CONTROL 1982
EPA approved 545 grants, totaling $112 million in August.  Total
grant dollars awarded through August 31, 1982 decreased $1.9
billion when compared to the same period of FY 1981.  ($951
million compared to $2.8 billion.)   (p. 9.)

As of August 31, 1982, Headquarters awarded 773 grants totaling
$103.0 million dollars.  Research accounted for 68%  ($69.7 million)
of these funds,  (p. 3.)
•Since April 1980, EPA awarded State Management Assistance grants
totaling $303 million to 45 states and one territory  (Puerto
Rico ).  These grants provide funds for states to employ staff
to administer segments of the WWT Construction Grants program
delegated to them by EPA.  (p. 22.)
In accordance with Section 402 (b) of the Clean Water Act, 35
states administer delegated permit programs limiting discharges
into navigable waters within each state jurisdiction,   (p. 23.)

A synopsis of hazardous waste - responsibilities, actions,
enforcement and cleanup are discussed in this issue of  "Activities
of the Grants Assistance Programs",  (p. 2.)

Feature  of  The  Month
Hazardous  Waste Control:  1982
 EPA'a Office of Solid Waste and  Emergency Response has In operation « comprehensive program for protecting America
 from the hazardous-waste by-products  of  Its  vast Industrial complex.

 Present-day generators and handlers of hazardous waste are under strict regulation.  Abandoned repositories for
 hazardous waste are ranked and those  deserving priority attention are subjected to cleanup.

 With close cooperation from the  States,  the  American people can be assured that the nationwide hazardous-waste
 threat is no longer Increasing,  but expected to diminish in the future.

 Chemical companies, metals processors, oil refiners and processors, and other generators of hazardous waste are
 operated and monitored under Federal  and State laws.  Transporters must report sources and destinations of the
 hazardous waste.  Storage facilities  and treatment plants must meet and comply with Federal and States safety
 standards.  Land disposal facilities, existing and new, must meet rigid requirements to prevent hazardous waste
 leakage Into ground water, surface water and air.

 Hazardous waste comprise less than one percent of all the solid waste generated in this country.   Disposal of
 more than 70 percent of this hazardous waste is handled on the Industrial site where it is produced.   The bulk
 of these hazardous biproducts is disposed of responsibly by the generators and other handlers.  In the past,
 hazardous waste dangers were less understood, and many unsafe deposits were made particularly in  the  big
 industrial areas.

 EPA's Office of Solid'Waste and  Emergency Response, (OSWER) is responsible for the public environmental
 protection from hazardous waste  threats, both past and present.  OSWER is organized into three divisions.  The
 Office of Solid Waste administers the Resource Conservation and Recovery Act (RCRA).  This involves the generating
 and the handling of Solid Waste. The Office of Emergency and Remedial Response administers the Comprehensive
 Environmental Response, Compensation  and Liability Act, nicknamed Superfund.  Its responsibility  is emergency
 spills response and cleanup of uncontrolled  or abandoned sites.  And, the responsibility of the Office of Waste
 Programs Enforcement is to persuade parties  responsible for abandoned hazardous waste accumulations
 to finance the cleanup.

                                                       RCRA
 56,000 generating plants and 13,000 transporters are in compliance with hazardous waste regulations.   For 10,000
 facilities that treat, store and dispose of  hazardous waste, regulations for operating permits were promulgated
 in January 1981 and, most recently, on July  13, 1982.  Thus, the core of the program for protection against new
 waste is completed.  The cradle-to-grave control of hazardous waste is defined and will be administered jointly
 by the States and EFA.

 In mid-January 1983, EPA will issue land-disposal permits. Issuance will be based on the strict regulations for
 new and existing facilities.  Then EPA will  have authority to issue permits to all facilities for the treatment,
 storage and disposal of hazardous waste.

 The EPA/State shared regulatory  load has shown progress.   Recently, 32 States were authorized to  administer
 their own programs for hazardous waste generators and handlers.  Arkansas, Texas, North Carolina  and  Georgia
 have Phase II authorization, qualifying them for permitting hazardous-waste incinerators and storage  facilities,
 including containers, tanks, surface impoundments and waste piles.

 EPA projects that 45 States will achieve either interim or final authorization for cradle-to-grave regulations
 of hazardous waste by October 1,  1983, and 1,700 permits  will be Issued by October 1,  1984.

                                                     SDPERFUND

 Lead responsibility for administering Superfund cleanup and for preparing the National Contingency Plan was
 given to EPA on August 14, 1981. The first  $68 million Superfund appropriation was received the  previous month.
 October 1981, the first interim  priority list of 115 hazardous waste sites eligible for cleanup was announced.
 March 12, 1982, the National Contingency Plan was proposed and on July 16, 1982, EPA promulgated  the  final plan.
 Also, July 1982 EPA initiated cleanup on 99  sites, and added 45 more sites, based on the States'  advice.  As  of
 August 1982, Headquarters had awarded $25.9  million in grants and Cooperative Agreements for remedial actions.

                                                    ENFORCEMENT

 Superfund Is intended for use only when  responsible parties cannot be identified or are unwilling or  unable to
 pay for cleanup at the sites where their hazardous waste was deposited.

 Office of Waste Programs Enforcement  is  to seek out responsible parties to undertake their fair share of cleanup
 costs.  This is facilitated by provisions in the law for possible collection of triple damages from responsible
 parties if Superfund support is  provided for prompt cleanup and the courts confirm the responsibility of reluctant
 parties.

 Enforcement actions have generated some $82  million in private support for cleanup at 22 imminent hazard sites.
 That is about the same amount allocated by Superfund for both emergency removal and remedial actions
 so far.
