&EM Umted States Office of Errergency & Environmental Protection Remedial Response A9encv Washington, DC 20460 HW-10.8 July 1989 BACKGROUND INFORMATION: NATIONAL PRIORITIES LIST, PROPOSED UPDATE |9 The U.S. Environmental Protection Agency (EPA) is proposing 52 Federal facility sites as Update #9 to the National Priorities List (NPL) and also is proposing to expand one final Federal facility site. Of the States and territories, 26 are proposing sites. California leads with 10 new proposed sites. This brings the number of proposed sites to 335, including 74 in the Federal facility section. Final sites now total 889, including 41 in the Federal facility section. Final and proposed sites total 1,224 . New Jersey has the largest number of final and proposed sites (109), followed by California (98) and Pennsylvania (96) . The proposed sites are subject to public comment for 60 days following publication of the proposal in the Federal Register in mid-July. Based on these comments and further review by EPA, those sites still meeting the listing requirements will be placed on the final NPL. The NPL identifies abandoned or uncontrolled hazardous waste sites that warrant further investigation to determine if long-term "remedial action" is necessary. Sites on the NPL are eligible for such action under the Compre- hensive Environmental Response, Compensation, and Liability Act (CERCLA), enacted on December 11, 1980, as amended by the Superfund Amendments and Reauthorization Act (SARA), enacted on October 17, 1986. SARA authorizes a "Hazardous Substances Superfund" totaling $8.5 billion over 5 years to pay costs for overseeing work by those responsible for cleaning up waste sites, and to pay costs not assumed by responsible parties. EPA has the primary responsibility for managing cleanup and enforcement activities under Superfund. Section 120(a) of SARA requires that Federal facilities be subject to and comply with CERCLA in the same manner as any nongovernmental entity. CERCLA Section lll(e)(3), however, generally prohibits use of Superfund dollars for remedial actions at Federally-owned facilities. This document provides background information on Proposed Update #9 and the following lists: o The new sites being proposed for the NPL arranged alphabetically by State. o The distribution of all sites by States arranged by the number of new proposed sites. Deletion of Final Sites At the time of the NPL rulemaking in May 1989, 890 sites were on the final NPL. Since then, one has been deleted because EPA and the State determined that all appropriate response has been taken, making a total of 889 final sites. The site is: ------- o Voortiran Farm, Upper Saucon Township, PA, deleted May 31, 1989 (54 FR 23212) Proposed Sites At the time of the NPL rulemaking in May 1989, 283 sites were in proposed status. They can be grouped in this way. All proposed sites will be considered for listing in future final rules. This proposal brings the number of proposed sites to 335, 74 of them in the Federal section. RCRA-Related Sites On June 10, 1986 (51 FR 21054), EPA announced components of a policy for the listing or the deferral from listing on the NPL of several categories of non-Federal sites subject to the Resource Conservation and Recovery Act (RCRA) Subtitle C corrective action authorities. The policy was intended to reflect RCRA's broadened corrective action authorities as a result of the Hazardous and Solid Waste Amendments of 1984. In announcing the RCRA policy, the Agency reserved for a later date the question of whether this or another policy would be applied to Federal facility sites that included one or more RCRA hazardous waste management units, and thus are subject to RCRA Subtitle C corrective action authorities. On March 13, 1989 (54 FR 10520), EPA announced it would place on the NPL those sites located on Federally-owned or -operated facilities that meet the NPL eligibility requirements—e.g., Hazard Ranking System (HRS) scores of 28.50 or greater—even if the Federal facility also is subject to the corrective action authorities of RCRA Subtitle C. Cleanup, if appropriate, could then proceed at those sites under either CERCLA or RCRA. EPA believes that listing Federal facility sites with or without RCRA- regulated hazardous waste management units is consistent with the intent of SARA Section 120 and will serve the purposes originally intended by the NPL — that is, to advise the public of the status of Federal government cleanup efforts. In addition, listing will help other Federal agencies set priorities and focus cleanup efforts on those sites presenting the most serious problems. -2- ------- Special -Study Waste Sites Section 105 (g) of CERCLA, as attended by SARA, requires additional information before proposing sites with "special study wastes," as defined under RCRA Section 3001(b)(2) [drilling fluids], 3001(b)(3)(A) (ii) [mining wastes], and 3001(b)(3)(A)(iii) [cement kiln dust]. Two sites in proposed Update #9 contain or possibly contain special study wastes. The sites and the special study wastes involved are: o Feed Materials Production Center (USDOE), Fernald, OH (mining wastes) o Monticello Mill Tailings (USDOE), Monticello, UT (mining wastes) Reproposed Site In addition to proposing new sites, EPA also is proposing to expand the Mather Air Force Base (AC&W Disposal Site) , Sacramento, CA, which was placed on the final NPL on July 22, 1987 (52 FR 27620). The original site was located in the Aircraft Control and Warning (AC&W) area of the base, which had contaminated portions of the large aquifer near some base production wells. Since then, EPA has determined that additional areas of the base are responsible for further contamination of the aquifer and may be responsible for contamination off-base. Consequently, EPA proposes to expand the original site to include the entire base and requests comment on the expanded site. The sites would be renamed "Mather Air Force Base." EPA discussed the basis for site expansions in a final rule concerning Federaf facility sites (54 FR 10512, March 13, 1989). HRS Effective Date On December 23, 1988 (53 FR 51962), EPA proposed revisions to the HRS in response to CERCLA Section 105(c)(1), added by SARA, which provides that EPA should revise the HRS by October 17, 1988 (24 months after the enactment of SARA). Conmenters on NPL rules have argued that the October 17, 1988 date is the effective date for all purposes of Section 105(c)(1), and EPA cannot use the current HRS after that date to propose or promulgate sites to the NPL. The commenters believe that EPA may not resume listing sites until the HRS revisions are proposed and made effective. EPA does not agree and provided its rationale for its position on March 31, 1989 (54 FR 13299). EPA intends to issue the revised HRS as soon as possible. However, until the proposed revisions have been subject to public comment and put into effect, EPA will continue to propose and promulgate sites using the current HRS, in accordance with CERCLA Section 105 (c) (1) and Congressional intent. -3- ------- Additional Publications Two additional publications are available on Update #9 proposed in July 1989: o "National Priorities List, Supplementary Lists and Supporting Materials."
