BACKGROUND INFORMATION National Priorities List, Proposed Update »5 . •V At this time, the U.S. Envirotmental Protection Agency (EPA) is proposing 45 sites as Update #5 to the National Priorities List (NPL). In a separate action, EPA is adding new sites to the NPL in a final rulemaking. Proposed Update #5 includes sites from 23 of the 50 States, the District of Columbia, and six Territories. New York and Pennsylvania lead with six sites each. The NPL identifies the targets for long-term "remedial action" under the "Superfund" law, the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCIA). The law set up a Trust Fund that totaled about $1.6 billion over the first 5 years of the Act. The Fund pays costs not assumed by responsible parties for corrective actions at abandoned or uncontrolled hazardous waste sites that threaten public health or the environment. EPA has the primary responsibility for managing cleanup and enforcement activities under Superfund. To date, EPA has inventoried approximately 23,800 uncontrolled hazardous waste sites. Some require emergency action because they represent an immediate threat. EPA cleans up such sites promptly through its "removal" program. As of April 25, 1986, EPA had undertaken 712 removal actions, of which 171 were at NPL sites where initial cleanup measures were required. To be eligible for a long-term "remedial" action under Superfund, however, a site must be included on the NPL. The 45 Update #5 sites are proposed for the NPL on the basis of their scores on the Hazard Ranking System (HRS), a numerically based system designed to evaluate the relative risks posed by a site to public health and the environment. All the sites received HRS scores of 28.50 or above. This document provides background information on proposed additions to the NPL and includes the following lists: 0 The 45 sites in Proposed Update #5, arranged in groups according to their scores on the HRS; Federal facilities are in a separate section. 0 The proposed sites arranged alphabetically by State. Washington, DC 20460 ------- 2- Federal Facility Sites A recent change to the National Contingency Plan (NCP), the Federal regulations under which CERCIA is implemented, allows placing Federal facilities on the NPL. Accordingly, EPA will include them on a separate section of the NPL. However, under CERCLA section lll(e)(3), the Trust Fund cannot be used for remedial actions at Federally owned facilities. Update #5 includes these two Federal sites: 0 Naval Air Development Center (8 Waste Areas), Warminster Township, Pennsylvania 0 Naval Undersea Warfare Engineering Station (4 Waste Areas), Keyport, Washington. Butler Mine Tunnel, Pittston, Pennsylvania The Butler Mine Tunnel, situated in a populated area in Pittston, Pennsylvania, is included in proposed Update 15. The tunnel was designed to drain acid mine waste into the Susquehanna River. The tunnel is honeycombed with boreholes and shafts. In addition to mine drainage, hazardous wastes were disposed in the tunnel. In July 1979, EPA initiated an emergency action at the site under section 311 of the Clean Water Act because oily material was being released from the tunnel into the river. In 1980, the State installed an automated detection system where the tunnel discharges to the river. Response actions ended in January 1981. The State continued to monitor the outfall until 1984, during which time there was no evidence of any di scharge. On October 23, 1981, EPA announced the Interim Priorities List (IPL), which included the Butler Tunnel. The IPL was a preliminary list of 115 sites developed prior to the formal proposal of the first NPL. In February 1982, the State of Pennsylvania indicated that no further response actions were warranted based on monitoring of existing conditions. On December 30, 1982, the first NPL was proposed in the Federal Register (47 FR 58476). Butler Tunnel was not included on the list because EPA had determined that all appropriate Fund-financed cleanup had been completed. Therefore, the site satisfied the criteria necessary for deletion from the NPL. Following heavy rains associated with Hurricane Gloria, oily material was observed discharging from the Butler Mine Tunnel outfall into the Susquehanna River on September 27, 1985. EPA again took emergency action, including measures to sample and contain the oily material, under CERCLA's removal authority. However, remedial action may be needed in the future to provide a long-term resolution of problems at the Butler Mine Tunnel. Therefore, the site is included in proposed Update #5 to provide EPA the additional capabilities available under CERCLA1s remedial action authorities. ------- -3- Silyer Bow Creek/Butte Area Site, Butte, Montana EPA has decided to expand the existing Silver Bow Creek Site in Butte, Montana, which was placed on the NPL in September 1983. At that time, the site was characterized as approximately 28 strean miles. Preliminary evaluation of data from EPA's remedial investigation/feasi- bility study (RI/FS) of the site indicates that sources upstrean are contributing to contamination in the creek. EPA considered two options for dealing with the upstrean problems — proposing a separate Butte Area Site or expanding the existing Silver Bow Creek Site. A thorough analysis of the relationship between the Silver Bow Creek Site and the Butte area led EPA to conclude that the geographical relationship of the headwaters of Silver Bow Creek (which originate a short distance upstrean of the Silver Bow Creek drainage area) and the portion of the Silver Bow Creek downstream of the City of Butte favors treating these areas as one site under CERCLA. In addition, EPA decided to analyze the nature and extent of contamination under one comprehensive RI/FS because contamination from these areas threatens the sane surface water body and the same target population. Tfrje geographical relationship suggests that the Butte area is a major source of contami- nation to the Silver Bow Creek, which is the major receiving water body for mining discharges and drainage from the Butte area. EPA treats sources of and extent of contamination at other sites in this way and concluded that it was logical to evaluate the Butte area and the Silver Bow Creek Site together. Adding the Butte area does not greatly expand the site geographically. EPA is soliciting comments on expansion of the Silver Bow Creek Site and will evaluate comments received before proceeding with remedial actions in the Butte area. Description of Lists In the first list, the sites on proposed Update 15 are presented in groups based on HRS scores. The proposed sites are placed in groups corresponding to the groups of 50 on the final NPL. For exanple, the sites in Group 5 of the proposed update have scores that fall within the range of scores covered by the fifth group of 50 sites on the final NPL. Each entry in the list by group and the list by State contains the name of the site, the State and city or county in which it is located, and the corresponding EPA Region. Each entry is also accompanied by one or more notations referencing the type of response and the status of cleanup activities. ------- -4- Five response categories are used to designate the type of response underway. One or more categories may apply to each site. The five are: R = Federal and/or State response F = Federal enforcement S = State enforcement V = Voluntary or negotiated response D = To be determined For informational purposes, cleanup status is indicated where field activities are underway or completed. Many sites are cleaned up in stages or "operable units" — that is, a discrete action taken as part of the entire site cleanup that significantly decreases or eliminates contamination, threat of contamination, or pathway of exposure. One or more operable units may be necessary before EPA considers the cleanup of a hazardous waste site completed. A simple action such as constructing a fence is not considered an operable unit for coding purposes. Three cleanup status codes are used. (Only one code can be used at a site because the codes are mutually exclusive). The three codes are: I = Implementation activities are underway for one or more operable units. 0 = Implementation activities are completed for one or more (but not all) operable units.
