SITE NAME AND LOCATION

     Old Rinchem, Incorporated, Albuquerque, Bernalillo County,
New Mexico
STATEMENT OF PURPOSE

     This decision document outlines the rationale that no
Federal action under Superfund is warranted at the Old Rinchem
site.   This decision is in accordance with the requirements of
the Comprehensive Environmental Response, Compensation, and
Liability Act of 1980 (CERCLA), as amended by the Superfund
Amendments and Reathorization Act of 1986 (SARA), and the
National Contingency Plan  (40 CFR Part 300).
STATEMENT OF BASIS

     This decision is based on the Administrative Record for the
Old Rinchem site.  The attached record (Attachment C) identifies
the documents that comprise the Administrative Record.  Based on
the findings in the Remedial Investigation for this site,
contamination in either subsurface soils or ground water does not
exceed concentrations that would trigger a Federal action.  Based
on current data, there is no imminent threat of contamination of
drinking water supplies near this site.  However, the ground
water in the area is protected as a future water supply under New
Mexico Water Quality Control Commission (NMWQCC) regulations.
Future actions at the site may be pursued by State and/or local
environmental authorities.
DESCRIPTION OF THE SELECTED RESPONSE ACTION

     Based on Che results of the Remedial Investigation and
associated risk assessment, no Federal response actions are

warranted for the Old Rinchem site.  Long-term monitoring by the
Federal Superfund program is not required, but the ground water
wells, installed during previous investigations in the 1980's and
90'a, will not be abandoned at this time.  These wells will be
abandoned when they are no longer needed by State and local
environmental authorities.

     The EPA will not include the Rinchem site on the National
Priorities List (NPL).   The EPA will pursue removing the site
from the list of sites proposed for the NPL.
DECLARATION

     Consistent with the Comprehensive Environmental Response,
Compensation, and Liability Act of 1980 as amended by the
Superfund Amendments and Reauthorization Act of 1986, and the
National Contingency Plan, I have determined that this decision
will provide adequate protection of human health and the
environment.  This decision attains Federal requirements that are
applicable, or relevant and appropriate.  Because no site related
hazardous substances above Federal health based levels were
detected, Five-Year Reviews of the site will not be conducted by
the Federal Government.

     The State of New Mexico has been consulted and supports this
decision for the Old Rinchem site.

Site Location and Deacription

     The Old Rinchem site  (site) is located at 5001 Edith
Boulevard NE, immediately north of the Albuquerque city limits,
in Bernalillo County, New Mexico (Figure 1).  The 2/3-acre site
is surrounded by mixed residential and industrial properties.
Rinchem leased and used this property as a chemical distribution
facility and hazardous waste transfer facility from May 1976
through December 1983.  Operations consisted of transporting
hazardous wastes from generators to the site, repackaging or
accumulating the waste, and transporting the waste either back to
the generators or to an off-site disposal facility.  Structures
associated with the Rinchem operation at this location included
an office and warehouse building, two 4,000-gallon steel storage
tanks, and two 950-gallon fiberglass storage tanks.  These
facilities are shown in Figure 2.

     Two residences are located within 100-feet north and south
of the facility; a school is located within one mile of the site.
Property east and west of the site is used for industrial
purposes.  There are 28 municipal water supply wells and at least
17 private water supply wells within a four mile radius of the
site's boundary.  The nearest water supply well is a domestic
well within one mile, and the nearest public water supply well is
less than two miles from the site.  An irrigation channel, the
Alameda Lateral, flows along the facility's western boundary.
Site History

     From the 1940's until May 1976, the Old Rinchem site was
occupied by an electronics assembly operation and a hydraulic
industrial facility, both of which may have used chlorinated
solvents in their industrial processes.  Rinchem began operation
at the site in 1976 as a distributor of industrial solvents and
resins.  In 1979 operations changed to allow for transportation
and storage of industrial wastes.  The company's operation

involved transporting hazardous wastes from a generator's
location, repackaging the waste and/or consolidating similar
types of waste from several sources,  and transporting the waste
back to the generator for further use or to a hazardous waste
disposal facility.

