OSWER DIRECTIVES-KEYWORD AND CFR INDEXES
I. INTRODUCTION
EPA's Office of Solid Waste and Emergency Re-
sponse (OSWER) is responsible for developing and im-
plementing the federal hazardous waste, Superfund, and
underground storage lank regulations. OSWER direc-
tives are documents used by that office to identify and
communicate policy and procedures to EPA regional of-
fices. The documents vary in length and scope, from
memoranda to guidance manuals; they identify ne\v
policy, clarify existing policy, specify procedural guide-
lines, and offer program guidance.
The OSWER directives contain much information that
can help the regulated community better understand and
comply with EPA's ha/ardous waste regulations. Unfor-
tunately, until now, this information has not been widely
used because it has not been cataloged and indexed in a
usable manner. In an effort to make this information
more accessible to the public, McCoy and Associates,
Inc. has reviewed and cross-referenced all of the RCRA
ha?,ardous-wasle-related OSWER directives listed in
EPA's database. Our copy of that database was last up-
dated in May 1989 and a more recent update is not yet
available.
Many of the directives have been superseded by sub-
sequent changes in the regulations. We have made every
effort to identify outdated directives and exclude them
from our listing. Those directives that we believe reflect
current agency policy are listed in the next section of this
article, beginning on page 4-3. For each directive the li.sl
includes a reference number assigned by McCoy and As-
sociates, the OSWER directive number assigned by EPA.
the title, the effective date, and the number of pages. For
those directives available from the National Technical In-
formation Service (NTIS), the NTIS order number is
given. As a service to our subscribers, we have obtained
copies of the directives not available Irom NTIS and are
offering them to interested parlies al a cost of fifty cents
per page with u minimum charge of $15.00 per order.

SAMPLES FROM THE OSWER DIRECTIVES
Because the OSWER directives total thousands of
pages o! guidance, it is impossible to summan/e their
contents in anv meaningful wav. However, we have
selected a few examples from the directives lo provide
our readers with a clearer understanding of the type of
information provided by these documents:
• Totally enclosed treatment facilities do not require a
RCRA permit; however, the definition of what consti-
tutes "totally enclosed'' is not well defined by the reg-
ulations. OSWER directive 9432.01(83) provides the
following guidance:
"The agency intends that a 'totally enclosed'
treatment facility be one which is completely
contained on all sides and poses little or no
potential for escape of waste to the environ-
ment even during periods of process upset.
The facility must be constructed so thai no
predictable potential for overflows, spills,
gaseous emissions, etc. can result from mal-
function of pumps, valves, etc., associated with
the totally enclosed treatment or from a mal-
function in the industrial process to which it is
connected. Natural calamities or acts of sabo-
tage or war (earthquakes, tornados, bombing,
etc.) are not considered predictable, however.
"As a practical matter, the definition limits
'totally enclosed treatment facilities' to pipe-
lines. tanks, and to other chemical, physical,
and biological treatment operations which are
carried out in tank-like equipment (e.g., stills,
distillation columns, or pressure vessels) and
which are constructed and operated to prevent
discharge of potenlialK ha/ardous material to
the environment. This requires consideration
of the three primary avenues ol escape: leak-
,'.i;c. spills, and emissions."
• Puncturing, crushing, or shredding containers does not
constitute treatment (l>432.

