16. ABSTRACT
This report discusses various upgrades to the New Jersey NEDS which Engineering
Science conducted under several task orders. In the first three task orders, ES
was directed to identify specific data elements that were missing from the NEDS
file and which could not be found in the state's file. However, when such data was
available upgrades were to be made to NEDS. Three additional tasks were subsequently
conducted with the intent of updating the New Jersey NEDS file to a level suitable
for immediate use in modeling efforts associated with SIP development.
In order to accomplish this task within the time constraints, ES and EPA established
priorities for the types of data required. Information was collected for only those
sources existing in the NEDS file at that time.

CHAPTER I
INTRODUCTION
The State of New Jersey is one of the most industrialized areas in the
country and contains a substantial number of air pollution emission sources.
Over the last four years six separate contracts were issued to Engineering-
Science (ES) by the U. S. Environmental Protection Agency (EPA), Region II,
to make various types of data upgrades to portions of the New Jersey point
source emission inventory. The new data was added to the EPA National
Emission Data System (NEDS). Other contractors were also retained by EPA
to perform upgrades to specific counties in the state.
The following is a brief description of the six contracts performed by ES;

Initially the data was collected specifically for Region II's Air Facilities
Branch; however, the later efforts were conducted for the Office of Air Pro-
grams Branch. In the first three task orders, ES was directed to upgrade the
existing NEDS with information found in the New Jersey State office files, and
identify, where possible, missing sources (sources which should normally be
present at certain types of facilities but which were obviously absent from
the NEDS and in some instances from the state files). In addition, ES was also
requested to identify specific data elements missing from the NEDS file and
that were not available in the state file. The intent was for ES to conduct
a "first cut" of identifying facilities, sources, or specific elements missing
from the NEDS inventory which the Air Facility Branch needed in order to carry
out its enforcement program. The NEDS file was to be completed later with in-
formation collected through subsequent plant visits and/or Section 114 letters
originating from that Branch.
The remaining three ES contracts were conducted with the intent of suf-
ficiently updating the New Jersey NEDS file for immediate use in modeling
efforts associated with SIP development. In order to accomplish this task
within the time constraints, ES and EPA established priorities for the types
of data required. Information was collected for only those sources existing
in the NEDS file at that time. The data was gathered through Section 114
letters and available technical publications.
This report summarizes the work done in all of the activity areas outlined
above for the last three efforts which resulted in the 1976 New Jersey point
source emission inventory.
For the last three contracts listed above, ES was requested to obtain,
format, and incorporate into the NEDS, missing data for approximately 700
facilities in the 1975 inventory. Our work in these last efforts consisted
of:
o Identification of commonly occurring blank data fields.
o Preparation of Clean Air Act Section 114 letter questionnaires for
those facilities with emission sources in the file that were missing
significant data such as operating throughput, emissions, and stack
characterization.

o Synthesizing, whenever possible, missing source data using reference
documents.
o Obtaining Universal Transverse Mercator (UTM) coordinates.
o Performance of follow-up calls to facilities which submitted incomplete
Clean Air Act Section 113 and 114 responses.
o Formatting all the data obtained, using a data processing system
compatible with the EPA National Emission Data System.
o Incorporation into the 1975 New Jersey point source emission inventory
of all data obtained through this effort in addition to a series of
transactions made available by Region II from previous efforts.
ES used established EPA methodologies and procedures in the completion of
this project. The reference material included:
o Guide for Compiling a Comprehensive Emission Inventory, APTD-1135.
o National Air Data Branch (NADB) Emission Data System Training Manual.
o Compilation of Air Pollutant Emission Factors, AP-42.
Two hard copies of the inventory in Emission Inventory Subsystem/Permits
and Registration format (a NEDS compatible system), and a NEDS card image tape
have been forwarded to the Project Officer. The following chapters describe
the background, methodology used, the current status of the inventory, and a
summary of recommendations. A list of references and the appendices are included
in this report.

CHAPTER II
BACKGROUND
The New Jersey point source emission inventory, prior to ES involvement
in 1974, consisted of 444 facilities and 2,010 emission points, representing
2,456 processes with a 1970-71 year of record. The following discussion
describes the work performed by ES on the three initial contracts, which
resulted in the data base for subsequent efforts.

