Dear Mr. Mantheyt

     This is in response to your letter of August 30, 1985,
which concerned the balking mad consolidating of compatible
vastes vith different EPA hazardous vast* codas.  lf« recognize
that transporters sonatinas pick up vasts froa several generators
in order to send full loads to treatment, storage, and disposal
facilities.  .These transporters also Bay consolidate different
bulk vasta shipments•in a tank truck or pump the contents of
drums containing different EPA vasts codes into a single tank
truck.  Ton asksd whether this method of handling hazardous
vasts constitutss treatment.  Zt is our interpretation that
incidental changes in the characteristics of the vasts that
occur froa consolidating shipments going to treataent* storage*
and disposal facilitiss for handling under ICRA regulations
vould not be considered treataent*

     Treataent as defined in I26O.10 •means any method, technique,
or process...designed to change the physical, chemical, or bio-
logical character or composition of any hazardous vasts ... to
render such vasts non-hazardous, or less hazardous; safsr to
transport* store, or dispose of....*  Mixing listsd vasts does
not render the vastes non-hazardous (40 CPU '261.3 (c) and (d)).
Mixing hazardous vasts that is identified in 40 CPU 261 Subpart C
on the basis of characteristics renders the vasts non-hazardous
if the vaste no longer exhibits those characteristics after
mixing (40 CFR 261.3(d)(l)).

     Although characteristic vastes aixsd by transporters may
exhibit fever hazards, this incidental reduction of hazard
is not considered treatment if the vastes are still sent to

treatment, storage* or disposal facilities.  The basis of
this interpretation ia found la the definition of treatment
la Section 1004 of tho Bssardous and Solid waste Amendments,
which states! •...'traatmont'.«.includes any activity or pro-
