SPA's purpose is sixfold:
                                                           This
    (1)    It delineates time frames by which States must
          obtain authorization for non-HSWA Cluster IV
          and HSWA Cluster II.              .

    (2)    It provides eight additional checklists (Numbers 39
          through 46), covering the period July 1, 1987 through
          June 30, 1988.   Revision Checklists 39, 42, and 44
          open HSWA Cluster II.  Revision Checklists 40, 41,
          43, 45, and 46  open and complete non-HSWA Cluster IV.

    (3)    It provides revised portions of the SCRAM
          necessitated by adding eight new checklists.
          Specifically, these revisions include:

          o    Table A-l of Appendix A (pages A-2a through
              3.3-20).

       „  o    The Model Attorney General's Statement (pages
              3.3-4 through 3.3-20).

     (5)   It provides a new version of Checklist 29 which
          explains  the relationship of this checklist to
          Checklist 46.
     (6)   It outlines corrections to existing checklists that
          have been uncovered during the authorization review
          process.  The SPA provides corrected versions of
          these checklists for substitution in Appendix A of
          the -SCRAM.

    The SPA itself is. organized into three major subsections
— A, B and C, with Section A summarizing each of the Federal
Register rules requiring a new revision checklist.  Section B
presents the revisions to the SCRAM necessitated by these
checklists, and Section C outlines the changes and corrections
to existing checklists.  Attached to the SPA are the eight new
revision checklists, the updated portions of. the SCRAM, and
updated versions of those existing checklists which have been
corrected.

 A.  STATE PROGRAM CHANGES FOR JULY 1, 1987  - JUNE 30,  1988

. 1.  California List Waste Restrictions

 Date:   July 8, 1987, as amended      Reference:   52  FR 25760-92

 Effective:  July 8, 1987 and October 27,  1987

 Summary:  This rule restricts the land disposal of certain  "California
 List"  wastes, including liquid polychlorinated  biphenyls  (PCBs)  above
 specified concentrations, and hazardous wastes  containing halogenated
 organic compounds above specified concentrations.  Additionally,  this  rule
 (1) codifies the statutory land disposal  restrictions  on  certain  California
•List corrosive wastes and, (2) establishes  methods for determining
 compliance with this rule's prohibitions.

 The land disposal  restrictions framework, promulgated  on  November 7,  1986
 (Revision Checklist 34), is also modified by this rule.   Of particular
 concern to state authorization is that certain  sections  (i.e.,  268.42(b),
 and 262.44), which  were originally delegable to states are  no  longer
 considered delegable.   With regard to 268.6—petitions of specific
 duration—EPA has  decided in this rule to require that these be  handled  at
 EPA, as the" Agency  expects few such "no migration" petitions.   However, 'in
 the future,  states  may be authorized to grant these  petitions.   Because  the
 delegability of these  sections has changed,  states are not  required to
 adopt  these  sections when Revision Checklist 34 is submitted.

 State  Authorization:   This is a HSWA rule and will be  included  in HSWA
 Cluster II.   The  state modification deadline is July 1,  1991.   Both interim
 and final  authorization are available.  The  state revision  application must
 include a  revised  program description,  an AG statement addendum,  an
 addendum to  the MOA (if appropriate),  Revision  Checklist  39 and  associated
 state  regulations.

 SCRAM  Update:   Updates  to Table A-l of Appendix A and  to  the Model Attorney
 General's  Statement are necessary to reflect the  addition of this
 checklist.   These revisions  are addressed -in Section B of this  SPA.

 2.   List  (Phase  1)  of  Hazardous Constituents for Ground-Water Monitoring

 Date:  July  9,  1987                  Reference:  52 FR 25942-53

 Effective:   September  28,  1987

 Summary:  This  rule  amends  the regulations concerning ground-water
 monitoring at RCRA  land-based TSD facilities.  It requires that an analysis
 of all the constituents  in  a new Appendix IX to Part 264 be performed on
 the  ground water taken from wells surrounding those facilities.

 State Authorization:   This  is a non-HSWA rule and will be included in
 non-HSWA  Cluster IV.   The  state modification deadline is July 1, 1989
 (note:  the  date given for  authorization in the Federal Register is
 incorrect).  Only final  authorization is available^The state revision
 application  must include a  revised program description, an AG Statement
 Addendum, Addendum  to  MOA  (if appropriate), Revision Checklist 40, and
 associated state regulations.

 SCRAM Update:  Updates to  Table A-l of Appendix A and to the Model Attorney
 General's Statement  are  necessary to reflect the addition of this
 checklist.   These revisions are addressed in Section B of this SPA.


 3.   Identification and Listing of Hazardous Waste

 Date:  July  10,  1987                 Reference:  52 FR 26012

 Effective:   July 10, 1987

 Summary:  This technical correction clarifies that it is the residue
 remaining in a container (or an inner liner) that may be a hazardous waste,
 not  the container or the liner itself.