ES was retained by Region II to review and partially upgrade 100 facilities
in the emission inventory during the latter part of 1974, and 150 facilities
early in 1975. The work consisted of an upgrade of NEDS using data that were
available in the files of the New Jersey State Department of Environmental
Protection. Initially, the permit files at the New Jersey Central Field Office
were used to upgrade the inventory for facilities located in various central
New Jersey counties. The work performed by ES in these counties is summarized
in Table II-l. Later, at the request of the project officer, the work was
redirected with emphasis placed on the northern counties. Consequently the
effort was carried out from the Springfield Office. Other contractors were
requested to perform similar work in the southern counties. The work performed
in the northern counties is summarized in Table II-2. The two deliverable
items for this effort were:
o NEDS coding forms for the facilities upgraded.
o "Missing Data" forms - developed by ES specifically for this contract.
The Missing Data forms, illustrated in Figure II-l, identified information
not available in the state files. In addition, it identified missing possible
emission sources which would generally be found at certain facilities. The work
under these efforts was completed in mid-1975 at which time ES had reviewed
a total of 465 facilities. Additional information is presented in Appendices
A and B. Appendix B-l contains facilities upgraded under the Contract
68-02-1380 (T. 0. No. 18). Appendix B-2 contains facilities that could not
be coded due to insufficient data or because the files were not available.

Early in 1976, and as a result of EPA internal data processing problems
and delays, ES was retained to consolidate the data generated under previous
efforts with the existing New Jersey NEDS file. In addition, ES was to include
the work generated by other contractors and the EPA Regional Office during 1974
and 1975. The data, totaling approximately 7,000 NEDS transactions, were
made available to ES on computer cards. These transactions were incorporated
into the existing NEDS file using the EPA Emission Inventory Subsystem/Permits
and Registrations (EIS/P&R). ES used the OSI computer facility at Rockville, '
Maryland. This effort was completed during the spring of 1976 and resulted
in an interim 1975 New Jersey point source emission inventory. The final
project report is presented in Appendix C.
A review of the inventory by EPA and ES engineers revealed that the
transactions processed did not include all the work done by ES and other
contractors under the initial effort. The missing transactions, totaling
approximately 14,000 computer cards, were located in the EPA regional office
files.
WORK REQUIRED
In the spring of 1976, two major problems were identified in the 1975
interim New Jersey point source emission inventory. These were:
o Approximately 14,000 transactions, representative, on the average, of
2,.000 points, were not in the file.
o The Regional Office had not obtained all of the missing information
identified by ES on the Missing Data Forms.
As a result, ES was retained under Contracts 68-02-1380 T. 0. #11 and #18 and
WC-7-0205-A (work summarized in this report) to:
o Update the 1975 point source inventory by incorporating the 14,000
transactions (not previously keypunched) as well as the data on NEDS
forms for 76 facilities into the existing EIS/PNR file.
o Obtain, format, and incorporate missing data for 700 sources in
the 1975 inventory.

CHAPTER III
METHODOLOGY
The most recent update to the New Jersey point source emission inventory,
(Contracts 68-02-1380 T. 0. Nos. 11 and 18, and WC-7-0205-A), involved the
gathering, formating, and processing of missing data items for sources in the
1975 version of the inventory. This chapter summarizes the work performed by
ES in these three activity areas. Established EPA methodologies and procedures
were used throughout the project. Of paramount importance in completing the
work were the referenced documents used to establish typical values for some of
the missing data elements.
IDENTIFICATION OF MISSING DATA
At the initiation of the project, ES made a cursory evaluation of the 1975
inventory and found that essential modeling and enforcement data for a substan-
tial number of facilities were missing. As indicated earlier the Regional
Office had not obtained all of the missing data and where the data was avail-
able it had not been keypunched and incorporated into the NEDS file. In order
to select an expeditious method for securing the various types of missing data
elements, the missing information was classified as critical or noncritical.
Critical data elements refer to the information which was required to conduct
air quality dispersion analyses. These data elements were obtained through
Section 114 of the Clean Air Act. Noncritical data refers to information that
was not required for dispersion modeling but which was needed to upgrade the
NEDS file. The noncritical data were obtained from the reference documents.
This effort did not include the addition of new sources.
The following data elements were identified as critical items:
o Process throughput
o Control equipment efficiency
o Stack parameters
o Fuel characterization