     According to information provided in the facility's Resource
Conservation and Recovery Act (RCRA)  Hazardous Waste Permit
Application (October 11,  1980),  the Old Rinchem site was designed
to store 10,000 gallons of hazardous material in tanks and 10,000
gallons of material in drums.  The facility was also designed to
treat 7,680 gallons of material per day.  The estimated quantity
of material to be handled was listed as 110 tons in the permit
application.  The types of hazardous substances stored at this
location included organic and inorganic chemicals, solvents,
he«vy metals,  acids, and bases.

     Drums were stored in three areas of the Old Rinchem site,
namely under a canopy in the southwest part of the covered
warehouse, on a concrete pad adjacent to the warehouse, and on
the non-vegetated ground along the southern fence line of the
property.  Drummed hazardous wastes that required protection from
adverse weather were stored in the canopied portion of the
warehouse.  In addition to the drum storage, two fiberglass tanks
were present on-site on the west side of the covered warehouse.
These tanks were used to contain reclaimed waste material spilled
during the drum loading/unloading process.

     In September 1980, a citizen's complaint to the New Mexico
Environmental Improvement Division [NMEID,  the predecessor agency
of the New Mexico Environment Department (NMED) before July
1991], described the use of these tanks in the process of
unloading a tanker truck.  In the complaint, an allegation was
made that liquids were collected in the tanks and were
subsequently dumped into a surface depression on the west side of
the Old Rinchem property.  In October 1980, staff from the NMEID
visited the site and were given pictures showing a chemical
running into a standing pool of water at the back of the Rinchem
property.  During the visit, workers from the facility outlined
plans to correct the problem of spillage and chemical handling.
These plans included a series of collection basins with
inspection points for spilled chemicals, feeder canals, and
earthwork dikes to prevent pools of standing water.

     In 1982, Rinchem notified the Environmental Protection
Agency (EPA)  that it would not apply for a RCRA operating permit
for this location.  Subsequently, in December 1983, Rinchem
closed the facility and moved the operation to a new facility
approximately one mile north of the old site.  The Old Rinchem
site is currently owned and operated by Janco Sheet Metal which
operates a metal duct-work fabrication facility.
Site Geography

     The former Rinchem property lies within the Albuquerque-
Helen basin and is bounded on the east by the Sandia, Manzano,
and Manzanita mountains and on the west by the mesas and high
lands of the Colorado Plateau.  The site is located approximately
three miles east of the Rio Grande River at an elevation of 4,995
feet above mean sea level, or approximately 20 feet above river
level.

     The ground surface at and near the site has a slope of two
percent to the north-northwest.   The Alameda Lateral, located
adjacent to the west property line, has a two-foot high dike
separating the site from the waterway.  Surface water on the Old
Rinchem site flowed west, then south, along the base of the dike,
and was then trapped in the southwest corner by the Lateral and a
railroad spur.  Occasionally, water flowed into the Alameda
Lateral through breaches in the dike.  Water in the lateral
eventually flows into the Rio Grande River.
Climate

     The Albuquerque area has an arid, continental climate
characterized by low precipitation and low relative humidity.
Average annual precipitation is 8.65 inches, 47% of which comes
from thunderstorms in July, August, and September.  Potential
evapotranspiration in the Albuquerque area is -30.9 inches.
Evapotranspiration exceeds precipitation from February through
October, reducing soil moisture.  Soil moisture is recharged from
November through January, when evapotranspiration decreases.

Geolocry

     The Albuquerque-Belen basin has a history of subsidence and
is considered a basin/fill sedimentary accumulation.  Presently,
the basin is a topographic depression bordered on the east by
mountains and the west by the Colorado Plateau.  The basin is
filled by erosional sediment, derived from sedimentary deposits,
volcanic/basaltic material, and some pre-Cambrian igneous or
metamorphic rocks.  The primary source of basin sediments comes
from the Upper Tertiary and Quaternary periods.  Underlying this
basin are pre-Cambrian igneous and metamorphic rocks and
Paleozoic, Mesozoic, and possibly Lower Tertiary sedimentary
rocks.