 State Authorization:   This  is a non-HSWA rule and will be included in
 non-HSWA Cluster IV.   The  state modification deadline is July 1, 1989.
 Only final authorization is available.  The state revision application must
 include a revised program  description, an AG Statement Addendum, Addendum
 to MOA (if appropriate), Revision Checklist 41, and associated state
 regulations.

SCRAM Update:  Updates to Table A-l of Appendix A and to the Model Attorney
General's' Statement are necessary to reflect the addition of this
checklist.  These revisions are addressed in Section B of this SPA.

 4.  Exception Reporting for Small  Quantity Generators  of  Hazardous Waste

 Date:  September 23, 1987            Reference:   52  FR 35894-99.

 Effective:   March 23, 1988

 Summary:   On March 4, 1986, EPA promulgated final  regulations  for small
 quantity genera-tors (addressed by  Revision Checklist 23).   This  present
 rule modifies this previous rule,  specifically imposing modified exception
 reporting requirements for generators  of between  100 and  1000  kilograms of
 hazardous waste in a calendar month.

 State Authorization:  This is a HSWA  rule and  will be  included in HSWA
 Cluster II.   The state modification deadline is July 1, 1991.  Both  interim
 and final authorization are available.   The state  revision  application must
 include a revised program description,  an AG Statement Addendum, Addendum
.to MOA (if  appropriate),  Revision  Checklist 42, and  associated state
 regulations.

 SCRAM Update:   Updates to Table A-l of  Appendix A  and  to  the Model Attorney
 General's Statement are necessary  to  reflect the  addition of this
 checklist.   These revisions are addressed in Section B of this SPA.


 5.   Liability  Requirements for Hazardous  Waste Facilities;  Corporate
     Guarantee-

 Date:   November  18,  1987              Reference:   52  FR 44314-21

 Effective:   December 18,  1987

 Summary:  Through  an Interim  Final Rule,  effective September 9,  1986 and
 addressed by Revision  Checklist 27, EPA  allowed the  use of  a corporate
 guarantee as an  additional  financial  responsibility  mechanism.   That rule,
 is  now  being finalized  with a number of  minor  revisions,  including allowing
use  of  the guarantee by firms  incorporated  outside the United  States.

The  standards  promulgated  in  the July 11,  1986  (51 FR  25350) rule are less
stringent than preexisting  Federal requirements; thus,  authorized states
are jiot required  to  adopt  them.  However,  authorized states that have
already adopted  or choose  to  adopt the July 11, 1986 Interim rule,
addressed.by Revision Checklist 27, must  revise their  program  and adopt
this present rule, as  this  rule  is more  stringent, in  some  respects, than
the  interim final  rule.

State Authorization:  This  is  a  non-HSWA  rule  and will  be included in
non-HSWA Cluster  IV.  Only  those authorized states that have already
adopted or choose to adopt  the  July 11,  1986 (Checklist 27)- Interim  Final
Rule must revise their  program  to reflect  the  changes  in this  checklist.
The state modification deadline  is July  1,  1989.  Only final authorization
is available'.  The state revision application  must include  a revised
program description, an AG  Statement Addendum, Addendum to MOA (if
appropriate), Revision Checklist 43, and associated  state regulations.

 6.   HSWA Codification Rule 2

 Date:  December 1, 1987           .  Reference:  52 FR 45788-99

 Effective:  December 1,  1987  for 264.100(e) introductory text,
               264.100(e)(l)  and (2), and 264.101(c)
            December 31, 1987 for the remainder of the rule

 Summary:   This  is  a  companion rule to EPA's July 15; 1985 final rule
 (Revision  Checklist  17)  codifying those HSWA requirements that took effect
 immediately or  shortly  after  the enactment of these amendments.  This
 present rule codifies further changes to existing corrective action and
 permitting provisions for  RCRA facilities.  Also included are provisions
 implementing corrective action requirements for releases beyond the
 facility boundary  and for  waste injection wells.

 Since  HSWA provides  that states may seek authorization for selected
 provisions (instead  of  having to adopt all provisions simultaneously), this
 checklist  has been divided into seven subsections:  44A Permit Application
 Requirements Regarding  Corrective Action, 44B Corrective Action Beyond the
 Facility Boundary, 44C  Corrective Action for Injection Wells, 44D Permit
Modification, 44E  Permit as  a Shield Provision, 44F Permit Conditions to
 Protect Human Health and the  Environment, and 44G Post- Closure Permits.

 State Authorization:  This is a HSWA rule and will be included in HSWA
Cluster II.  The. state  modification deadline is July 1, 199-1 (note:  the
 date given for  authorization  in the Federal Register is incorrect).  Both
 interim and final  authorization are available.  The state revision
application must include a revised program description, an AG statement
 addendum,  an addendum to the MOA (if appropriate), Revision Checklists
44A-G  (as  appropriate)  and associated state regulations.