Sources emitting 50 tons or more per year of any criteria pollutant and missing
any one of these data items, were primary candidates for a Section 114 letter
questionnaire. Sources with actual emissions of less than 50 tons per year of
any criteria pollutant and missing the process throughput qualified for a letter
questionnaire, if this data element could not be obtained from the maximum
hourly rate or by using published emission factors. Sources missing pollutant
emission rates and related to a complex industrial process for which emission
factors did not exist were also sent a questionnaire.
The term noncritical data identified fields, such as seasonal operating
schedule, standard industrial classification (SIC) codes, UTM coordinates,
allowable emissions, and all of the remaining fields found in the standard
NEDS load sheet that were not identified as critical data elements.
LETTER QUESTIONNAIRES
The need for letter questionnaires under Section 114 of the Clean Air
Act had been quantified as a result of the review described above. A sample
of the questionnaire package is presented in Appendix D. For facilities where
a dearth of information existed, an OMB Form 158-R75, "EPA Air Pollutant
Emission Report", was sent. For sources missing only a few data elements, a
short individualized form developed by ES was used. The short form, illustrated
in Figure III-l, was designed to expedite the identification of missing data,
questionnaire response time, and data coding and processing. A team of four
engineers reviewed all of the 4900 emission points (about 850 facilities) in
the 1975 inventory. This resulted in the identification of missing critical
data, plant contact and address. These questionnaire forms were channeled to
a staff for clarification of incomplete addresses and preparation of cover
letters and other questionnaire enclosures. The references used for locating

PROCESS OPERATING THROUGHPUT
The process annual and hourly maximum design rates should represent 1975 operating
conditions. Enter the units applicable, such as tons, gallons or million cubic feet.
FUEL USAGE
• Type - Identify type of fuel (distillate, residual, bituminous, anthracite, natural
gas, etc.)
Process gas used as auxiliary fuel should also be noted.
Anrwl and Hourly Operating Rates - This should represent the annual and hourly maximum
fuel usage rates during calendar year 1975.
%S - Sulfur content of fuel.
ZA - Ash content of fuel.
Heating Value - Heat content of fuel(s) used.
Space Heating - Percent of the heat generated which is used for space heating.
PLANT LOCATION
Indicate- exact plant location giving the distance from nearest intersection, e.g.-,
located on Rt. 123, 2-1/2 miles west of intersection if 1-95 and Rt. 1.

A total of 387 letters were sent via certified mail by ES under EPA letterhead
and signature. A list of these facilities is presented in Appendix E.
During the latter part of May and in the early part of June, ES engineers
answered an average of 30 calls per day from facilities receiving the ques-
tionnaires.
There were 37 questionnaires returned to ES incomplete and 54 facilities
which did not respond to the letter request. As requested by the project
officer, ES made follow-up calls during the early part of 1977 to all the
facilities with incomplete responses in order to obtain additional informa-
tion and finalize their updates. Also, at that time, 22 of the pending
responses were received and coded by ES.
OTHER DATA
ES used the documents listed in the reference section of this report to
generate missing noncritical data for all of the emission sources in the 1975
inventory for which a letter request was not initiated. The project officer
concurred with ES that this would be an expeditious and reasonably accurate
procedure to generate the data. Forms similar to the one appearing in Figure
III-2 were used to document the data obtained using this methodology. The
following brief discussion summarizes common procedures used.
o Stack Parameters - The NTIS publication, "Exhaust Gases from Combustion
and Industrial Processes", was used to determine missing stack parameters.
The publication summarizes typical stack parameters and includes
equations to determine exhaust flow rates based on process throughput
for a variety of industrial processes.
o Throughputs - Maximum hourly process throughputs were determined from
the yearly throughput data assuming 90 percent normal operation and
vice versa.
o UTM Coordinates - UTM coordinates were obtained from county and U.S.
Geological Survey Maps. -Approximately 450 coordinates were obtained.

The questionnaires were used to.request, as needed, additional informa-
tion on plant locations. In some isolated instances and due to the
lack of adequate location description, a few small sources were
assigned coordinates corresponding to the centroid of the township
where the facility was located. These cases were identified in the
documentation forms. All sources within a facility were assigned
the same set of coordinates.
o Allowable Emissions - These were determined in accordance with the
regulations published by the New Jersey Department of Environmental
Protection. The following two codes were used in the allowable field
to identify maximum allowable sulfur content for combustion sources:
Code Representing
'22222' - Distillate oil sulfur content of
0.2% by weight.
- Anthracite and Bituminous coal sulfur
content of 0.2% by weight (dry basis).
'33333' - Residual oil sulfur content of 0.3%
by weight.
Most of the data in the inventory were for 1974-1975 operating condi-
tions, thus the regulations used to determine allowable emissions were
those in effect at the time. No hydrocarbon regulations were in effect
at the time.
o Compliance Status - Compliance status was determined only for those
facilities in the inventory which had that data field blank. A list
has been made available to EPA under separate cover with the com-
pliance status for all the sources in the inventory. The list was gener-
ated by comparing actual and allowable emissions. Whenever possible, the
compliance status appearing in the CDS file was used. The status of
compliance data information was not incorporated into the inventory
for the following reasons:

- The compliance status would not be indicative of 1976-77
conditions but rather representative of historical conditions.
- Allowable emission, determined from synthesized parameters
such as exhaust flow rate, should not be used to assess compliance
status.
o Miscellaneous Fields
- IFF Process Code - The code '99' was used to identify processes
for which an IPP process identification code has not been defined.
- Storage Tank Capacity - Tank capacity was entered in the annual
process rate field for SCC codes related to breathing losses
from petroleum product storage.
COMPLIANCE ORDERS
The EPA issued orders under Section 113 of the Clean Air Act to all
the facilities that did not respond to the questionnaire. A total of 92
orders were prepared and sent by EPA Retion II. A list of the recipients
is presented in Appendix F.
DATA PROCESSING
The data collected and developed by ES was formatted and incorporated

UPDATED INVENTORY
FILE CONTENT
The New Jersey 1976 point source emission inventory presently consists
of 668 facilities (industrial plants), representing 4229 emission sources
(stacks) and approximately 5123 industrial processes. These figures represent
a file content improvement of 50 percent with regard to facilities and 100 per-
cent for both emission sources and industrial processes. Most of the data
currently in the inventory are representative of 1974-1975 plant operations.
Statewide emissions for each criteria pollutant in tons per year are presented
in Table IV-1. A summary by county of facility name with the respective NEDS
plant identification number is presented in Appendix G.

FEDERAL FACILITIES
During the summer of 1976, and as per the request of the project officer,
all federal facilities were removed from the 1975 inventory. In February 1977,
the Air Facilities Branch made available to ES the NEDS data in keypunched
card form for nine federal facilities and requested their inclusion in the 1976
version of the inventory. The'names of these facilities are presented in
Basis for comparison was obtained from Reference 8.

Table IV-2. The NEDS AP-7 cards with additional comments could not be pro-
cessed since including them in the inventory required a special programming
effort. A list of these cards is presented in Appendix H.
FACILITIES CEASED OPERATIONS
As per the request of the project officer, all the facilities and emission
sources in the 1975 inventory which had ceased operations were removed from
the inventory. This occurred when (a) a source was defined as such in the
files or (b) information from the questionnaires indicated that the operation
had terminated.
INCOMPLETED WORK UNDER TASK ORDERS 11 AND 18
Several action items remain from Task Order 11 and 18 (Contract 68-02-1380)
and require follow-up work. These activities are primarily associated with 114
or 113 responses that, for a variety of reasons, were outstanding at the con-
clusion of the ES effort. The following paragraphs briefly describe the actions
remaining.
o Pending Responses - There were 32 facilities for which responses
on the data requested under Sections 113 and 114 of the Clean Air Act
were not received at ES. A list of these facilities is presented in
Table IV-3.
o Facilities Not Locatable - There were 19 facilities for which the
letter questionnaires under Section 114 were returned by the postal
service. Address verification using the 1975 New Jersey Industrial
Directory and the EPA CDS file did not result in better mailing
addresses. In June 1976, and as per the request of the project
officer, the names of these facilities were made available for his
follow-up. A list of these facilities is presented in Table IV-3.
o Incomplete Responses - The inventory for 13 facilities could not
be completed. These plants were part of a group of 37 which
originally submitted incomplete questionnaires. The 13 plants are
presented in Table IV-3. Some of the facilities were not responsive

to the follow-up phone calls made by ES. Other sources seemed coopera-
tive, however, they did not have the resources to collect the data.
o Letters Required - Once the preparation of the letter questionnaires
under Section 114 had been finalized and work was initiated on other
subtasks, ES identified five facilities which qualified for a
letter questionnaire. As a result of the limited period of perform-
ance and turn-around time, the only feasible follow-up action was to
generate, whenever possible, missing noncritical data items from
reference documents.
IMPROVEMENTS TO THE PRESENT EMISSION INVENTORY
There are several activity areas which have received limited attention
but could substantially enhance the present emission inventory. These activi-
ties are as follows:
o Verification File - A statewide facility verification file identi-
fying and prioritizing facilities with potential pollution sources
and not in NEDS, should be prepared. Priority can be established
based on: plant location in nonattainment areas; areas with large
industrial growth projections; or by pollutant. Work should be
directed toward the inclusion of these facilities in the NEDS file.
o Additional Sources - The missing data forms prepared by ES under
previous efforts addressed the possible existence of other emission
sources, (frequently combustion sources), for the facilities up-
dated and not found in the state files. In some cases these were
tentatively identified as potential sources. In other cases it
was impossible to estimate the types and number of sources that
could be present at a specific facility. ES also identified
those emission sources in NEDS which could not be updated since
they could not be identified in the state file. Work should be
directed toward the inclusion of these missing point sources in
NEDS.
o Facilities in the Original NEDS File - There are a substantial number
of faciltiies in the 1976 version of the inventory from the original
NEDS with data representative of plant operations for 1970 through

