United States HW-10.2 Environmental Protection Agency __ BACKGROUND INFORMATION: NATIONAL PRIORITIES LIST, FINAL AND PROPOSED PULEMAKING At this time, the U.S. Environmental Protection Agency (EPA) is adding 99 sites (including 32 Federal facility sites) to the National Priorities List (NPL). The Federal facility sites are the first to be added to the NPL. EPA is also reproposing 7 Federal facility sites and proposing to expand 1 Federal facility site. With the 703 sites already on the NPL, the number of final sites is now 802. In addition, 149 sites (including 16 Federal facility sites) are proposed for the NPL. Final and proposed sites total 951. Of the 50 States, the District of Columbia, and 6 Territories, 37 are represented in the final rulemaking. California leads with 14 new final sites, followed by Pennsylvania with 13. Of the States and Territories, eight have no sites on the new final NPL: Alaska, American Samoa, Commonwealth of the Northern Mariana Islands,; the District of Columbia, Hawaii, Nevada, Trust Territory of the Pacific Islands, and the Virgin Islands. New Jersey has the largest number of final sites (96), followed by New York (63), Pennsylvania (61), Michigan (58), and California (48). The NPL identifies sites for long-term "remedial action" under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), as amended by the Superfund Amendments and Reauthorization Act (SARA) enacted on October 17, 1986. SARA sets up the "Hazardous Substances Superfund" (superseding the "Hazardous Response Trust Fund" set up under CERCLA) to pay costs not assumed by responsible parties for cleanup actions at abandoned or uncontrolled hazardous waste sites that threaten public health or the environment. EPA has the primary responsibility for managing cleanup and enforcement activities under Superfund. * This document provides background information on the final and proposed rulemakings and the following lists: 0 The 99 new final sites being added to the NPL arranged alphabetically by State. The 32 Federal facility sites are in a separate section. 0 The 149 sites that are now proposed for the NPL arranged alpha- betically by State, with the 16 Federal facility sites in a separate section. * For a more detailed description of the NPL process, see "National Priorities List, Fact Book" (June 1986), Publication HW-7.3. The formal comment period closed on August 11, 1986. Of the 45, 16 received no comments and are being added to the NPL at this time. Update #6, proposed on January 22, 1987, consisted of 64 sites, including 1 Federal facility site. The formal comment period ended on March 23, 1987. Of the 64 sites, 22, including the Federal site, received no comments and are being added to the NPL at this time. Of the 133 sites and 16 Federal facility sites in proposed status, 66 sites and 14 Federal facility sites are from proposed Updates #1 through 4 and remain proposed pending resolution of technical or policy issues involving the Resource Conservation and Recovery Act (RCRA), the Federal Insecticide, Fungicide, and Rodenticide Act, and the Surface Mining Control and Reclamation Act. These policies are explained in detail in the June 10, 1986 final rule (51 FR 21054). The remaining 67 sites and 2 Federal facility sites, from proposed Update #5 and #6, continue to be proposed because EPA has not completed review of comments. All proposed sites will be considered for listing in future final rules. ------- RCRA-Related Sites In November 1984, the Hazardous and Solid Waste Amendments were enacted, expanding EPA's authority to require corrective measures under Subtitle C of RCRA. As a result of this broadened RCRA authority, EPA revised its policy for placing RCRA-related sites on the NPL,. and in June 1986, announced three major components of a final RCRA policy. Specifically, EPA announced that facilities subject to Subtitle C of RCRA would be placed in the NPL only if one or more of these conditions exist: 0 'The facilities are owned by persons who are bankrupt. 0 The facilities have lost authorization to operate, and'there are additional indications that the owner or operator will be unwillinq to undertake corrective action. 0 Facilities, analyzed on a case-by-case basis, whose owners or operators have shown an unwillingness to undertake corrective action. In June 1986, EPA requested public comment on a proposal to add specificity to the third component. EPA will consider supplementing the final RCRA listing policy if comments or experience with the new policy demonstrate that additional categories of RCRA-related sites should be placed on the NPL to ensure appropriate and expeditious remedial action. At this time, EPA is adding two RCRA-related sites to the NPL because the owners/operators are bankrupt, thus meeting the first component of the final listing policy. No comments were received on the sites, which were proposed in Update #6. The sites are: o Parsons Casket Hardware Co., Belvidere, Illinois 0 Palmetto Recycling, Inc., Palmetto, South Carolina EPA is also adding four California sites that were identified as RCRA sites in June 1986. Subsequent investigation revealed that the sites are not subject to RCRA Subtitle C. These sites have HRS scores of 28.50 or above, and EPA received no information precluding placing them on the NPL. The four are: 0 Applied Materials, Santa Clara 0 Monolithic Memories, Inc., Sunnyvale 0 National Semiconductor Corp., Santa Clara 0 Teledyne Semiconductor, Mountain View RCRA-related sites remaining in proposed status total 45, including these four not previously identified: 0 Pratt & Whitney Aircraft/United Technologies Corp., West Palm Beach, Florida 0 A.Y. McDonald Industries, Inc., Dubuque, Iowa 0 National Starch & Chemical Corp., Salisbury, North Carolina 0 Rohm & Haas Co. Landfill, Bristol Township, Pennsylvania All RCRA sites will be considered in future rulemaking. -4- ------- Federal Facility Sites, Final Rule Section 120(a) of SARA requires that Federal facilities be subject to and comply with CERCLA in the same manner as any nongovernmental entity. In addition, listing Federal facility sites is consistent with the NPL's purpose of informing the public about sites that present potential hazards. CERCLA Section lll(e)(3), however, limits use of the Superfund for remedial actions at Federally-owned facilities. Prior to this final rule, 48 Federal facility sites were proposed for the NPL. This final rulemaking adds 32 of these sites to the Federal section of the NPL, leaving 16 in proposed status. In its June 1986 rulemaking, EPA announced final and proposed components of a listing policy for non-Federal, RCRA-related sites, reserving for a later date the question of the policy for Federal facilities containing areas subject to Subtitle C of RCRA within the facility boundary. On May 13, 1987 (52 FR 17991), EPA proposed a policy of placing Federal facility sites on the NPL regardless of whether RCRA Subtitle C corrective action authorities were applicable. The 32 Federal facility sites being placed on the NPL at this time can be categorized in this way: 0 26 have areas within the facility boundaries subject to the corrective action authorities of RCRA Subtitle C, but the areas were not included in the HRS score. They are being listed according to the RCRA policy announced on September 8, 1983 (48 FR 40662), which stated that EPA could place on the NPL nonregulated units of active facilities — that is, land disposal units that stopped receiving hazardous waste before the effective date of the RCRA Subtitle C land disposal regulations. This policy remains applicable to Federal facility sites until EPA reaches a final decision on modifying it. In the interim, EPA believes that it is important to continue the process of including Federal facility sites on the NPL. 0 6 do not include any RCRA-regulated units within the facility boundaries. They are: - Alabama Army Ammunition Plant, Childersburg, Alabama - Moffett Naval Air Station, Sunnyvale, California - Twin Cities Air Force Reserve Base (Small Arms Landfill), Minneapolis, Minnesota (in Update #6, no comments received) - Weldon Spring Quarry (USDOE/Army), St. Charles County, Missouri - Cornhusker Army Ammunition Plant, Hall County, Nebraska - Naval Air Engineering Center (NAEC), Lakehurst, New Jersey Federal Fac i 1 i ty S i tes, Proposed Rule Of the 16 Federal facility sites that remain proposed, 7 are being reproposed at this time in a separate rule because it appears that the areas evaluated for the NPL included areas subject to the corrective action requirements of RCRA Subtitle C. The RCRA units will still be included in calculation of the HRS scores for these sites, which is consistent -5- ------- with the RCRA/Federal facilities policy proposed in May 1937. The seven Federal facility sites being reproposed at this time are: 0 Anniston Army Depot (Southeast Industrial Area), Anniston, Alabama 0 Dover Air Force Base, Dover, Delaware 0 Joliet Army Ammunition Plant (Load-Assembly-Packing Area), Joliet, Illinois 0 Savanna Army Depot Activity, Savanna, Illinois 0 Louisiana Army Ammunition Plant, Doyline, Louisiana 0 Letterkenny Army Depot (Property Disposal Office Area), Franklin County, Pennsylvania Air Force Plant #4 (General Dynamics), Forth Worth, Texas o The 16 Federal facility sites remaining proposed will be considered in future final rules. Within the boundaries of the Rocky Mountain Arsenal in Adams County, Colorado, there are areas subject to the Subtitle C corrective action authorities of RCRA. However, there are no such areas on this specific NPL site. Therefore, this Federal facility site is among those being placed on the Federal section of the NPL at this time according to the September 1983 NPL/RCRA policy. In the separate proposed rulemaking, EPA is also proposing to expand the site to include a surface impoundment known