     In your June 25,  1982 memo, you have asked that Headquarters
concur on your draft response to Pennsylvania's questions re-
garding the Interface  of State and EPA "delist1ngs" and U.S.
Department of Transportation  (DOT) requirements.   In response to
your request, we have  developed a response to DER which is similar
to your "draft" response.  However, you will note that our response
does differ from yours because the Federal Register statement
regarding applicability of Federal delistings 1_s correct  (46 FR
6123, third column)'.

     We also included  some statements which express our under-
standing of the HOT rules.  Pennsylvania may wish to conftna
these statements with  DOT since any interpretation of their
regulations should be  supplied by DOT, not EPA.          '  -

     As you will note  on the attached copy of the "surname""sheet,
the appropriate program managers in the Office of Solid Haste
have concurred on this response.  OSW recommends sending  the
attached to Pennsylvania's DER.