     Several monitoring wells or hand-augered borings from the
various site investigations show the subsurface lithology of the
sediments under the site.  Top soils are generally sand and loam
underlain by a thin (8-24 inch) layer of clay and silty clay.
Below that, loose soil to a depth of about 54 feet is normally a
mixture of sand, gravel and clay in varying proportions.  The
sand is medium to coarse grained and the gravel averages one to
two inches in diameter.  Both seem to be composed of granitic
material.  Next comes about 20 feet of gravel and sand.  The
gravel is pebble to boulder sized and composed of silicic
volcanics, sedimentary, and metamorphic rock fragments.
Underlying this rock unit is a sequence of sand, gravel, clay,
and sandy clay.  Thus the stratigraphic section at this site is
best described as an alternating series of sands, gravels,
boulders, silts, silty clays, and clays.  These sediments are
generally unconsolidated but do have layers of weakly cemented
sandstone.  The monitoring wells installed in 1988 by NMEID were
screened in the gravel-boulder section at approximately 75 feet
to 95 feet below the ground surface.
Hydrology

     Sediments in the vicinity of the site are divided into the
Upper Tertiary and Quaternary basin fill and the underlying pre-
Tertiary zone.  The different aged sediments and the varying
lithologic constituents of the soil are generally hydraulically
interconnected.  Thus a single aquifer, called the Santa Fe, is
present in the Albuquerque Basin.  The ground water in the

overall aquifer is unconfined; the water table generally slopes
toward the south and west toward the Rio Grande River.  All but
one of the monitoring wells, installed during the various site
investigations, were screened in the shallower portion of the
aquifer,  but one well,  screened at a depth of 180 feet, was set
in the lower portion of the aquifer.

     At the Old Rinchem Site, however, the hydrology is affected
by pumping from nearby Albuquerque water supply wells.  The draw-
down caused by well pumping creates an interruption of ground
water flow gradients in both the horizontal and vertical
directions near the site.  The ground water flows to the
southeast near the site, rather than to the west, the regional
gradient direction.  At this site the ground water gradient is
approximately 24 feet per mile.

     The Santa Fe aquifer thickness in the Albuquerque Basin with
a low Total Dissolved Solids  (TDS) concentration of less than
1,000 parts per million  (ppm), exceeds 3,500-feet.  The dissolved
solids concentration in the ground water under the former Rinchem
property was estimated to be 800 ppm in 1988.  The TDS
concentration is one of the parameters used to judge the quality
of the water as a drinking water source.

     There are six municipal well fields within three miles of
the site: the Candelaria (removed from service before 1988),
Duranes,  Griegos, Leyendecker, Santa Barbara, and Volandia.  The
transmissivities of these well fields are estimated to range from
68,000 gallons/day/foot to 512,500 galions/day/foot.  The 1988
population estimated to be served by the wells was slightly over
100,000 people.
Previous Investigations

     The Old Rinchem site was routinely inspected by the EPA
under its RCRA authority.  In addition to these regular
inspections, the site was inspected on January 8, 1981,
February 4, 1982, and January 4, 1983, in response to a citizen's
complaint to NMEID.  These inspections noted liquid pooled on the
facility grounds.  As noted in the complaint, the liquid was
thought to have come, in part, from leaks during tank truck
unloading and leaks in the on-site storage tanks.

     The NMEID conducted an assessment of the Old Rinchem site in
late 1983-early 1984.  This assessment included the collection of
on-site surface soil samples and water samples from an abandoned
water supply well located on the property.  Volatile Organic
Chlorinated (VOC) solvents, including acetone, trichloroethylene
(TCE),  and perchloroethylene (PCE), and methyl isobutyl ketone
(MIBK)  were found in the soil samples.  VOCs and ketones were
also found in ground water samples collected from the abandoned
well (Potential Hazardous Waste Site Inspection Report. Rinchem
Company. February 1985, NMEID).

     A second investigation of the Old Rinchem site was conducted
by NMEID in 1988.  Five ground water monitoring wells were
installed at a depth of approximately 100 feet.  The screens were
set immediately below the water table.  Samples collected from
down-gradient wells had higher concentrations of VOCs than
samples from the up-gradient wells.  This situation usually
indicates a contaminant release to ground water.  Based on this
information, EPA and NMEID determined that VOCs were released
from the Old Rinchem site.  Three solvents- 1,1-dichloroethene
(1,1-DCE), 1,1,1-trichloroethane  (1,1,1-TCA), and TCE- were
detected at concentrations exceeding State and/or Federal
drinking water standards.  Eight soil borings were drilled to a
depth of ten feet to evaluate soil contamination on-site.
Acetone, PCE, 1,1,1-TCA, and TCE were detected in soil samples
taken from these borings  (Site Follow-up Investigation. Rinchem
Company. NMEID, December 1988).