SCRAM Update:   Updates  to  Table A-l of Appendix A and to the Model Attorney
General's Statement  are  necessary to reflect the addition of this
checklist.  These  revisions  are addressed in Section B of this SPA.
7.   Hazardous Waste Miscellaneous Units

Date:  December 10, 1987             Reference:  52 FR 46946-65

Effective:  January 11, 1988

Summary:  This rule promulgates a .new set of standards under Subpart X of
Part 264 that are applicable to_owners and operators of new and existing

  hazardous  waste  management units not covered under the existing
  regulations.   This  rule win allow  the Agency, and states adopting
  equivalent authorities, to issue permits to miscellaneous waste management
  units.

  State Authorization:  This is a non-HSWA rule and will be included in
  non-HSWA Cluster IV.  The state modification deadline is July 1, 1989.
  Only final  authorization is available.  The state revision application must
  include a  revised program description, an AG Statement Addendum, Addendum
  to MOA (if appropriate), Revision Checklist 45, and associated state
  regulations.

  SCRAM Update:  Updates to Table A-l of Appendix A and to the Model Attorney
  General's  Statement are necessary to reflect the addition of this
  checklist.  These revisions are addressed in Section B of this SPA.


  8.   Technical Corrections; Identification and Listing of Hazardous Waste

.  Date:  April 22, 1988                Reference:  S3 FR 13382

  Effective:   January 11, 1988

  Summary:   This rule makes technical  corrections to the list of commercial
 chemical  products.that are hazardous wastes when discarded (261,33(e) and
  (f)), and to the lists of hazardous  constituents (Appendix VIII of Part
 261).  In addition EPA has added 'hazardous waste numbers corresponding to
 substances  listed in Appendix VIII  that are also listed in 261.33(e) or
  (f).

 Since this  checklist makes extensive corrections to the lists which are
 part  of Revision Checklist 29,  states are advised to follow Revision
 Checklist 46 when revising their code,-to avoid 1) making two separate
 revisions  and 2)  incorporating  the  extensive misspelling, CAS numbering,
 and format  errors which are part of  the lists given in the August 6, 1986
 Federal  Register (51 FR 28296)  addressed by Revision Checklist 29.

 State Authorization:   This  is  a  non-HSWA rule and will be included in
 non-HSWA  Cluster IV.   The  state  modification deadline is July 1, 1989.
 Only  final  authorization  is  available.   The state revision application must
 inclade a revised program  description,  an AG statement Addendum, Addendum
 to MOA  (,\f  appropriate),  Revision Checklist 46, and associated state
 regulations.

 SCRAM Update:   Updates to  Table  A-l  of  Appendix A and to the Model Attorney
 General's Statement  are necessary to reflect the addition of this
 checklist.   Also, the  existing Revision Checklist 29 has been changed to
 include a paragraph  on its  first page outlining this checklist's
 relationship to Revision Checklist 46.   These revisions  are addressed in
 Section B and  C of this SPA.

3.   REVISIONS TC iC.:.r.;»

The  addition of eight new  checklists necessitates revisions to Table A-l of
Appendix A, and to the Model Attorney General's Statement.  These sections
are  included in Attachment B and should replace these parts in the most
recent SCRAM.

Specifically, the revisions are as follows:

      •    The revised Table A-l should replace pages 2-2a through A-2e of
          the SCRAM.  Table A-l was revised by adding non-HSWA Cluster IV
          and HSWA Cluster II to the cluster list on page A-2a as well as
          by adding these  two clusters to the main body of the Table (i.e.,
          pp. 2-2b through 2-2e).  Revision Checklists 40, 41, 43, 45 and
          46 were placed in non-HSWA Cluster IV.  These are the only
          checklists in this cluster as these are the only non-HSWA
          Checklists occurring during the period July 1, 1987 through June
          30, 1988.  Revision Checklists 39, 42, and 44 open HSWA Cluster
          II.  This cluster has two more years, and will close on June 30,
          1990.

      t    The revised Model Attorney General's Statement should replace
          pages 3.3-4 through 3.3-20 of the SCRAM.  Sections I-A(8), XV-G,
          and XV-H were revised and Sections VII-8 & C; XII-C; XIII-C, D,
          E, & F; XV-J; XVI-K, L, M, N, & 0; and XXI-8 were added to
          reflect the addition of eight new revision checklists.

C.   CORRECTIONS TO EXISTING REVISION CHECKLISTS

In reviewing state authorization packages, several errors in existing
revision checklists have come to the attention of the State Programs
Branch.  This section addresses these areas.  Additionally, two of the new
checklists (Nos. 39 and 46) have a complicated and confusing relationship
to existing checklists (Nos. 29 and 34); consequently, a paragraph was
added to these existing checklists to explain this relationship.  Revision
checklist pages for substitution in the existing SCRAM are provided in
Attachment C.

