United States Environmental Protection Agency Office of Solid Waste and Emergency Response Publication 9320.7-041 February 1992 4>EPA Background Information: National Priorities List, Proposed Rule Office of Emergency and Remedial Response Hazardous Site Evaluation Division (OS-230) Intermittent Bulletin Volume 2, Number 1 The U.S. Environmental Protection Agency (EPA) is proposing 30 sites to the National Priorities List (NPL) in a rule published in the Federal Register in early February 1992. The 30 sites in Proposed Rule #12 are in 17 States, Guam, and the Virgin Islands. California is proposing five new sites, followed by Pennsylvania with four. Adding the 22 sites proposed on July 29, 1991 (56 FR 35840) brings the number of proposed sites to 52. The number of final sites is 1,183 (reflecting the two deletions noted below), making a total of 1,235 final and proposed NPL sites - 1,111 in the General Superfund Section and 124 in the Federal Facilities Section.' EPA is not the lead agency at Federal facility sites, and its role at such sites is accordingly less extensive than at other sites in the General Superfund Section. Under Executive Order 12580 and CERCLA Section 120, each Federal agency is responsible for carrying out most response actions at (acuities under its own jurisdiction, custody, or control, although EPA is responsible for scoring Federal facility sites. The NPL identifies uncontrolled hazardous waste sites that warrant further investigation to determine if long-term "remedial action" is necessary. The sites on the General Superfund Section of the NPL are eligible for remedial action funded under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), enacted on December 11, 1980, as amended by the Superfund Amendments and Reauthorization Act (SARA), enacted on October 17, 1986. SARA authorized a "Hazardous Substances Superfund" totalling $8.5 billion over 5 years to pay costs for overseeing work by those responsible for cleaning up waste sites, and to pay costs not assumed by responsible parties for cleanup at sites in the General Superfund Section of the NPL. In October 1990, SARA was extended to September 30, 1994 to provide an additional $5.1 billion. The NPL also identifies sites where remedial construction activities have been completed but formal deletion is not yet appropriate. At present, 40 sites have been deleted from the NPL. When EPA activated the "Construction Completion" category on February 11, 1991 (56 FR 5634), it stated that the category would consist of sites awaiting deletion, sites awaiting the first 5-year review after the remedial action was completed, and sites undergoing long-term remedial action. EPA has decided to eliminate the 5-year review subcategory. On the basis of subsequent experience and analysis, EPA has determined that tying these two independent processes (5-year review and deletion) is unnecessary and potentially confusing (56 FR 66601, December 24, 1991). On January 16, 1992 (57 FR 1872), EPA added new sites to the category, bringing the total to 25 sites. Thus, 65 sites have been cleaned up or all remedial construction activities have been completed. All are in the General Superfund Section of the NPL. ------- This document provides background information on the proposed rule and the following lists: The distribution by State of the 30 new proposed sites The names and locations of the 30 sites The 40 sites deleted from the NPL because no further response is needed The 25 sites in the two Construction Completion categories of the NPL The 1,235 final and proposed NPL sites CONTENTS OF RULE Three sites in this proposed rule are subject to Subtitle C of the Resource Conservation and Recovery Act (RCRA). EPA's policy is, in general, not to place sites subject to RCRA Subtitle C corrective authorities on the NPL because the owners can be forced legally to take such action under RCRA. However, certain categories will be listed if EPA concludes that doing so best furthers the aims of the NPL/RCRA policy and the CERCLA program that is, cleaning up sites expeditiously while conserving CERCLA's limited resources. One of these categories includes facilities where owners have demonstrated an inability to finance corrective action by invoicing bankruptcy laws. Two sites in this proposed rule are in mis category: McCormick & Baxter Creosoting Co., Stockton, CA U.S. Smelter and Lead Refinery, Inc., East Chicago, IN One site in this proposed rule has "converter" status - that is, it once treated or stored Subtitle C hazardous waste but has since converted to generator only status. The site is: General Electric Co. /Shepherd Farm, East Flat Rock, NC All sites in this rule scored 28.50 or greater on the Hazard Ranking System (HRS), except for Austin Avenue Radiation Site, Delaware County, PA. It is proposed on the basis of Section 300.425(c)(3) of the National Contingency Plan (NCP), the Federal regulation by which CERCLA is implemented. Under this section, a site can be placed on the NPL if (1) the Agency for Toxic Substances and Disease Registry (ATSDR) of the U.S. Public Health Service has issued a public health advisory recommending that people be removed from the site, (2) EPA determines that the site poses a significant threat to public health, and (3) EPA anticipates that it will be more cost-effective to use its remedial authority (available only at NPL sites) than its emergency removal authority to respond to the site. On September 6, 1991, ATSDR issued a health advisory warning that the Austin Avenue Radiation Site poses a significant threat to public health because the site has no security, creating a potential for intruders to start a fire, which could spread radiation throughout the neighborhood. Three sites in this rule are being reproposed. They had been proposed previously on the basis of their scores on the original HRS. In response to comments, their scores fell to below the 28.50 cutoff. They are being reproposed at this time on the basis of their scores on the revised HRS. New information was used to evaluate the surface water pathway, which is scored differently under the two systems. The sites are: Concord Naval Weapons Station, Concord, CA GBF, Inc., Dump, Antioch, CA Richardson Flat Tailings, Summit County, UT EPA's policy is to place Federal facility sites on the NPL if they have an HRS score of 28.50 or greater, even if the Federal facility also is subject to the corrective action authorities of RCRA Subtitle C. In that way, those sites could be cleaned up under CERCLA, if appropriate. This proposed rule includes six Federal facility sites: Concord Naval Weapons Station, Concord, CA Jet Propulsion Laboratory (NASA), Pasadena, CA Andersen Air Force Base, Yigo, Guam Memphis Defense Depot, Memphis, TN Naval Service Weapons Center-Dahlgren, VA Naval Weapons Station-Yorktown, Yorktown, VA ------- DELETIONS Since the last NPL nilemaking (56 FR 48438, September 29, 1991), EPA has deleted these two sites from the General Superfund Section of the NPL (57 FR 355, January 6, 1992): John's Sludge Pond, Wichita, KS Beachwood/Berkley Wells, Berkley Township, "NJ NPL FORMAT CHANGES EPA has proposed to change how the NPL is presented in the Federal Register (56 FR 35840, July 29, 1991). In the past, the NPL was arranged by HRS scores and presented in groups of 50 sites. As the NPL has grown over the years, that format has made it increasingly difficult to find individual sites. Almost all public requests for the NPL ask for a list organized by State, rather than by site rank and score. Because the primary purpose of the NPL is to inform the public about sites that are of sufficient concern to warrant further investigation under Superfund, EPA proposes to organize the NPL in a format similar to that used here for proposed sites. The NPL will organize sites by State rather than in, ranked groups. The NPL will also provide other information such as whether a site is a Federal facility. EPA has requested comment on the proposed format. EPA is considering the comments received and will announce its decision in the first final rule under the revised HRS.