     From data generated in the 1988 investigation, the NMEID
concluded that activities at the Rinchem property resulted in
soil contaminated with several volatile organic compounds
including acetone, TCE, and 1,1,1-TCA.  In addition to these
compounds, 1,1-dichloroethane (1,1-DCA) was detected in ground
water samples taken from the upper portion of the aquifer in the
vicinity of the site.  These data  indicate that a release of
hazardous substances from the Rinchem operation to ground water
had occurred prior to 1988.  Specifically, the conclusion in the
1988 investigation is based on this evidence:

  1) hazardous wastes had been processed at the site;

  2) chlorinated solvents and acetone had been found in soil
samples collected on-site; and,

  3) chlorinated solvents were found in ground water samples
collected on-site; higher contaminant concentrations were noted
to the south of the facility.

     Based on these investigative conclusions, EPA proposed the
Old Rinchem site be included on the National Priorities List
(NPL) in October 1992.  Because chemicals associated with
operations at this location were found in soil and ground water
samples, EPA and NMED concluded that a full Remedial
Investigation and risk assessment should be conducted to
determine whether any contaminated areas on-site or ground water
contamination would pose a risk to public health or the
environment.

     EPA and NMED were particularly concerned that highly
concentrated Dense Non-Aqueous Phase Liquids  (DNAPL) might have
settled in the ground water as a free phase liquid.  To
investigate this possibility, NMED drilled two ground water
monitoring wells in 1995 to evaluate a deeper part of the Santa
Pe aquifer beneath the site.  In the deeper of the two wells, the
well screen was set at IBO-feet.  This is the deepest monitoring
well at the Old Rinchem site and evaluates the possibility of a
DNAPL occurrence in this part of the aquifer.
Remedial Investigation Results

     In addition to the earlier investigations, Rinchem, in 1992,
initiated a remedial investigation to acquire site specific data
needed to evaluate the vertical and horizontal distribution and
the magnitude of contamination from hazardous substances released
from the facility.  Also sought was the  potential threat to
human health or the environment from the release.  This
investigation included drilling and sampling 28 soil borings,
installing eight new monitoring wells, and the sampling of the 13
wells at the site.  In addition, the investigation included a
soil gas survey; additional soil samples were taken in areas with
higher soil gas survey contaminations.  The location of the soil
borings and monitoring wells are shown on Figures 3 and 4,
respectively.  The results of laboratory analyses from soil and
ground water samples taken from these locations are presented on
Tables 1 and 2.

          The results of the 1992 soil investigation performed by
Rinchem, Inc., indicated that chlorinated solvents were not
detected in soil samples collected from the upper 27 feet of the
sedimentary section.  This was in opposition to previous
investigations conducted by NMED/NMEID prior to 1992.  In the
earlier investigations, TCE and PCE concentrations in soil
samples, collected at a depth of six feet, were reported as high
as 73 and 131 parts per billion (ppb), respectively.  Thus,
results of the soil investigations indicate that the operations
at the Old Rinchem site resulted, at one time, in the release of
numerous VOC compounds, including acetone, trichloroethane, PCE,
and TCE to on-site soils.  Over time,  the concentration of VOC
compounds in the soil decreased through either volatilization
and/or leaching into the ground water beneath the site.
Currently, contaminant concentrations in all surface soil samples
are below Superfund soil screening levels, indicating that no
Federal Superfund action is warranted at the Old Rinchem site.
Metals were not detected at concentrations of concern to the
Federal Government in soil samples collected on-site.

     Ground water sampling, conducted by Rinchem between 1992 and
1996, indicate that VOC concentrations above Federal drinking
water standards, as shown on Table 2,  were present in several
wells, namely OR88-3A, OR88-4, OR88-5, OR92-1, OR92-2, and
OR92-3.  All of these wells, except the OR88-3A, south of the
site, and OR92-3, north of the site, had minimal concentrations
of VOCs, were erratic in VOC presence, and showed no VOC
concentrations above Federal/State standards during 1995.  Using
data through 1995, wells OR88-3A and OR92-1, although showing
VOCs slightly above standards, did not pose a risk based threat
to human health or the environment.  A summary of the risk
process is discussed in the following section.