as "Basin F." EPA's NPL/RCRA policy when the site was proposed was to exclude an area from an NPL site if it had received hazardous waste after the effective date of the RCRA Subtitle C land disposal regulations. EPA believed Basin F had received hazardous waste after the effective date and so excluded it frcm the NPL site. EPA has since learned that Basin F did not receive hazardous waste after the date. In addition, further investigation indicates that Basin F is a major contributor to ground water .contamination at the arsenal. Therefore, EPA is proposing to expand the NPL site to include Basin F and is soliciting public comment on the proposal. Silver Bow Creek The Silver Bow Creek Site, in Deer Lodge and Silver Bow Counties, Montana, was added to the NPL in September 1983. At that time, the site was characterized as approximately 28 stream miles. Subsequent investigations indicated that sources in Butte upstream of the original site are contributing to contamination in the creek. In June 1986, EPA'requested comments on the appropriateness of adding the Butte Area to the original site. EPA received two comments. EPA continues to believe that it is appropriate to expand the site. Consequently, the NPL site has been expanded and is now known as "Silver Bow Creek/Butte Area." Silver Creek Tailings In proposing the Silver Creek Tailings Site, Park City, Utah, on September 18, 1985 (50 FR 37950), EPA evaluated the site using information provided by the State of Utah. EPA has determined that some of the information is not appropriate to substantiate an HRS score of 28.50 or -6- ------- above. In the past, such sites have continued in proposed status until EPA could determine if the appropriate data could be obtained to substantiate an MRS score of 28.50 or above. However, Section 118(p) of SARA specified that the Silver Creek Tailings Site be removed from the NPL unless EPA determines that site-specific data not used to propose this site indicate that the site meets the requirements of the MRS or any revised hazard rankitig system. Consequently, the Silver Creek Tailings Site was removed from proposed status on October 17, 1986, the date of SARA's enactment. This action does not indicate a change of the existing policy to continue to propose sites until the appropriate decision can be made. Name Revisions The names of three sites and one Federal facility site being placed on the NPL have been changed in response to comments received. The changes are intended to reflect more accurately the location or nature of the problems at the site. The sites are: 0 Harris Corp./General Development Utilities, Palm Bay, Florida, becomes Harris Corp. (Palm Bay Plant) 0 Robins Air Force Base, Houston County, Georgia, becomes Robins Air Force Base (Landfill tt4/Sludge Lagoon) 0 St. Augusta Sanitary Landfill/St. Cloud Dump, St. Augusta Township Minnesota, becomes St. Augusta Sanitary Landfill/Engen Dump 0 First Piedmont Corp. Rock Quarry, Pittsylvania County, Virginia, becomes First Piedmont Corp. Rock Quarry (Route 719) Description of Lists Each entry on the NPL and the three site lists contains the name of the site, the city or county in which it is located, and one or more notations referencing the type of response and the status of cleanup activities. The site lists are arranged alphabetically by State (two-letter abbreviations) and by site name. Five response categories are used to designate the type of response underway. Except for "D," more than one category may apply to each site. The five are: R = Federal and/or State response F = Federal enforcement S = State enforcement V = Voluntary or negotiated response U = To be determined -7- ------- For informational purposes, cleanup status is indicated where field activities are underway or completed. .Many sites are cleaned up in stages or "operable units" — that is, a discrete action taken as part of the entire site cleanup that significantly decreases or eliminates contamination, threat of contamination, or pathway of exposure. One or more operable units may be necessary before EPA will consider the cleanup of a hazardous waste site completed. A simple action such as constructing a fence is not considered an operable unit for coding purposes. Three cleanup status codes are used. (Only one code can be used at a site because the codes are mutually exclusive). The three codes are: I = Implementation activities are underway for one or more operable units 0 = Implementation activities are completed for one or more (but not all) operable units C = Implementation activities are completed for all operable units The new final NPL is ordered according to MRS scores, with sites placed in groups of 50. The range within most of the groups of 50 is only 1 to 4 points. EPA considers sites within a group to represent approximately the same potential threat to public health, welfare, or the environment. For convenience, the sites are numbered.
