The National Priorities List (NPL) identifies the targets
for long-term "remedial action" under the "Superfund"
law, the Comprehensive Environmental Response,
Compensation, and Liability Act of 1980 (CERCLA).
CERCLA set up a Trust Fund that totaled $1.6 billion over
the first 5 years of the Act to pay costs not assumed by
responsible parties for corrective actions at abandoned or
uncontrolled hazardous waste sites that threaten human
health or the environment.
The U. S. Environmental Protection Agency (EPA) has
the primary responsibility for managing cleanup and
enforcement activities under Superfund. As of June 1986,
EPA had inventoried over 24,000 uncontrolled hazardous
waste sites. Some require emergency action because they
represent an immediate threat. EPA cleans up such sites
promptly through its "removal" program. As of May 20,
1986, EPA had started 726 removal actions, including 177
at NPL sites where initial cleanup measures were required.
To be eligible for a long-term remedial action under
Superfund, however, a site must be on the NPL.
EPA published the first official NPL of 406 hazardous
waste sites on September 8, 1983. It was the result of EPA's
consideration of comments received during the 60-day
public comment period on the 419 sites proposed in
December 1982 and March 1983. (Earlier, before formal
rulemaking, EPA had announced two preliminary lists.)
EPA must update the NPL at least annually. Since
September 1983, EPA has proposed five updates to the
NPL, added 305 sites to the final NPL, and deleted 8 sites.
As of June 1986, 703 sites qualified for the NPL. Another
185 sites were in the proposed category, for a total of 888
sites. These totals result from the following EPA actions

NPL Eligibility Policies
Sites are placed on the NPL primarily on the basis of their
scores on the Hazard Ranking System (HRS), a numerically
based system designed to evaluate the relative risks posed
by a site to human health and the environment. An HRS
score of 28.50 was selected as the cutoff point for the first
proposed NPL to identify at least 400 sites, the minimum
specified by CERCLA.
CERCLA also allows States or Territories to designate a
top-priority site. Top-priority sites must be listed in the
first 100 (Groups 1 and 2), regardless of score.
On February 12, 1985, EPA proposed amending the NCP
to provide an additional criterion for listing. On September
16, 1985 (50 FR 37624), the amendment was adopted.
Under section 300.66(b)(4), a site can now be included on
the NPL if it meets these three requirements:
• The Agency for Toxic Substances and Disease Registry
(ATSDR) of the U.S. Department of Health and Human
Services has issued a health advisory that recommends
removing people from the site.
• EPA determines that the site poses a significant threat to
public health.
• EPA anticipates that it will be more cost-effective to use
its remedial authority than to use its removal authority to
respond to the site.
CERCLA restricts EPA's authority to respond to certain
sites by expressly excluding some substances from the
definition of "release." In addition, as a matter of policy,
EPA may choose not to use CERCLA because other
authorities can be used to clean up these releases. Where
such authorities exist and the Federal government can
undertake or enforce cleanup under an established
program, using the NPL to determine the priority or need
for response under CERCLA may not be appropriate.
However, if EPA later determines that sites not listed as a
matter of policy are not being properly responded to, it
may consider placing them on the NPL.
CERCLA section lll(e)(3) prohibits use of the Trust Fund
for remedial actions at Federally owned facilities, and,
until November 1985, section 300.66 (e)(2) of the National
Contingency Plan (NCP), the Federal regulation by which
CERCLA is implemented, prohibited including Federal
facilities on the NPL.
On February 12, 1985, EPA proposed amendments to the
NCP, including one to delete section 300.66(e)(2). On
November 20, 1985, EPA adopted the NCP amendments
(FR 50 47912). With section 300.66(e)(2) deleted, Federal
sites now can be included on the NPL.
Until the amendments were adopted, EPA continued to
score Federal facilities and identify those that would meet