• Wastes containing sulfides may also exhibit the charac-
teristic of reactivity. Again, the RCRA regulations do
not specify a threshold below which a sulfide-contain-
ing waste would be considered nonhazardous; how-
ever, EPA's internal policy is that only wastes con-
taining 500 mg/kg total available sulfidc are
considered hazardous |9443.04(85)j.
» Residues of non-acute hazardous wastes must be re-
moved from containers using procedures described in
261.7(b). As long as the container meets the definition
of "empty" per this regulation, the residue remaining
in the container, by definition, is not considered to be
a hazardous waste unless i{ exhibits a characteristic
(9441.25(84)]. Note, however, that residue must be re-
moved by all "commonly employed" emptying
methods, even if the quantity of residue remaining
meets (he regulatory standards (e.g., less than or
equal to one inch or 0.3% of the container's capacity).
For example, if a tank car has a bottom valve for un-
loading and this method produces the minimum re-
sidue, top unloading alone cannot be used even if less
than 1 inch of residue or 0.3% of capacity remains in
the tank [9441.34(84)j.
• Creosote-treated railroad Hex arc not considered to be
listed hazardous wastes when disposed; however, they
could be hazardous wastes when disposed if they ex-
hibit any characteristics (9441.28(85)). [Ed. note-
whcn the TCLP becomes effective, these ties could
very well exhibit a characteristic because both crcsols
and pentachlorophenol are on ihc TCLP list of haz-
ardous constituents.)
• Wastes that arc listed solely because they exhibit a char-
acteristic pose special problems under the derivcd-
from and mixture rules. (FW3 spent solvents, which
were listed solely because they exhibit the charac-
teristic of ignitability, are examples of such wastes.) If
these wastes arc mixed with non-hazardous wastes.
and if the resulting mixture no longer exhibits a char-
acteristic, it is not a Jia/ardous waste. However, il the
same waste "is not mixed with a solid waste during
treatment." the residue remains a listed waste until it
1^ dehsted even if the residue no longer exhibits the
characteristic ("441.32(S4)J.
• Solids haiing a flash point of less ihan 140°F do not
meet the criteria for ignitable wastes; this charac-
teristic only applies «> liquids (VM43.(X)-1 A).
• For a solid to exhibit the characteristic of ifyiitahiliry il
"must be capable, under standard temperature and
pressure, of both causing fires through friction, ab-
sorption of moisture or spontaneous chemical
changes and burn so vigorously and persistently that it
creates a hazard." Thus, titanium wastes, which are
difficult to ignite, are not ha/ardous even though.
once ignited, they pose a hazard [9443.01(83)].
• Tlie characteristic for ignitable liquids contains an ex-
emption for "aqueous solutions conlaininu less than
24% alcohol by volume." Although EPA intended this
exemption to apply only to alcoholic beverages, they
failed to use the term "ethanol" rather than "alco-
hol." Therefore, this exemption applies to any chemi-
cal containing the hydroxyl (-OH) functional group,
such as methanol or propanol [9443.02(85)).
• Corrosion-resistant batteries designed to prevent disin-
tegration in a landfill do not need to be cut up before
being tested via the EP toxicity test. Such batteries
should show no signs of leakage after submersion for
one month in a salt water solution and should also be
resistant to crushing. Batteries not satisfying these cri-
teria must be cut up so that they can pass through a
1-cm sieve before being tested by the EP toxicity test
(9443.05(83)).
• An aerial pesticide applicator periodically washes the
surface of his airplane, which is used to apply pesti-
cides that are P-listed wastes when disposed. The air-
plane washwater is not a listed hazardous waste be-
cause the pesticide on the airplane resulted from the
intended use of the chemical rather than a decision to
throw away the pesticide [9443.05(85)].
• Solid sodium hydroxide or potassium hydroxide pellets
do not exhibit the characteristic of corrosivity because
this characteristic only applies to aqueous liquids with
a pH > 12.5 or liquids that are corrosive to steel
(9443.09(84)).
• One of the listed hazardous wastes from the
petroleum industry is leaded tank bottoms. This mate-
rial is a listed hazardous waste only if it is generated
at a petroleum refinery. In other words, leaded tank
bottoms from bulk terminals, distribution points, etc.,
do not meet the terms of the listing definition and are
not hazardous wastes unless they exhibit a charac-
teristic (9444.03(81)].
• The listed hazardous wastes K001 and F006 are
sludges derived from the treatment of wastcwatcrs.
Thus, wastewatcr effluents from treatment processes
that remove the sludge arc not considered to he KOOl
or F006 wastes. For example, wasiewaier from a
flocculation process in which F006 sludge set lies out
is not a hazardous waste even if the water contains
some flocculated material that has not been removed.
If this wasfewatcr is subsequently treated in a filter,
the water does not become a "leachate" even (hough
it passes through sludge that has been (rapped by the
filter. The wastcwater emerging from the filter is still
a wastewaler and is not regulated under the F006
listing 19444.10(84)1.
• Spent ion exchange resin from treatment of electro-
plating wastewaters is considered to meet the criteria
for the F006 hazardous waste listing (9444.11(85)].
• Filter cartridges are used to recover spent perchloroethy-
lene (F002) from dry cleaning processes. EPA con-
siders the entire cartridge to he F002 waste. In other
words, the cartridge is not considered to be a con-

tainer. Therefore, the weight of the entire cartridge is
included when determining whether the small quan-
tity generator exclusion applies [9444.18(84)].
• Soil containing toluene is not considered to be a haz-
ardous waste unless the source of the spill is known to
be an F-, K-, or U-listcd waste (or unless the soil
otherwise exhibits a characteristic). The presence of
toluene in Appendix VIII has no bearing on this issue
(9445.01(85)]. If the source of the contamination is
unknown, the soil is not a hazardous waste (again, as-
suming that the soil does not exhibit a characteristic)
19441.01(84)].
REGULATORY AND REWORD INDEXES
In order to make the OSWER directives more usable,
we have prepared two indexes. The "CFR Reference
Index," which begins on page 4-IS. lists RCRA CFR sec-
tions and provides the reference numbers of OSWER
directives that explain or discuss those sections. The
"Keyword Index," which begins on page 4-22, lists key
subjects in alphabetical order and provides the reference
numbers of directives that discuss those subjects.
To use either of the indexes, locate the CFR sections
or keywords of interest in the appropriate index and
identify the reference numbers that correspond to those
sections or keywords. Then turn to the list of directives
beginning on page 4-3, and locate the reference numbers
in the left-hand column. As discussed above, the informa-
tion needed to order any of the directives is provided
along with the reference numbers.
PROBLEMS NOTED WITH SOME DIRECTIVES
While cross-referencing and keywording the OSWER
directives we came across a few problems that should be
noted:
• The readability of a few of the directives is marginal.
We have obtained the best copies available to us and
have not included in our listing any directives that are
completely unreadable. Nevertheless, some of the
copies are of poor quality.
• We believe our copies of the OSWER directives are
complete. However, some of the directives refer to at-
tachments that are not included.
• Many of the directives address more than one issue.
In a few cases, we determined that part of the infor-
mation contained in a directive is out-of-date while
the rest of the directive reflects current EPA policy
and therefore provides useful guidance. In such cases,
we have included the directive in our listing and it is
incumbent on the reader to separate the grain from
the chaff.
NEW REGULATORY UPDATE SERVICE MAKES
OSWER DIRECTIVES MORE ACCESSIBLE
Persons who frequently use the Code of Federal Regu-
lations will find that the CFR reference index on page
4-18 provides a way to identify pertinent OSWER direc-
tives. To make the referencing system more useful,
McCoy and Associates, Inc. now offers a loose-leaf regu-
latory update service that identifies pertinent OSWER
directives in the margin beside the text of the RCRA reg-