     Subsequently in June 1998, NMED examined 15 ground water
monitoring wells at the site.  Four wells, including the OR88-3A,
were dry.  The other 11 wells, including the OR92-3, had no VOC
concentrations above drinking water standards.  The concentration
of VOC solvents suggest that DNAPLs are not present in the
aquifer beneath the Rinchem site.  Also, because concentrations
of VOCs at the Old Rinchem site are below Federal/State water
quality standards and the nearby Albuquerque water supply wells
are not threatened from a release at this site, it is improbable
that there is an imminent threat from past Rinchem releases under
or adjacent to the Old Rinchem site.

Summary of Site Risks

     The EPA conducted an evaluation of potential risk to human
health using conservative risk assessment guidelines outlined in
the EPA Risk Assessment Guidance for Superfund. Part A.  The
purpose of using conservative assumptions is to assure that the
estimated risk from exposure to site contaminants is not
underestimated.  The risk assessment is not an absolute estimate
of risk to human health.  Rather, it is a conservative analysis
indicating the potential for adverse impacts to human health from
a release of hazardous substances from the site.

     The EPA compared the maximum soil concentrations of TCE and
PCE reported from the site with soil screening concentrations for
these chemicals.  These screening concentrations  (100 ppb for TCE
and 300 ppb for PCE) were set assuming that land use at the site
would remain commercial.  Since the maximum concentrations
reported during the site investigations are lower than the EPA
screening concentrations, a Federal response action is not
warranted to address direct worker contact with soil
contamination at the site.

     The EPA also used the maximum reported concentrations to
estimate the risk, based on the concentration of solvents that
could be expected in ground water due to leaching of TCE and PCE
from site soils.  The excess cancer risk from ground water
contaminated by leachate from the site was estimated to be 9 in
1,000,000.  This risk factor falls within the target risk range
set for the Federal Superfund program of 1 in 10,000 to 1 in
1,000,000.
Statutory Determination

     The development of remedial alternatives to address
contamination at the Old Rinchem site was not warranted on the
following basis:

  1.  soil contamination detected in the several investigations
of the site did not exceed EPA soil screening concentrations
calculated for direct worker contact at the site;

  2.  in ground water samples collected by Rinchem in 1995, only
well OR92-3 indicated VOC concentrations above Federal drinking

water standards;  In a 1998 sampling event, contaminant levels
for the OR92-3 had dropped below standards;

  3.  based on the absence of free-phase VOCs and the maximum
concentrations of contaminants found in the ground water
monitoring wells on the Old Rinchem site,  there are no DNAPLs
present in the aquifer beneath the site; and

  4.  the estimated risk from future exposure to contaminants in
ground water resulting from leaching of soil contaminants is
within the target risk range set for the Federal Superfund
program.

     Because the results of all investigations of the Old Rinchem
site indicate that risks from the site are within or below the
Superfund target risk range, inclusion of the site on the NPL is
not warranted.  Therefore, the EPA will begin the process of
removing the site from the list of sites proposed for the NPL.
Removal of the site from the proposed list does not preclude
future Superfund activities, should additional information become
available.  The EPA suggests that ground water monitoring be
continued to ensure the continued quality of the ground water at
the site.

     The State of New Mexico and the city of Albuquerque support
this decision.  However, this decision applies solely to Federal
Superfund activity associated with the Old Rinchem site, and it
does not affect the ability of other Federal, State, and/or local
authorities to protect ground water resources in the area of the
site.

                     RESPONSIVENESS SUMMARY
             FORMER  RINCHEM,  INCORPORATED, PROPERTY
                       RECORD OF DECISION

                           April 1997

     This Responsiveness Summary is divided into two sections.
The first section provides a history of community relations
activities during the site investigations conducted at the site.
The second section of the summary provides written responses to
comments received during the formal public comment period on
EPA's proposal  to remove the site from consideration for further
Superfund action at this time.

Background of Community Involvement:

     On January 20, 1993, EPA held an open house inviting
interested persons to discuss the proposal of the Old Rinchem
site to the National Priorities List.   During the open house,
residents asked questions about another Superfund site in the
area, AT&SF Tie Treater.   No questions were asked about the Old
Rinchem site.