the criteria for listing. EPA named six such facilities in the
preamble to the FederaJ Register notice proposing Update
#3 and three in the Update #4 preamble. EPA solicited
comments on the nine sites and stated that it could place
them on the NPL without soliciting further comments if the
amendments were adopted. Earlier, EPA had proposed 36
Federal facilities in Update #2.
RCRA-Related In establishing the first NPL in September 1983, EPA
Sites adopted a policy for placing sites related to the Resource
Conservation and Recovery Act (RCRA) on the NPL. The
policy stated that sites where RCRA provided no
comprehensive authorities for correcting the contamination
problems would be eligible for the NPL.
In November 1984, the Hazardous and Solid Waste
Amendments were enacted, expanding EPA's authority to
require corrective measures under RCRA. As a result of this
broadened RCRA authority, EPA is revising its policy for
placing RCRA-related sites on the NPL, and in June 1986,
announced major components of a final RCRA policy.
As part of the policy, EPA will continue to consider
eligible for the NPL those RCRA facilities to which RCRA
Subtitle C corrective action authorities do not apply. In
addition, certain sites subject to Subtitle C corrective action
requirements are eligible for listing on the NPL if:
• The facilities are owned by persons who are bankrupt.
• The facilities have lost RCRA Interim Status and there
are additional indications that the owner or operator will
be unwilling to undertake corrective action.
• Based on a case-by-case analysis, EPA has determined
that the facilities' owners or operators appear unwilling to
undertake corrective action.
In June 1986, EPA requested public comment on a
proposal to add specificity to the third component. EPA
will consider supplementing the final RCRA listing policy
if comments or experience with the new policy
demonstrate that additional categories of RGRA-related
sites should be placed on the NPL to ensure appropriate
and expeditious remedial action.

Update #2 (Proposed October 1984)
NPL Update #2, proposed on October 15, 1984 (49FR
40320), consisted of 244 sites. California led with 41 sites.
The following two sites in New Jersey were added to the
NPL on February 14, 1985, in a separate rulemaking
because serious problems existed that required EPA to take
immediate remedial action:
• Glen Ridge Radium Site
• Montclair/West Orange Radium Site
Of the 242 remaining sites in proposed Update #2:
• Pratt & Whitney Aircraft in West Palm Beach, Florida,
was reproposed for the NPL on September 18, 1985, as part
of Update #4
On June 10, 1986, EPA took these actions on the 241
sites remaining in proposed Update #2:
• 149 were added to the NPL
• 86 continued to be proposed
• 6 were removed from further consideration because their
final HRS scores fell below the cutoff point of 28.50
EPA received 607 comments on proposed Update #2, of
which 543 pertained to 126 sites (including 36 Federal
facilities). The remaining comments involved sites that
were not proposed, or generic or technical issues that did
not pertain to specific sites. In all, EPA reviewed over
12,000 pages of comments on proposed Update #2, the
most it has ever received on an NPL rulemaking.

Status Proposed Update #2 contains 35 RCRA-related sites. Of
the 35, 30 remained in proposed status in June 1986
because EPA needs more time to evaluate their RCRA
status. The 30 sites are:

EPA added the following two RCRA-related sites to the
NPL because the potentially responsible party declined to
initiate work and CERCLA-funded activities are underway:
• Operating Industries, Inc., Landfill, Monterey Park,
California
• L.A. Clarke & Son, Spotsylvania County, Virginia
EPA has determined that the owners or operators of 3 of
the 35 RCRA-related sites are bankrupt and believes that
they are financially unable to take appropriate remedial
action. Thus, EPA placed the following three sites on the
NPL:

EPA is continuing to evaluate the six
pesticide-contaminated sites in Hawaii in the context of an
overall policy for sites where contamination appears to
result entirely from the application of pesticides registered
under the Federal Insecticide, Fungicide, and Rodenticide
Act. Hence, these six sites remained in proposed status in
June 1986:
• Kunia Wells I
• Kunia Wells II
• Milliard Wells
• Waiawa Shaft
• Waipahu Wells
• Waipio Heights Wells II
Two mining-related sites remained in proposed status in
June 1986 while EPA determines their eligibility for funds
from the Abandoned Mine Land Reclamation Program of
the Surface Mining Control and Reclamation Act. The two
sites are:
• Olson/Neihart Reservoir, Wasatch County, Utah
• Sharon Steel Corp. (Midvale Tailings), Midvale, Utah
An additional 12 sites in Update #2 remained in
proposed status in June 1986 while EPA continues to
evaluate the public comments received. The sites are listed
in the Federal Register notice of June 10, 1986.
Six proposed sites were no longer being considered for
listing in June 1986 because of changes in HRS scores. As a
result of EPA's review of comments and other information,
23 proposed HRS scores changed, but in only these sites
did the changes lower the scores to below 28.50:

Update #1 (Proposed September
1983)
NPL Update #1, proposed on September 8, 1983 (48 FR
40674), consisted of 133 sites. On May 8, 198-1 (FR 49
19480), 4 of the 133 sites were udded'to the NPL. On
September 21, 1984 (49 FR 37070), 123 were added, 2 were
removed from consideration, and 4 remained proposed.
EPA had continued the proposal of two of the four sites
in September 1984 because of an administrative error
during the 60-day comment period. After providing an
additional comment period, EPA placed this site on the
NPL in June 1986:
• Sand Springs Petrochemical Complex, Sand Springs,
Oklahoma
The second of the two sites is RCRA-related. It remains
in proposed status because EPA needs more time to
evaluate its KGRA status. Tin? site is:
• OHu Corp, (Areas I, 2, 4), Augusta, Georgia
EPA continued the proposal of one site in September
1984 because it did not meet the existing criteria specified
in the NCP for placing a site on the NPL. Section 300.66
(b)(4) of the NCP adds a new criterion involving issuance
of a health-advisory by ATSDR. EPA is evaluating the site
in light of the new criterion and so in June 1986 again
deferred final rulemaking on:
• Quail Run Mobile Manor, Gray Summit. Missouri
A fourth Update #1 site remained in proposed status in
September 1984 because EPA needed time to resolve
technical issues relating to the site's HRS score. After
further analysis, EPA has determined that the HRS score is
below 28.50 and, therefore, removed this site from
consideration in June 1986:
• Pig Road, New Waverly, Texas

Update #3 (Proposed April 1985)
NPL Update #3, proposed on April 10, 1985 (50 FR
14115), consisted of 32 sites, including 6 Federal facilities.
Of the States and Territories, 18 were represented in
proposed Update #3. Pennsylvania led with six sites.
Of the 32 sites, one, the Lansdowne Radiation Site in
Lansdowne, Pennsylvania, was proposed on the basis of
the amendment proposed in February 1985, to section
300.66(b) of the NCP. ATSDR issued a health advisory on
March 5, 1985, as that section requires, stating that
exposure levels in the Lansdowne residence were in excess
of those considered safe for human habitation. The normal
60-day comment period following the proposal was
shortened to 30 days to allow earlier action on the
Lansdowne Radiation Site. EPA placed the site on the NPL
on September 16, 1985 (50 FR 37630).
On June 10, 1986, EPA added to the NPL seven sites
from proposed Update #3 on which no comments were
received during the public comment period. The seven are:
• H. Brown Co., Inc., Grand Rapids, Michigan
• Valley Park TCE, Valley Park, Missouri
• Tibbetts Road, Harrington, New Hampshire
• Monitor Devices, Inc./Intercircuits, Inc., Wall Township,
New Jersey
• Davis (GSR) Landfill, Glocester, Rhode Island
• Texarkana Wood Preserving Co., Texarkana, Texas
• Wausau Ground Water Contamination, Wausau,
Wisconsin
After the NCP amendment on listing Federal facilities
was proposed, EPA did not place on the NPL Federal
facilities it had already proposed, nor did it formally
propose additional Federal facilities. However, EPA
continued to score Federal facilities. For proposed Update
#3, EPA determined that six would meet the criteria for
listing. EPA solicited comments on the scoring of these
sites and reserved the right to place them on the NPL
without soliciting further comments if it decided to list
Federal facilities in the future. The six were identified in
the preamble to the Federal Register notice proposing
Update #3 to the NPL. With the prohibition against listing
Federal sites removed, these six sites can now be counted
in the proposed category:

• Joliet Army Ammunition Plant (Load-Assembly-Packing
Area), Joliet, Illinois

NPL Update #4, proposed on September 18, 1985 (50 FR
37950], consisted of 41 sites, including 3 Federal facilities.
Of the States and Territories, 18 were represented on
proposed Update #4, Iowa and Pennsylvania led with five
sites each.
On June 10 1986, EPA added to the NPL 13 sites from
proposed Update #4 on which no comments were
received. The 13 are:
• Interstate Lead Co. (ILCO), Leeds, Alabama (identified as
RCRA-related, but the owner is bankrupt and financially
unable to take appropriate remedial action)
• Halby Chemical Co., New Castle, Delaware
• Yellow Water Road Dump, Baldwin, Florida

As it did in Update #3, EPA named in the preamble to
the Federal Register notice those Federal facilities that
would meet the criteria for proposal. Thus, these three sites
can now be counted in the proposed category:
• Naval Air Engineering Center (NAEC), Lakehurst, New
Jersey
• Naval Air Station, Whidbey Island (Ault Field), Whidbey
Island, Washington
• Naval Air Station, Whidbey Island (Seaplane Base),
Whidbey Island, Washington
The Pratt & Whitney Aircraft/United Technologies Corp.
Site in West Palm Beach, Florida, was proposed in October
1984, as part of Update #2. In response to comments
on the proposal, EPA revised the site's HRS score.
Consequently, EPA reproposed the site in Update #4 and
12 solicited comments on the revised score.

Update #5 (Proposed June 1986)
NPL Update #5, proposed on June 10, 1986 (51 FR 21099),
consisted of 45 sites, including 2 Federal facilities. Of the
States and Territories, 23 were represented. Pennsylvania
led with seven sites, followed by New York with six. This
proposal brought to 185 the number of sites proposed for
the NPL. Adding the 703 sites on the final NPL brought the
total to 888.
Butler Mine The Butler Mine Tunnel, situated in a populated area in
Tunnel Pittson, Pennsylvania, is included in proposed Update #5.
The tunnel was designed to drain acid mine waste into the
Susquehanna River. The tunnel is honeycombed with
boreholes and shafts. In addition to mine drainage,
hazardous wastes were disposed illegally in the tunnel.
In July 1979, EPA initiated an emergency response action
at the site because oily material was being released from
the tunnel into the river. On October 23, 1981, EPA
announced the Interim Priorities List, including the Butler
Mine Tunnel Site. In February 1982, the State of
Pennsylvania indicated that no further response actions
were warranted based on monitoring of existing conditions.
Butler Mine Tunnel was not included on the first NPL
proposed in December 1982 because EPA had determined
that all appropriate Fund-financed cleanup had been
completed. Therefore, the Butler Mine Tunnel satisfied the
criteria necessary at that time for deletion from the NPL.
Following heavy rains associated with Hurricane Gloria,
oily material was observed discharging from the Butler
Mine Tunnel outfall into the Susquehanna River in
September 1985. EPA again took emergency action.
However, remedial action may be needed in the future to
provide a long-term resolution of problems at the Butler
Mine Tunnel. Therefore, the site was included in proposed
Update #5 to provide EPA the additional capabilities
available under CERCLA's remedial action authorities.

Deletion of Sites
EPA may delete a proposed or final NPL site from the NPL
if it determines that no further response is required to
protect public health or the environment. A recent
amendment to the NCP (50 FR 47912, November 20, 1985)
establishes criteria for deleting sites under section
300.66(c)(7). A site may be deleted where no further
response is appropriate if EPA determines that one of the
following criteria has been met:
• EPA, in consultation with the State, has determined that
responsible or other parties have implemented all
appropriate response action required.
• EPA, in consultation with the State, has determined that
all appropriate Fund-financed response under CERCLA has
been implemented, and that no further response by
responsible parties is appropriate.
• Based on a remedial investigation, EPA, in consultation
with the State, has determined that the release poses no
significant threat to public health or the environment, and,
therefore, remedial measures are not appropriate.
Under the NCP amendments adopted in November 1985,
sites that have been deleted remain eligible for further
Fund-financed remedial actions if warranted by future
conditions.
On December 31, 1985 (50 FR 53448), EPA provided a
notice of intent to delete eight sites from the NPL and
solicited comments on the notice. On March 7, 1986
(51 FR 7935), EPA announced that the following sites
have been deleted:
• Taputimu Farm, Island of Tutuila, American Samoa
• PCS Warehouse, Saipan, Commonwealth of the Northern
Mariana Islands
• Morris Arsenic Dump, Morris, Minnesota
• Friedman Property (once listed as Upper Freehold Site),
Upper Freehold Township, New Jersey

