The Revised Delegation to Process "Research and Special Incineration-at-Sea
Permits".
Summary of Directive
The Assistant Administrator for Water will continue to have the respinsibility for
issuing "research" and special incineration-at-sea permits under the Marine
Protection Research and Sanctuaries Act. Since some of these permits could involve ,
incineration of RCRA hazardous wastes. OSW will continue to work, under an informal
arrangement, with the Office of Wate'r on the issuance of these permits. No formal
arrangement is necessary.

As you requested, the Office of Solid Waste haa reviewed *
the subject materials transwitted by the Feftruary 29, 1984 , £
me!»or»ndufl! froct Gary Katz. I recoonend that Lee TtioiMts concur
in the revised delegation* without cowiaent fro« the RCRA view-
point.
For the record, I would point out that one of the
revised delegations would continue to vest in the \asiatant
Administrator for Water the authority to process "research and
special incineration-at-sea permits* under the Marine Protection,
Research and Sanctuaries Act. Some of these permits could encom-
pass incineration of RCRA hazardous wastes (e.g., the 'Vulcanua*
permit), suggesting the desirability of OSW participation in a
concurrence/ consultation role. However, we have Been working
with the Office of water in the issuance of these perwits under
an informal arrangement which we expect will continue to serve
both offices well. Therefore, we see no need to formalize this
arrangement oy amending that delegation.