The  specific revisions are as follows:

     9    Revision Checklist 4, page 1, 261 Appendix VII.  In the last line
          of the F024 listing "tetrachpjjjethylene" was changed to
        /.•"tetrachloroethylene", so that this substance was spelled
          correctly.  On the second page, 261 Appendix III, the common
          names were not included with the chemical names.  The
          descriptions for this change were corrected to include the common
          names.

     •    Revision Checklist 14, page 2, 261.33f.  The instruction
          following this citation is incorrect.  It says to remove these
          chemicals from the list.  The FR's instruction is to revise the
          hazardous waste  numbers to reference F027.  The revised page 2,

 included  in Attachment C, gives the instruction as shown in the
 FR.  On page  7 of Revision Checklist 14, 270.17(1) and 270.18(1}
 have been  corrected  to read 270.17(j) and 270.18(j), to
 accurately reflect the £R addressed by this checklist.

 Revision Checklist 171, 270.60(c)(3).  This citation was changed
 to more correctly read 270.60 (c)(3)(vii).

 Revision Checklist 28, page 5.  This checklist omits stating that
 246.200 was removed.  Page 5 of this checklist was changed to
 reflect this.

 Revision Checklist 29, page 1.  A paragraph has been added to the
 first page of this checklist to explain" that Revision Checklist
 46 supercedes it, and that there are many spelling and other
 errors in  the lists which were promulgated in the Federal
 Register addressed by Revision Checklist 29.  The Federal
 Register addressed by Checklist 46 makes these corrections.

 Revision Checklist 34,-page 1.  A paragraph has been added to the
 first page of this checklist to explain that several of the
 paragraphs which were delegable in this checklist are no longer
delegable, due to changes to the land disposal rul.es addressed by
Revision Checklist 39.  Footnotes have been added to those
sections which are no longer delegable.

     NOTE:   The  Agency is  solely responsible for granting a national capacity variance
     to  the  prohibition effective date under 268.32.   The procedures for granting case
     by  case extensions are found in 268.5.   Therefore,  states cannot be authorized for
     this  aspect of the program.  Similarly, variances under 268.42(b) and 268.44 for
     waste-specific variances  from a treatment standard  are not delegable to the
     states:  (Note:   268.44 is  not addressed by this  checklist, but is addressed by
     Revision  Checklist 34.   The~Federal  Register (November 4, 1986, FR 40572)
     addressed by Revision  Checklist 34 implied that  this section was aelegable.
     However,  the preamble  to  this present checklist  changed the delegability of this

     Under 268.6,  EPA  may grant  petitions of specific  duration to allow land disposal
     of  certain  hazardous wastes provided certain criteria are met.  States that have
     the authority to  impose land disposal  prohibitions  may ultimately be authorized
     under RCRA  Section  3006 to  grant petitions for such exemptions.  However, because
     the Agency  expects  few  such petitions,  EPA is currently requiring that these
     petitions be  handled at EPA headquarters.   (Note:   This is a change from the
     November  7,  1986,  FR 40572  addressed by Revision  Checklist 34.)

 Hi.   MANAGEMENT OF DIOXIN  WASTES

           from the disclosure requirements of the  Federal  FOIA,  5  U.S.C..552;

           regardless of whether any justification  or need  for such records  has
           been shown by the  requestor;

      (3)  The same types of  records would be available to  the public  from  the
           State as would be  available from EPA.  [In making this certification,

      (4)  Information is provided to  the public in substantially the  same

           Checklist "in Appendix D of  the SCRAM.  [Optional:  Where the  State
           agrees  to  implement selected  provisions  through  the use  o.f  a
           Memorandum of Agreement (MOA) the Attorney General  must  certify  that:
           "The State  has the authority  to enter into and carry out the  MOA
           provisions  and there are no State statutes (e.g., State
           Administrative Procedures Acts) which require notice and comment  or
           promulgation of regulations for the MOA  procedures  to  be binding.]

 NOTE:   The Administrator of EPA is responsible for granting national  variances  for
 the effective date of land disposal  prohibitions.   The procedures  for granting  the
 case-by-case extensions are in 40 CFR §268.5.   Since the granting  of  these
 variances is based on national concerns, States cannot be authorized  for this
 aspect of the program.   States should also note that a number of paragraphs
 addressed by this  checklist are superceded by  changes made in Revision Checklist
 39 (The California List, July 8, 1987, 52 FR 25760).  Additionally, the
 delega-bil ity of certain paragraphs have changed in that checklist.  Specifically,
 268.6, 268.42(b),  and 268.44 were made not delegable to the states.   Thus,  states