Data Summaries
A total of 888 sites appear on the State map, 703 final NPL
sites and 185 sites that are still in proposed status. After a
period of public comment and revisions, the proposed sites
that continue to meet the listing criteria will be merged
into the final NPL.
Seven States or Territories — Alaska, American Samoa,
Commonwealth of the Northern Mariana Islands, the
District of Columbia, Nevada, Trust Territory of the Pacific
Islands, and the Virgin Islands — have no final or
proposed sites. When final and proposed sites are
combined, New Jersey has the largest number with 97,
followed by Michigan (66), and New York and
Pennsylvania (65 each). Of the 10 EPA Regions, Region 5'
(Illinois, Indiana, Michigan, Minnesota, Ohio, and
Wisconsin) leads with 217 sites.
A wide range of activities are involved in the operations at
the 888 sites on or proposed for the NPL. Landfilling was
the major type of activity, taking place at about 42 percent
of all sites. Other major activities were surface
impoundments (27 percent) and drums (27 percent).
Most of the sites have problems involving contaminated
ground water. At 74 percent, hazardous materials
(primarily heavy metals and organic solvents) were
detected in ground water. About 44 percent of the sites had
problems with surface water, and 15 percent with air.
NPL (by Rank)
Of the States and Territories, eight have no sites on the
new final NPL: Alaska, American Samoa, Commonwealth
of the Northern Mariana Islands, the District of Columbia,
Hawaii, Nevada, Trust Territory of the Pacific Islands, and
the Virgin Islands. New Jersey has the largest number of
sites (91), followed by New York (57), Michigan (56), and
Pennsylvania (48).
Each entry on the new final NPL contains the name of
the site, the State and city or county in which it is located,
and the corresponding EPA Region. (In some cases, the
names have had to be shortened for space reasons.
Complete site names are given in the list starting on page
50.)
The entries are arranged according to their scores on the
MRS. HRS scores are designed to take into account a
standard set of factors related to risks from potential or
actual migration of substances through ground water,
surface water, and air. Listing by rank serves both as an
information and management tool, allowing EPA and the
States to decide which sites warrant detailed investigation
to determine what, if any, response is needed.

The 703 sites on the NPL are in 15 groups, 50 to a group
(except for the last group of 3). The range wilhin most of
the groups is 1 to 4 points. EPA considers sites within a
group to represent approximately the same potential threat
to public health, welfare, or the environment. For
convenience, the sites are numbered.
Of the States and Territories, 36 have designated a
top-priority site. Four of these sites were deleted from the
NPL on March 7, 1986. Of the 32 remaining top-priority
sites, 9 are included in the first 100 on the basis of their
scores. The remaining 23 have scores that would not place
them in the top 100. They are included at the bottom of the
second group of 50. Of the 23, 6 have scores below 28.50.
The site placed on the NPL on the basis of section
300.66(b)(4), which includes issuance of a health-advisory
by ATSDR, has a score below 28.50 and appears at the
bottom of the list in Group 15.
Each entry is also accompanied by one or more notations
referencing activities underway at the site at the time the
list was prepared (June 1986). Five categories are used to
designate the type of response underway. One or more
categories may apply to each site. The five are:
V The Voluntary or Negotiated Response category includes
sites where private parties have started or completed
response actions pursuant to settlement agreements or
consent decrees to which EPA or the Stale is a party.
R The Federal and/or State Response category includes
sites at which EPA or State agencies have started or
completed response actions.
F The Federal Enforcement category includes sites where
the United States has filed a civil complaint (including
cost recovery actions) or issued an administrative order.
It also includes sites at which a Federal court has
mandated some form of response action following a
judicial proceeding.
S The State Enforcement category includes sites where a
State has filed a civil complaint or issued an
administrative order. It also includes siles al which a
State court has mandated some form of response action
following a judicial proceeding.
D Category To Be Determined includes all sites not listed
in any other category. A wide range of activities may he
in progress at sites in this category. EPA or a Slate may
be evaluating the type of response action to undertake, or
an enforcement case may be under consideration,
Responsible parties may be undertaking cleanup actions
that are not covered by a consent decree or an
administrative order.

