A. "~rA'-s P.cla In The Acquisition cf Interim Status
"i--ar. Cz.-.gress specified in Section 3GG5 cf P.C7.A that all
hazardous waste management facilities must obtain a permit, it
recognized that I?A would not be able to issue- permits to all
hazardous vasts management facilities befcra the Subtitle C
program beca.ta affective. Accordingly, Ccncress prcvided in
Sacticr. 30G5(a) ttat a facility s^etinc certain cor.citicr.s would
be treated as having teen issued a ce r-.it until final adrtinistra- '
tive action is takan cr. its permit application. T>.is statutorilv
conferred tar.pcrary authorization to cperats — cor.mcnlv refarrad
to as "interi." status" — is conditioned on a facility's r.eetinc
the following thrse recuire.tents :
1. Tna facility rsust have been in existence en
JTcvesicer 19^ 1930.
-
.
he aclt aust have cc-pliad with che Secton
3010(a) notification requirements.
3. The facilitv must have filed an act i ication for
a permit.
An essential feature cf "interim status" (and the source cf
most of the confusion within the Agency) is that, unlike a parmit,
i t is not granted or conferred by I? A. P.ather, i t is conferred
directly by statute. Any facility meeting the above three statu-
tory requirements qualifies for interim status. The only excep-
tion is where it can be shovn that final administrative disposi-
tion cf an application has not been made because the applicant
has failed to provide necessary information. See Section 3005(e).
This is not to say that Z?A plays no part whatsoever in the
acquisition of interim status by hazardous waste management
facilities. Cur role has, however, largely been confined to
interpreting the above statutory requirements and counseling
facilities en whether those requirements have been caet. In this
respect, we have performed tvc important f'unctions. First, we
have published regulations which clarify the requirements cf
Section 3005(«) — i.e., which define what it means to be a
facility "in existence" and ex-olain what is required to be included
in the permit application. Se-s, 40 CF?. SSI22.3*, 122.22, 122.22(a),