     On September 9 and 10,  1994,  EPA conducted community
interviews to discuss the site activities.   Very little interest
was generated from these interviews.

     In Summer 1996,  Rinchem, EPA,  and NMED completed all Federal
remedial investigation work for the property. The results of
these investigations indicated that:

  1. a release of hazardous substances from the property to the
ground water occurred during Rinchem1s operational period; and,

  2. that the level of risk from exposure to contaminants from
the site does not trigger a Federal response action at this time.

     Announcement of a Proposed Plan was postponed until NMED and
the city of Albuquerque could develop plans to address the
Rinchem property through State and local environmental
authorities.

     A notice of a public comment period was published in the
Albuquerque Journal on August 11,  1997.  A fact sheet outlining
EPA's proposal was mailed to all persons on the mailing list at

the same time.  The public comment period began on August 14,
1997, and ended on September 12, 1997.  The EPA held a public
meeting on August 21, 1997, at the North Valley Senior Citizen
Center to discuss the results of EPA, NMED, and Rinchem's
investigations and EPA's proposed plan.  Ten people attended the
meeting.

Summary of Comments Received During the Comment Period

     No written comments were received by EPA during the public
comment period.  However, a few comments were made during the
public meeting.  The following is a discussion of comments made
during the meeting and EPA's responses to those comments:

Comment ftl:    One commenter stated that the New Mexico
Environment Department had data indicating that area ground water
was contaminated prior to 1976, when Rinchem began operations at
the 5001 Edith Blvd. location.

EPA Response:  The New Mexico Environment Department has no
record of area ground water sampling conducted prior to 1976.   A
statement was made, either by the tenant occupying the property
prior to Rinchem or the property owner, that the ground water
quality was bad and shouldn't be used for drinking water.

Comment #2:    Contaminant concentrations up gradient of the site
are worse than concentrations down gradient from the site.

EPA Response:  The EPA believes that the statement is inaccurate
for the following reasons:

  1.  Data presented in the 1988 site investigation conducted by
NMEID indicated that a release of chlorinated solvents to the
ground water had occurred from the Rinchem property.
Concentrations of solvents in down gradient wells were higher
than in up gradient wells at the time.

  2.  Over time, the ground water gradient and elevations have
changed such that current conditions do not reflect the original
ground water elevations and velocity and flow direction.

  3.  There is limited information available to define the nature
of solvent migration since the releases occurred.  It is possible
that past releases from the site have migrated down gradient and
that recent releases from other sources in the area were detected
during the 1992-1996 remedial investigations.

                                  INTRODUCTION
Section 1 130X1) of the Comprehensive Environment!! Response, Compensation, and Liability Act
(CERCLA), 42 U.S.C. Section 9613QX1). provides that judicial review of any issues concerning
(he adequacy of a response action shall be limited to the administrative record compiled for the she.
CERCLA, as amended by the Superfimd Amendments and Reauthorization Act (SARA), requires
the U.S. Environmental Protection Agency (EPA) to compile documents that form the basis for the
selection of die remedial CERCLA and SARA response actions. These supporting documents form
an "administrative record" (AR), which die Agency must provide for public review. The ARs are
maintained at relevant EPA Regional Offices as well as "at or near die facility at issue."

The following Administrative Record Index was compiled in accordance with OSWER Directive
Number 9833.3 A-l, "Final Guidance on  Administrative Records for Decision* on Selection of
CERCLA Response Actions* (December  3, 1990). Documents listed as bibliography sources in
respofise decision documents may not be listed in the AR Index. An index to die "Compendium of
CERCLA Response Selection Guidance Documents" is enclosed in the AR. The AR Index file is
compiled as documents related to die response action are being generated.  All documents dial are
clearly relevant and nooprivOeged are placed m die record file, entered into die index, and made
available to die public as soon as possible.  The documents included in die index are predominantly
nrrmnged in chronological order.  EPA may send supplemental AR volumes and indexes to die
          repository. These supplements should be placed with the initial record file.
The AR Index helps readers locate and retrieve documents in die file. It also provides an overview
of die response action history. The index includes die following information for each document:
