Grant Funds.
Congress has appropriated additional RCRA grant
funds for FY 1986. The amount available is
$4.75 million. The funds will be awarded by the
Regions under the grant authority of §8001 of
RCRA, and are to be used for the development or
implementation of State or local hazardous waste
management efforts focused on waste reduction,
waste exchange, alternatives to land disposal
and assistance to small quantity generators.
Congress has specified the use of these funds.
The money is currently available. The awards
should be made as soon as possible to allow
maximum time for implementation.

As you know, Congress has again appropriated additional
RCRA grant funds for FY 1986. The amount available for award
is $4.75 million. However, due to the uncertainty associated
with the recently enacted Balanced Budget and Emergency Deficit
Control Act of 1985 (Gramm-Rudman provisions) the Agency will
not release these FY 1986 funds at this time. When we more
clearly understand the ramifications of these provisions and
are assured the funds will not be withdrawn, the Regions will
be notified and the funds will be released. We are issuing
this guidance and working toward revising the Delegations
Manual at this time in order to accelerate the grant awards
when, and if, the funds are released.
The $4.75 million is to be used for a variety of
activities not traditionally funded by the RCRA State grants
(see Attachment A). These funds will be awarded under the
grant authority of §8001 of RCRA.
The attached guidance document is essentially the same
as the one provided to you for the same purpose last year,
and contains:
0 a description of the approach that will be taken in
allocating and awarding funds;
0 a description of eligible activities; and
0 a discussion of the development and review of grant
applications.

GUIDANCE ON USE OF ADDITIONAL APPROPRIATION
FOR STATE AND LOCAL ACTIVITIES
PURPOSE
In FY 1986 S4.75 million is available for grants under $8001
of RCRA to support two types of activities:
0 To fund the development or implementation of State or
local hazardous waste management efforts not directly
permit-related but focused on innovative waste manage-
ment activities, such as waste reduction, waste
exchange, siting, use of alternatives to land disposal,
shared treatment, and assistance to small quantity
generators, which will reduce dependency on land
disposal.
e To accelerate issuance of permits to new or expanding
hazardous waste management facilities which would
provide alternatives to land disposal, thereby reducing
dependency on lana disposal.
ELIGIBLE GRANTEES
Grants will be awarded under RCRA $8001. Grant regulations
at 40 CFR Parts 29, 30 and 33 will apply. Awards need not be
limited to the State agencies receiving awards under RCRA §3011;
awards may be made to other State agencies. State universities,
sub-State government units such as cities or counties, or other
nonprofit entities. States may also receive awards with the
intention of passing funds through to local governments.
GRANT AMOUNTS AND MANAGEMENT
We will distribute the additional funds on a Regional basis,
using each Region's proportional share of the total FY 1986 RCRA
$3011 base grants as the basis for distribution (see attached
chart). The Regions will have the discretion to make individual
awards based on the needs and interests of the individual grant
applicants and their proposals for use of the funds. Grants
will be awarded and managed by the Regional Offices.
Through an expedited procedure, the Agency's Delegations
Manual is being revised to provide the Regional Administrators
with the authority to approve grants from these funds under
$8001 of RCRA. The previous delegation expired, as it applied
only to the FY 1985 additional appropriation. The delegation
must be reproposed to apply to the FY 1986 addition. OSWER
will ask the Comptroller to release the funds to the Regional
accounts as soon as the Delegation is approved.

The grants will be awarded with a 10% match requirement.
Grantees will be able to fulfill this requirement with cash or
with in-kind services.
ELIGIBLE ACTIVITIES
Grantees may conduct a variety of activities which would
satisfy the identified funding priorities. Some of the acti-
vities the Regions should seek to fund are:
0 conducting outreach or education activities in support
of the Agency's Small Business Initiatives to achieve
small quantity generator compliance with statutory and
regulatory requirements.
0 implementing a local or regional collection, transfer,
and transport system to handle wastes from small
quantity generators.
0 demonstration and analysis of potential regulatory and
nonregulatory roles for local or county governments
in achieving increased small quantity generator compli-
ance with the hazardous waste regulations.
analysis of generator waste streams to see whether
there is potential for on-site treatment to reduce
the volume or toxicity of the waste or potential
for reuse or recycling.
0 analysis of generator processes to see whether there
is potential for reduction in the volume or quantity
of waste generated.
0 targeting a particular industry or geographical area
for analysis of waste streams and processes to see
whether there is potential for shared treatment.
accelerated issuance of permits to innovative and new
or expanding hazardous waste management facilities
which would provide alternatives to land disposal.
0 targeting a particular industry, geographical area or
demographic situation for analysis of waste streams
and processes to see whether there is potential for
a waste exchange and, if practicable, setting up such
a program.
0 conducting public education activities centered around
specific siting projects.
0 conducting studies and analysis of potential sites for
alternative treatment facilities.

e conducting or sponsoring a conflict mediation program to
assist in siting facilities.
In developing proposals and selecting grantees, preference
should be given to applicants:
0 with experience in conducting such activities;
0 with well-developed, concrete proposals for implementing
a program or project (as opposed to developing or study-
ing as the major activity);
* with evidence of support and cooperation from the regulated
community for the proposed project.
HEADQUARTERS REVIEW
Proposals for projects related to implementation of the
small quantity generator provisions should be forwarded to
Eileen Claussen, Director, Characterization and Assessment
Division, for informal review prior to award. This review
will allow Headquarters to learn of the Region's plans for
the funds and ensure funding of projects that are innovative,
transferable and useful. The proposals need not be in the
form of completed grant applications at the time they are
forwarded to Headquarters.
Once the Regions have determined which applications will
be approved, they should send a description of each project to
Bruce Weddle, Director, Permits and State Programs Division.
These descriptions may be sent either prior to award or shortly
after award. Both the proposals for small quantity generator
activities and the project descriptions should, at a minimum,
include the following information:
0 A description of the overall project and of the
activities to be covered by the grant.
0 A workplan and schedule for the activities covered
by the grant.
* A list of specific outputs which will result from
the activities funded by the grant.
These descriptions will be compiled and distributed to all
Regions and to all grantees. Although the Conference report
did not specify a required report to Congress, these summaries
will be used if we should be asked for one at a later date.
Each grant should require that the grantee provide an
acceptable report at the end of the project period, describing
the activities and accomplishments under the grant. Development

of an acceptable report should be included as a required and
fundable task under the grant. Copies of these reports should
be sent to Bruce Weddle on completion.