1973. Updates were never scheduled for these facilities under
any of the previous efforts. The latest update performed by ES
to the inventory involved only the generation of missing data
items. Work should be directed toward the update of these facilities.
o Data Quality Verification - An effort geared toward data quality
verification should be initiated and maintained by the regional
office. This activity area should pursue the validation of stack,
process throughput, and emission data as reported by the facilities
based on a series of descriminators.

CHAPTER V
SUMMARY AND RECOMMENDATIONS
ES was retained by the U.S. EPA through six contractual efforts during
a four-year period to perform different types of improvements to the
New Jersey point source emission inventory.
The inventory currently has 668 facilities, comprising 4,229 emission
points and approximately 5,123 industrial processes. An improvement
of 50 percent with regard to facilities and of 100 percent for both
emission sources and industrial processes was achieved over the 1970
inventory.
Established EPA methodologies and guidelines were used in the data
gathering and processing phases of the study.
The majority of the facilities in the inventory have emission and process
data representative of 1974-1975 plant operations.
ES could not complete the update for 69 facilities. Forty-five of these
did not comply with the letter questionnaire request and/or the follow-up
phone calls; the questionnaires for 19 facilities were returned unclaimed;
and five facilities required a letter questionnaire.
In order for past efforts to be fruitful, it is recommended that the
present content of the inventory be updated at regular intervals and
followed by a data quality verification effort.
It is recommended that improvements be made in the following activity
areas:
o Development of a verification file identifying and prioritizing
facilities not in the NEDS file.
o Inclusion in the inventory of those point sources which are not in
the state files as a result of not undergoing modifications since
the adoption of local regulations.
o Updating those facilities in the original inventory for which a
review was not scheduled by EPA under any of the previous contracts.

INTRODUCTION
Engineering-Science, Inc. was retained by the U.S. Environmental Protection
Agency at Region II to update the New Jersey point source master file with
approximately seven thousand existing NEDS transactions. These transactions
comprised updates to point sources in the file as well as entry of new facili-
ties . Due to several software "and hardware problems EPA found it difficult to
make these updates through their facility at Research Triangle Park. This level
of effort resulted in an updated version of the New Jersey point source master
file.
DEVELOPMENT OF PROJECT
A copy of the current New Jersey NEDS file was used to generate a base
year P&R point source master file. Obvious keypunch errors on the NEDS trans-
actions made available by EPA were corrected using the text editing facilities
at ES. These transactions were later sorted and converted to P&R transactions
and incorporated into the base year P&R master file. As a result of this
update run a series of the 7,000 transactions were rejected. The following
are examplary of the problems which caused some of the transactions to be
rejected:
o Duplicate records - duplicate occurrence of point or plant I.D.
o Incomplete or incorrect action and identifier fields - these refer
to the action codes (ADD, DELETE, CHANGE) and the plant key (County,
AQCR, Plant and Point I.D.) respectively.
o Incomplete records - points without a complete set of cards.
At the time, ES proceeded to make the necessary corrections using as
reference the NEDS load sheets. As a result of this exercise, ES concluded
that the majority of the problems were due to key punch errors. Typical
corrections included completion of fields for which the data had not been key-
punched as well as correction of action codes that had been processed erroneously.
Also, clarification of duplicate records.

Once the rejected transactions were updated they were used to generate
subsequent file updates. The procedure outlined above was followed until all
the transactions were processed.
In addition, ES coded and entered into the master file several 114 responses
as made available by the project officer.
WORK ACHIEVED
The resulting updated point source master file for New Jersey was made
available to EPA during the earlier part of February 1976. The file consists
of the base year NEDS updated with the 7,000 transactions made available
earlier by EPA Region II. The file comprises approximately four-hundred
facilities which are inclusive of almost 2,500 emission points.
FINANCIAL SUMMARY
The level of effort required to complete this task order was 256 manhours
at an approximate total cost of $5,732.71. The following breakdown of the cost
is offered:

Total ODC $ 968.79
Table 1 summarizes, on a weekly basis, the manpower required to complete
this task.

inventory for the State of New Jersey which will be used to assess air
quality levels. Some data has already been collected on your plant from

ATTACHMENT I
FEDERAL ENFORCEMENT
"SEC. 113. (a) (1) Whenever, on the basis of any information
available to him, ithe Administrator finds that any person is in
violation of any '"requirement of an applicable implementation
plan, the Administrator shall notify the person .in violation of the
plan and the State in which the plan applies of such finding. If
such violation extends beyond the 30th day after the date of the
Administrator's notification, the Administrator may issue an
order requiring suchjperson to comply with the requirements of
such plan or he may bring a civil action in accordance with
subsection (b).
"(2) Whenever, on the basis of information available to him,
the Administrator finds that violations of an applicable imple-
mentation plan are so widespread that such violations appear, to
result from a failure of the State in which the plan applies to
enforce the plan effectively, he shall so notify the State. If the
Administrator finds such failure extends beyond the thirtieth day
after such notice, he shall give public notice of such finding, (A)dur-
ing the period beginning with such public notice and ending when
such State satisfies the Administrator that it will enforce such
plan (hereafter referred to in this section as 'period of Federally
assumed enforcement') (B) the Administrator may enforce any
requirement of such plan with respect to any person—
" (A) by issuing an order to comply with such requirement,
or
"(B) by bringing a civil action under subsection (b).
"(3) Whenever, on the basis of any information available to
him, the Administrator finds that any person is in violation of
section lll(e) (relating to new source performance standards) or
112(c) (relating to standards for hazardous emissions), or is in
violation of any requirement of section 114 (relating to inspec-
tions, etc.), he may issue an order requiring such person to comply
with such section or requirement, or lie may bring a civil action
in accordance with-subsection (b).
"(4) An order issued under this subsection (other than an
order z-elating to a violation of section 112) shall not take effect
until the person to whom it is issued has had an opportunity to
confer with the Administrator concerning the alleged violation. A
copy of any order issued under this subsection shall be sent to the
State air pollution control agency of any State in which the viola-
tion occurs. Any order issued under this subsection shall state
with reasonable specificity the nature of the violation, specify a
time for compliance which the Administrator determines is rea-
sonable, taking into account the seriousness of the violation and
any good faith efforts to comply with applicable requirements. In
any case in which an order under this subsection (or notice to a

violator under paragraph (1)) is issued to a corporation, a copy
of such order (or notice) shall be issued to appropriate corporate
officers.
"(b) The Administrator may commence a civil action for ap-
propriate relief, including a permanent or temporary injunction,
whenever any person—
"(1) violates or fails or refuses to comply with any order
issued under subsection (a); or
"(2) violates any requirement of an applicable implement-
ation plan during any period of Federally assumed enforce-
ment more than 30 days after having been notified by the
Administrator under subsection (a) (1) of a finding that
such person is violating such requirement; or
"(3) violates section lll(e) or 112 (c); or
"(4) fails or refuses to comply with any requirement of
section 114.
Any action under this subsection may be brought in the district
court of the United States for the district in which the defendant
is located or resides or is doing business, and such court shall have
jurisdiction to restrain such violation and to require compliance.
Notice of the commencement of such action shall be given to the
appropriate State air pollution control agency.
"(c) (1) Any person who knowingly—
" (A) violates any requirement of an applicable implement-
ation plan (i) during any period of Federally assumed enforce-
ment, more than 30 days after having been notified by the
Administrator under subsection (a) (1) that such person is
violating such requirement, or
"(B) violates or fails or refuses to comply with any order
issued by the Administrator under subsection (a), or
"(C) violates section lll(e) or section .112(c)
shall be punished by a fine of not more than $25,000 per day of
violation, or by imprisonment for not more than one year, or by
both. If the conviction is for a violation committed after the first
conviction of such person under this paragraph, punishment shall
be by a fine of not more than $50,000 per day of violation^ or by
imprisonment for not more than two years, or by both.
"(2) Any person who knowingly makes any false statement,
representation, or certification in any application, record, report,
plan, or other document filed or required to be maintained under
this Act or who falsifies, tampers with, or knowingly renders in-
accurate any monitoring device or method required to be main-
tained under this Act, shall upon conviction, be punished by a fine
of not more than $10,000, or by imprisonment for not more than
six months, or by both.
