(The Environmental Protection Agency (EPA) is proposing to amend its
regulations under the Resource Conservation and Recovery Act (RCRA) to add
121 chemicals to the lists of commercial chemical products that are
hazardous when discarded, §261.33(e) and 261.33(f). This action is in
response to a petition for rulemaking, filed by the State of Michigan, in
which Michigan petitioned for the addition of a total of 175 compounds to
§261.33(e) and 261.33(f)J3 Michigan has provided 11 volumes of background
material to support their claim that there is sufficient justification for
adding 175 additional compounds to lists 261.33(e) and 261.33(f). The
Michigan Department of Natural Resources states that mismanagement of these
materials after they are discarded, could pose a substantial threat to human
health and the environment.
The Agency has evaluated both data submitted in the State's petition
and other data available to the Agency in determining whether or not to
propose listing a chemical. The additional data includes pesticide regis-
tration and reregistration information, TSCA chemical review program data,
information published by the National Institute for Occupational Safety and
Health" in the Registry of Toxic Effects of Chemical Substances, as well as
studies and evaluations made by the International Agency for Research on
Cancer and the Agency's Office of Research and Development. As a result of
these evaluations, the Agency decided to propose listing for some of the 175
chemicals and to reject listing others. Background material provided by
Michigan as well as other data used by the Agency may be viewed at the RCRA
3001 Docket, Lower Level Basement, SE Mall Entrance, U.S. Environmental
Protection Agency, 401 M Street, SW, Washington, D.C.
Of the 121 chemicals the Environmental Protection Agency is adding to
the lists of commercial chemical products, 35 of these chemicals would be
classified as acutely hazardous wastes and added to 261.33(e), with the
remaining 86 classified as toxic hazardous wastes and added to 261.33(f).
In addition, 122 compounds would be classified as hazardous constituents and
added to Appendix VIII; thus, their presence in wastes could serve in the
future as a justification for listing hazardous waste streams.

A number of compounds which the State of Michigan petitioned to
include in 40 CFR 261.33(e) and 261.33(f) are not commercial chemical
products. If there is sufficient evidence to show that exposure to some of
these compounds pose concerns for harm to human health or the environment,
these compounds are included (if not already included) in Appendix VIII.
The remaining compounds addressed in the State's petition are commercial
chemical products, and so are potentially suitable for inclusion in
§261.33. For some of the compounds included in the Michigan petition,
sufficient evidence to show whether these wastes meet the criteria for
listing was not available. For compounds in which the Agency's evaluated
data differed from that cited in the petition, the Agency's data and
evaluations were used in determining whether or not to propose listing the
chemicals.
Additions to §261.33(e) must meet one or more of the criteria for
acutely hazardous wastes published in 40 CFR 261.11(a)(2) that is, the
compound has been found to be fatal to humans in low doses or, in the
absence of data on human toxicity, it has been shown in studies to have an
oral fat) LDgo of less than 50 milligrams per kilogram, an inhalation
(rat) LC50 of less than 2 milligrams per liter, or a dermal (rabbit)
LDSO of less than 200 milligrams per kilogram or is otherwise capable of
causing or significantly contributing to an increase in serious
irreversible, or incapacitating reversible, illness.
The Agency agrees that 28 of the 57 proposed additions to §261.33(e)
meet these criteria and is proposing to list these in §261.33(e). In
addition to this, the Agency is proposing to list seven other compounds
under §261.33(e) that Michigan originally proposed for addition to
§261.33(f).
Additions to §261.33(f) must meet the criteria for hazardous wastes
contained in §261.11(a)(3). For the purposes of identifying compounds to be
included on this list, the Agency considers the nature of the toxicity
presented by the compound and its concentration in the waste. The Agency
agrees that 81 of the 117 requested additions to §261.33(f) are valid and

