INTERAGENCY AGREEMENT (TAG) GUIDELINE ON USE OF
NATIONAL COMPUTER CENTER (NCC) LICENSED SOFTWARE
1. PURPOSE. This policy guideline establishes the principles
governing the use of commercially licensed software on the
Agencywide computer systems which include the IBM 30xx
mainframe, the IBM 43xx logical mainframe and VAX Cluster
at the National Computing Center and other major data
processing sites in the Agency. It is intended to be used
as an integral part of EPA Interagency Agreements (lAGs)
-% to define the limits of licensed software usage.

2. SCOPE AND APPLICABILITY. This policy guideline is
applicable to all EPA program and Regional offices which
negotiate lAGs with provisions for the use of Agencywide
computer systems.

3. BACKGROUND.
a. The EPA's National Computer Center (NCC) at,-Research
Triangle Park, and other data processing sites
provide computing resources to support the Agency's
various environmental program computer systems.
b. However, within the monetary limits and conditions of
particular lAGs, access to the general purpose
computer systems and licensed software is limited.
c. To prevent problems while operating within these
limits, vendors providing software to the Agencywide
computer systems were contacted and asked to clarify
authorized use of their software. This guideline
provides formal rules which govern limitations on the
use of commercially licensed software. They are to
be observed by EPA managers when they negotiate new
lAGs or renew or amend current lAGs.

5. RESPONSIBILITIES.
a. Office of Information Resource Management (OIRM)
is responsible for providing IAG guidance on the
use of EPA licensed software to Assistant
Administrators, Associate Administrators and
Regional Administrators.
b. The National Data Processing Division (NDPD) is
responsible for providing technical guidance
s^« regarding IAG issues dealing with commercially
. licensed software on the EPA computer systems at NCC
*:. and other major distributed data processing sites .
c. Associate Administrators, Assistant Administrators
and Regional Administrators are responsible for
ensuring that their respective organizations comply
with the requirements of this policy.
d. The Grants Administration Division is responsible
for issuing policies and procedures regarding the
execution of lAGs.
6. TAG LANGUAGE.
a. Section 7, "Conditions and Limitations on the Use of
Commercially Licensed Software on the EPA's Computer
Systems," of this Policy Guideline should be
incorporated as an attachment, into all new and
current lAGs.
b. All IAG holders should agree to and sign the clause
described in section 7e, "Computer Systems and
Software Usage Agreement."
c. Unless prohibited by State law or Federal regulation,
all IAG holders should agree to and sign section 7f,
"Indemnification Clause." In cases where this clause
conflicts with laws or regulations, it should be
severed from the IAG attachment.

7. CONDITIONS AND LIMITATIONS ON THE USE OF COMMERCIALLY
LICENSED SOFTWARE ON THE EPA'S COMPUTER SYSTEMS.
The language in this section is to be incorporated into
all lAGs which involve the use of EPA's computing
facilities.
a. Access to All Licensed Software.
\\ Unlimited use of all approved licensed software
(except Mark IV) on the general purpose computer
v-- systems by authorized non-EPA users shall be provided
to the following environmental program activities and
users: . .
(1) Entering and validating data for EPA's databases
either directly through transaction files or
sub-databases.

(2) Retrieving, analyzing, manipulating, reporting
and presenting the data maintained in these
databases, sub-databases or transaction files.
(3) Using EPA's application software including
modeling and simulation programs.
(4) Maintaining sub-databases, transaction files or
user written programs in support of the above
functions.
b. Non-EPA Access to Licensed Software.
(1) Federal agencies are authorized access to the
Agencywide computer systems, databases,
application software and licensed in the manner
described above for joint projects with EPA or
its environmental programmatic needs.
(2) Environmental agencies/organizations of state
and local governments are authorized access to
the Agencywide computer systems applications
software and licensed software in the manner
described above.

i. For the purpose of implementation of
environmental programs delegated by EPA
through grants and similar funding
vehicle.
ii. For performance of joint projects between
EPA and the environmental agencies/organ-
izations of state and local governments.
•v (3) University organizations are authorized access
'\ to EPA's computer systems, databases,
^ application programs and licensed software for
^ environmental research activity or joint
projects between EPA and the universities.
c. Prohibitions.
(1) Any violations of the licenses or contracts for
commercial software (e.g. software duplication,
modification, disclosure) is prohibited.
(2) Any application programs or licensed software
used for purposes other than the above functions
is not authorized by EPA and is expressly
prohibited unless authorized in section d
. below.
(3) The use of the MARK IV licensed software package
for any purpose is prohibited.
d. Limited Access to Licensed Software.
Non-EPA users authorized to use the general purpose
computer systems for purposes other than those
described in section a. above shall be allowed use of
all licensed software with the exception of the
following software products:

e. Computer Systems and Software Usage Agreement.
This clause addresses the obligations IAG users must
fulfill. It must be completed by the organization
requesting the Agreement with EPA.
The (IAG Holder) agrees to
abide by the terms and conditions of usage of EPA's
computer systems, databases, application programs and
-v licensed software as stated above. Furthermore, the
S^ (TAG Holder) understands that it is
^ their responsibility to request and uphold all of
"• EPA's computing policies and to develop their own
internal policies and procedures to prevent any
unauthorized use.
f. Indemnification Clause.
This clause addresses the indemnification of the
Environmental Protection Agency in the even of
unauthorized use of the Agencywide computer systems,
databases, applications, and licensed software..
Any legal action or damages resulting from
unauthorized use will be the responsibility of
(TAG Holder) ,_ Through this agreement,
(IAG Holder) shall indemnify and hold
harmless EPA from any damages/awards resulting from
the unauthorized use.
