United States Environmental Protection Agency Office of Solid Waste and Emergency Response Publication 9320.7-041 January 1994 Background Information: National Priorities List, Proposed Rule Office of Emergency and Remedial Response Hazardous Site Evaluation Division (5204G) Intermittent Bulletin Volume 3, Number 3 The U.S. Environmental Protection Agency (EPA) is proposing 26 sites to the National Priorities List (NPL) in a rule published in the Federal Register in January 1994. Of the 26 sites in Proposed Rule #16, 16 are in the General Superfund Section and 10 in the Federal Facilities Section. The sites are in 18 States. Utah is proposing three sites; California, Florida, Michigan, Ohio, Pennsylvania, and Tennessee are proposing two sites; a number of States are proposing one site. The status of the NPL (reflecting three site actions described later) is as follows: General Federal Total Proposed Proposed Rule #16 Previously Proposed Final Proposed Plus Final 67 (16) (51) 1,069 30 (10) (20) 97 123 1,192 1,289 EPA is not the lead agency at Federal facility sites, and its role at such sites is accordingly less extensive than at sites in'the General Superfund Section. Under Executive Order 12580 and CERCLA Section 120, each Federal agency is responsible for carrying out most response actions at facilities under its own jurisdiction, custody, or control, although EPA is responsible for scoring Federal facility sites. The NPL identifies uncontrolled hazardous waste sites that warrant further investigation to determine if long-term "remedial action" is necessary. The sites in the General Superfund Section of the NPL are eligible for remedial action funded under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), enacted on December 11, 1980, as amended by the Superfund Amendments and Reauthorization Act (SARA), enacted on October 17, 1986. SARA authorized a "Hazardous Substances Superfund" totalling $8.5 billion over 5 years to pay costs for overseeing work by those responsible for cleaning up waste sites, and to pay costs not assumed by responsible parties for cleanup at sites in the General Superfund Section of the NPL. In October 1990, SARA was extended to September 30, 1994 to provide an additional $5.1 billion. EPA's goals for the Superfund program are to: • Address the worst sites and the worst problems first • Make sites safe by immediately controlling acute threats to people and the environment • Develop and use new technologies for more effective cleanups EPA continually seeks ways to evaluate and clean up sites more quickly. The new "Superfund Accelerated Cleanup Model" (SACM) involves several pilot projects aimed at streamlining the Superfund process. EPA will describe any changes to the process resulting from SACM as they are identified. ------- This document provides background information on the rule and two lists: • The names and locations of the 26 new Proposed Rule #16 sites • The 1,289 final and proposed NPL sites by state CONTENTS OF RULE Three sites in this rule are proposed based on the Agency for Toxic Substances and Disease Registry (ATSDR) Health Advisories; • Raymark Industries, Inc., Stratford, CT • Lower Ecorse Creek Dump, Wyandotte, MI • Tennessee Products, Chattanooga, TN Under this listing mechanism, included in the NCP at 40 CFR 300.425(c)(3), certain sites can be listed whether or not they score above 28.50, if the following conditions are met: • The ATSDR of the U.S. Public Health Service has issued a health advisory that recommends dissociation of individuals from the release. • EPA determines that the release poses a significant threat to public health. • EPA anticipates that it will be more cost- effective to use its remedial authority than to use its removal authority to respond to the release. One site in this rule is proposed based on State designation as top priority: • Boomsnub/Airco, Vancouver, WA Under this listing mechanism, each State may designate a single site as its top priority, regardless of the HRS score. This mechanism, provided by the NCP at 40 CFR 300.425(c)(2), requires that, to the extent practicable, the NPL include within the 100 highest priorities, one facility designated by each State representing the greatest danger to public health, welfare, or the environment among known facilities in the State. One site in this rule may be subject to Subtitle C of the Resource Conservation and Recovery Act (RCRA). The site is being proposed based on ATSDR health advisory criteria. EPA's policy is, in general, not to place sites subject to RCRA Subtitle C corrective action authorities on the NPL because the owners can be forced legally to take such action under RCRA. However, certain categories will be listed if EPA concludes that doing so best furthers the aims of the NPL/RCRA policy and the CERCLA program - that is, cleaning up sites expeditiously while conserving CERCLA's fixed resources. One of these categories includes deferrals. The proposed site in this category was formerly operated as a hazardous waste generator and land disposal facility The site is a RCRA Subtitle C regulated facility which has initiated bankruptcy proceedings. Listing this site on the NPL is consistent with EPA's NPL/RCRA deferral policy. The site in this category is: • Raymark Industries Inc., Stratford, CT Except for the three sites proposed based on ATSDR Health Advisory criteria and the one designated as a State top priority, all sites in this rule scored 28.50 or greater on the Hazard Ranking System (HRS). EPA's policy is to place Federal facility sites on the NPL if they have an HRS score of 28.50 or greater, even if the Federal facility also is subject to the corrective action authorities of RCRA Subtitle C. In that way, those sites could be cleaned up under CERCLA, if appropriate. This rule includes 10 Federal facility sites. EPA emphasizes that designating a site as Federal or non-Federal has no legal significance and is purely informational in nature. Such designation does not determine, or limit, the extent of any Federal agency's obligations under CERCLA Section 120. EPA solicits comments on the most appropriate designation of the site. EPA proposes to change the name of one previously proposed site: • Schofield Barracks, Oahu, HI, is to be renamed Schofield Barracks/Wheeler Army Airfield. EPA believes this name more accurately reflects the site and solicits comment on this proposed name change. ------- OTHER SITE ACTIONS ADDITIONAL PUBLICATIONS At the time of the last proposed rule (58 FR 34018, June 23, 1993), 1,199 sites were on the final NPL. Since then, the number has been reduced to 1,192. Six sites were deleted because no further response is required to protect human health and the environment. EPA has developed the Construction Completion List (CCL) (58 FR 12142, March 2, 1993) to better show the successful completion of Superfund response action at present or former NPL sites. The CCL is intended to enhance public understanding of the status of cleanup progress at sites. The CCL now totals 217 sites, all but 1 from the General Superfund Section. Cleanups at sites on the NPL do not reflect the total picture of Superfund accomplishments. As of November 1993, EPA had conducted 2,325 removal actions, 591 of them at NPL sites.