adds five compounds to 261.33(f) that Michigan originally proposed for
addition to 261.33(e).
Detailed explanations citing the reasons that a specific compound is
or is not being added to 261.33(e), 261.33(f) or Appendix VIII are
summarized on individual 261.33/Appendix VIII Chemical Disposition Forms
(attached). The 261.33/Appendix VIII Chemical Disposition Forms provide
rationale in support of the Agency's decision to list or not list each
compound proposed by Michigan for addition to §261.33. In addition to this,
each Chemical Disposition Form summarizes regulatory action to date
concerning the proposed compound and provides the newly assigned Hazardous
Waste Number, the CAS number, the Ninth Collective Index name and the
references that the Agency's decision for that compound is based upon.
The 261.33/Appendix VIII Chemical Disposition Forms are designed so
that they may be used in maintaining a complete, current record of
regulatory action regarding 261.33 compounds. In order to locate
information regarding an individual compound, the user needs to know the CAS
number of the compound as forms are arranged by order of CAS number. The
EPA Chemical Activity Status Report (EPACASR), Fourth Edition, can be used
to access most CAS numbers (EPA 560/TIIS-84-001a). In addition, the
Michigan Petition Federal Register notice (49 CFR 49784) also indicates CAS
numbers.
At the top of the form (above the title, "261.33/Appendix VIII
Chemical Disposition Form") are boxes for the CAS number. Directly below
the title are designated spaces where the compound is identified by its
common name and by its Ninth Collective Index (9CI) name (Chemical
Abstracts). Directly below the 9CI name are four boxes that indicate the
current regulatory disposition of the compound. "Disposition" refers to the
last published USEPA Federal Register notice regarding the compound of
interest. The box "Proposed" is checked if EPA proposes the compound for
inclusion in (or deletion from) 261.33(e) or (f) or Appendix VIII. "Final"
is checked if a Final Rule adding the compound to (or deletion from)
261.33(e) or (f) or Appendix VIII has been published in the Federal
Register. "Change" is checked in cases in which it is the intent of EPA to

redesignate the regulatory disposition of a compound. For instance, it
would be necessary to change a 261.33(f) listing to a listing under
261.33(e) 1f new information were to provide conclusive evidence of a
compound's acute toxidty. "Other" 1s checked 1f the compound was suggested
for Inclusion by the State of Michigan (or some other commenter), and if EPA
1) 1s proposing to not regulate the compound, 2) has already regulated the
compound, 3) 1s still reviewing the compound, or 4) 1s proposing to regulate
the compound under a different designation than was suggested by Michigan.
If applicable, the assigned Hazardous Waste Number 1s provided in boxes
directly underneath the disposition of the compound. "Notes" appears below
the spaces for the Hazardous Waste Number and is used to provide
clarification for the "Disposition" section. "Notes" should be used for
those cases in which "Change" or "Other" are checked. More than one
Disposition box is checked when necessary.
To Illustrate the use of the rest of the form, 1t would be useful to
refer to an example. Nickel, CAS No. 7440-02-0, 1s an example of a compound
for which more than one Disposition box 1s checked and "Notes" are provided
for clarification. Here, the "Proposed", "Final" and "Other" boxes are
checked Indicating that 1) EPA has proposed nickel for addition to
261.33 (f), 2) a Final Rule already places nickel on Appendix VIII
and, 3) EPA proposes to regulate
nickel in a different manner than originally suggested by Michigan. The
proposed assigned Hazardous Waste No., U300, appears in the boxes designated
for 261.33(f) compounds and the box above VIII is checked indicating that
nickel 1s on Appendix VIII (the VIII box would also be checked if EPA were
proposing addition to Appendix VIII). "Notes" further explains the
regulatory disposition of nickel. Here, we learn that EPA is proposing that
nickel be added to 261.33(f) rather than 261.33(e), as Michigan originally
suggested. We also learn that nickel is already included on Appendix VIII.
"In Initial 5/19/80 Rule" (directly below "Notes"), is also checked
for nickel. This indicates that nickel was addressed in the initial May 19,
1980 Hazardous Waste Regulations. Underneath the Disposition section is a
chronological list of Federal Register notices that provides a RCRA
regulatory history of nickel. The first FR notice provides information

about the Agency's decision to include nickel on Appendix VIII on May 19,
1980. The second FR notice reports the Agency's decision to propose nickel
for addition to 261.33(f) in response to Michigan's petition.
