regulations. Of these, EPA has
approved 40 State primacy revisions (three more than
last update) . The remaining 13 States are preparing
requests for EPA approval.

regulations. Of these, EPA has approved 39 State
primacy revisions (three more than last update) . The
remaining 13 States are preparing requests for EPA

Based on Regional surveys, large water systems have
completed the first round of monitoring for lead and
copper. Most States report difficulties in budgeting
for rule implementation, and many have indicated they
will be requesting extensions to adopt the rule. One
State has submitted a request for a primacy revision,
and one State has formally requested an extension. The
final Implementation Guidance (for Part I, Monitoring)
was completed in October, 1991. Supplemental
monitoring guidance for large systems (>50,000) was
issued January 1, 1992. Supplemental monitoring
guidance for medium sized systems (3,300 - 50,000) and
small systems (<3,300) was issued in April, 1992.

Enforcement of Drinking Water Regulations
»l Guidance on Enforcement of the Requirements of the
Surface Water Treatment Rule, was issued on June 26, 1992.
This guidance covers the portions of the surface water
treatment rule dealing with unfiltered systems allowed to
remain unfiltered and those unfiltered systems required to
filter.
Data Verifications. SPA has completed data verifications in
nine States in FT 1992. Three more data verifications are
scheduled for this fiscal year.
Final Guidance on the Lead and Copper Rule was issued June
lf 1992. This guidance provides definitions and federal
reporting requirements for milestones, violations, and
significant noncompliers (SNCs) . State summary information
reflecting the monitoring data results for systems serving
greater than 50,000 persons is to be provided to SPA (via
the Federal Data Reporting System) by September 1, 1992.
Any large system that fails to correct an initial tap
monitoring/ reporting violation will become an SBC on Oct. 1,
1992.

On July 22, 19-92 SPA announced a second round of the OIC
Class V enforcement initiative which will focus on service
stations owned and/or operated by a group of 12 oil
companies and on fleet motor pools operated by the General
Services Administration. Settlement negotiations should
commence in early FY'93 and be concluded by the third
quarter of FT'93.

TpterJM Regulation of Underground Injection
The Federally-chartered advisory committee (FACA) charged
with examining potential changes for Class II oil and gas
regulations readied agreement on language for recommended
changes for three guidance documents, and regulations for
construction requirements and "area of review." The State,
industry, trade association and environmental group
participants have endorsed most of the recommendations. A
proposed rule that encompasses the committee's consensus is
projected for the first quarter of FY 1993. SPA issued

environmental protection standards of oil and gas injection

• The Wellhead Program (WHP) for Ohio has been approved,
bringing the total number of approved programs to 21. We
continue to work with other States to develop and implement
their Wellhead Protection Programs.
• The first year of the National Rural Water Association
Ground Water/Wellhead Protection Program has proven success-
ful, with four hundred ten (410) communities representing a
population of over 700,000 now involved in developing and
implementing their own wellhead protection plans. Of these
communities, 163 are now managing their WHP areas. Twenty-
six of these communities have plans in place to handle
emergencies affecting water supplies.

and Training of Personnel
EPA began implementation of a Drinking Water Mobilization
Strategy in FY 1988 to build coalitions among public and private
organizations interested or involved in drinking water quality
issues.
• EPA has recently .revised the Mobilization strategy with an
eye to focusing and streamlining the effort. The new
strategy identifies 3 initiatives: State Capacity, Small
Systems, and Public Education. These initiatives represent
a consolidation and refocusing of the old strategy's 7
initiatives: State Capacity; Institutional Support; Local
Health Officials; Non-Transient, Non-Community Systems;
Technology; Training; and Public Education. The text of
strategy follows:

laboratory capacity through increased appropriations and/or
use of alternative funding mechanisms (user fees). Where

Health departments, rural water associations, and others to
do inspections /sanitary surveys, sampling, etc. to maximize
State program, resources.

OBJECTIVE 1: Establish State Viability Programs; encourage
restructuring of non-viable systems; increase understanding
of system financing options; and encourage public private
partnerships .
OBJECTIVE 2: Expand use of appropriate technology.
OBJECTIVE 3: Assist formation of State training and TA
coalitions.
OBJECTIVE 4: Promote pollution prevention of drinking water
sources .
III. Public Education Initiative
OBJECTIVE 1: Educate consumers on public health and other
benefits of SOfA regulations. Focus public education
efforts on creating willingness to pay, promoting compliance
and supporting State primacy retention.
State Capacity Update: Despite the fact that 31 States
experienced budget shortfalls this past year, 17 States
sought additional funding in 1992 year for their drinking
water programs. Thus far, 10 States received some form of
increase for FY 1993 totalling approximately $7.0 million.
Six States (KS, MS, MO, MS, SD, VA) were granted the
authority to assess fees to support the drinking water
program. An additional three States (CT, ME, WV) received
additional general fund appropriations. Idaho received a
significant increase from a special fund.
SPA Regional Mobilization coordinators are currently working
in eleven States in support of State Capacity building
activities. Current efforts to build consensus for funding
approaches will lead to the development of legislation for
the 1993 legislative session. States where SPA is currently
working or soon will be working include: Arizona, Colorado,
Connecticut, Idaho, Illinois, Iowa, Kansas, Maine, New
Mexico, South Carolina, and Vermont.