The status of Fund-financed field activities underway
or completed, as well as the status where responsible
parties are conducting cleanup activities under a consent
decree, court order, or an administrative order, is
indicated with one of three codes. Planning or
engineering studies do not receive a cleanup status code.
Many sites are cleaned up in stages or "operable units"
— that is, a discrete action taken as part of the entire site
cleanup that significantly decreases or eliminates
contamination, threat of contamination, or pathway of
exposure. One or more operable units may be necessary
before EPA will consider the cleanup of a hazardous
waste site completed. A simple action such as
constructing a fence is not considered an operable unit
for coding purposes.
Three cleanup status codes are used. (Only one code
can be used at a site because the codes are mutually
exclusive). The three codes are:
I Implementation activities are underway for one or more
operable units. Field work is in progress at the site, but
no operable units are completed.
O Implementation activities are completed for one or more
(but not all) operable units. Some field work has been
completed, but additional work is necessary.
C Implementation activities are completed for all operable
units. All actions agreed upon for remedial action at the
site have been completed, and work has started to
monitor the effectiveness of the cleanup. Further site
activities could occur if EPA considers them necessary.
Proposed Sites The list of the 185 sites from Updates #1-5 that remain in
proposed status is arranged by State (two-letter
abbreviations), with the 47 Federal sites in a separate
section. Of the States and Territories, 18 have no sites in
either section: Alaska, American Samoa, Commonwealth of
the Northern Mariana Islands, the District of Columbia,
Guam, Idaho, Massachusetts, Mississippi, Nevada, New
Mexico, North Dakota, Puerto Rico, Rhode Island, South
Dakota, Trust Territory of the Pacific Islands, Vermont, the
Virgin Islands, and Wyoming. The State with the most sites
is California with 27. Other States with a large number of
proposed sites are Pennsylvania (17) and Illinois (11).
Each entry contains the name of the site and the State
and city or county in which it is located. Essentially the
same response categories are assigned for Federal sites as
for non-Federal sites. A Federal agency response is

as evaluating the appropriate response to undertake, are

The 47 proposed Federal sites are also shown by group.
The 13 sites where EPA has determined no further
response is needed at this time are shown by State in the
list of "Sites Deleted Because No Further Response
Needed." Eight of the sites were deleted from the NPL in
March 1986 under section 300.66(c)(7) of the NCP. The
remaining five were considered for the NPL, but EPA
determined before promulgation of the first NPL in
September 1983 that no further response was needed.
The 18 proposed sites considered for but never placed on
the NPL are shown by State in the list of "Proposed Sites
Removed From Consideration for NPL." EPA determined
that the sites have HRS scores below the 28.50 cutoff.

Cleanup of sites on the NPL can be financed by the
CERCLA Trust Fund, by those potentially responsible for
contamination at the site, or by a combination of the two.
Response actions can require several years to complete and
involve a number of successive steps:
• Taking any measures needed to stabilize conditions,
which might involve, for example, fencing the site or
removing above-ground drums or bulk tanks. Such
measures usually would be required in any event in the
later phases of cleanup. Often, such actions are taken by
EPA's emergency "removal" program.
• Carrying out a "Remedial Investigation" to determine the
type and extent of contamination at the site.
• Conducting a "Feasibility Study" to develop and analyze
various response alternatives. The Feasibility Study is often
conducted with the Remedial Investigation as one project.
• Providing a public comment period on remedies
proposed.
• Selecting the remedy that provides the most protection
to human health and the environment on the basis of
permanence, reliability, and cost.
• Implementing the remedy. Typical remedies involve
ground-water cleanup and measures to control the source
of contamination (containing or treating the wastes on the
site and managing the residuals on or off the site).
