SUBJECT: Submission of Waste Minimization Information.

As part of the Agency's ongoing oversight activities, the
Regional Offices should verify that waste minimiz'ation information
required by Section 3002(a)(6) of RCRA and 40 CFR 262.41(a)(6) &
(7) is being submitted to either EPA or authorized States. This
information was due on March 1, 1986, the scheduled biennial
report date. In our view it is acceptable for the generator to
have submitted the information to either the State or the Region.
If a generator has not complied with these waste minimization
requirements, then appropriate enforcement action should be
initiated.
By October 1, 1986, EPA must report to Congress on the
desirability and feasibility of establishing standards of per-
formance, or of taking additional action under RCRA to reduce the
quantity and/or toxicity of the hazardous waste generated. As
part of this effort, EPA is also required to evaluate possible
changes to the current biennial reporting requirements for waste
minimization. In order to accomplish this task, the Office of
Solid Waste (OSW) is planning to review the content of the nar-
rative waste minimization statements to determine whether a
change in the current reporting requirements is desirable and
feasible. OSW will evaluate the waste minimization statements
to determine whether to change the reporting requirement to:
(1) further assist generators in completing the statement; (2)
provide greater consistency in data collection; and (3) enhance
the quality of the generator biennial report.
We need your assistance in this endeavor. Please send us a
copy of the waste minimization statement contained in each bien-
nial report. This information should be sent to James R. Berlow,
Manager of the Treatment, Recycling, and Reduction Program
(WH-562A), no later than August 15, 1986. If you should have any
