Implementation Strategy
For The Clean Air Act
Amendments Of 1990
Update, November 1994
INTRODUCTION
This is the fifth in a series of Implementation
Strategy documents issued to inform Congress
and the public on the status of activities
implementing the Clean Air Act Amendments
of 1990. The paragraphs immediately
following present the highlights of recent
activities. The remainder of the document
consists of a cumulative list of significant
actions already taken to carry out the 1990
Amendments, as well as a two year projection
of future activities.
The release of this strategy closely follows the
release of an annual EPA report titled
"National Air Quality and Emissions Trends -
1993." The purpose of the Trends report is to
show air quality and emissions over the last
ten years for all six "criteria" air pollutants,
those pollutants for which EPA has
established health-based national ambient air
quality standards (NAAQS).
The Trends report documents the fact that
national air quality is continuing to show
impressive gains. In fact, 1993 was the best air
quality year of the last ten years for five of the
six criteria pollutants (sulfur dioxide, lead,
carbon monoxide, nitrogen dioxide,
particulate matter [PM10],) and despite above
average temperatures in the eastern half of the
country, the second best for ozone. These air
quality improvements - the direct benefits of
effective implementation of clean air laws and
regulations - mean that nearly 43 million
Americans who lived in nonattainment areas
in 1991 now live in areas which have not
violated any air quality health standards in
the last three years.
At the same time, almost 100 million
Americans continue to live in areas which
have violated at least one of the health
standards within the last three years. In short,
effective implementation must continue if we
are to finally achieve the promises of the Clean
Air Act Amendments of 1990 for all
Americans.
RECENT HIGHLIGHTS
EPA continues to press forward on proposing
and finalizing Clean Air Act rules in every
area. Among the highlights of recent activities
are the following:
Attainment of Air Quality Standards
Air quality data for 1993 show that 48 of 98
ozone areas and 28 of 42 carbon monoxide
areas now have air quality in line with
national health standards. Many of these
areas have formally submitted redesignation
requests, and seven areas have already been
formally redesignated.
Responding to a petition from the Ozone
Transport Commission, EPA joined with
states, automakers, environmentalists and
others to focus on the development of a
comprehensive low emission vehicle program.

EPA also joined with the Ozone Transport
Commission to move forward on limits for
NOx emissions from power plants in the
Northeast. The approach agreed upon
through a memorandum of understanding
among the OTC states will result in a 65% to
70% reduction in NOx emissions in the
Northeast by 2003.
Air Toxics Control
After a slow start, EPA continued to make
progress on meeting the goal of issuing
standards for 25% of all hazardous air
pollutant source categories by November 15,
1994. The result is that more standards have
been issued in the last two years than in the
previous twenty-two year history of the Clean
Air Act. Final rules were issued controlling
toxic air emissions from industrial cooling
towers, chromium electroplating operations,
commercial sterilizers, degreasing operations,
gasoline marketing operations, and magnetic
tape coating manufacturers.
A rule was proposed through which
emissions from municipal waste incinerators
will be drastically cut. These incinerators are
the largest known source of dioxin emissions
to the air, and the rule will result in a 98%
reduction in dioxin releases.
Rules were also proposed for controlling
toxic air emissions from secondary lead
smelters, petroleum refineries, aerospace
manufacturing, offsite waste and recovery
operations, and wood furniture
manufacturing.
The Great Waters Report was issued
documenting air toxics deposition issues for
water bodies like the Chesapeake Bay, the
Great Lakes and coastal waters. The report
will be used to assess the need for further
regulation of certain air toxics source
categories.
Control of Emissions from Vehicles and Fuels
EPA has taken a number of actions to
address for the first time emissions from
nonroad engines and equipment. These
actions include the following:
In May we proposed exhaust emission
standards for small gasoline engines used in
lawn and garden equipment. These
standards, which are proposed to take effect
on engines produced after August 1996, will
reduce VOC emissions by 32% and CO by 14%
compared to equipment in use today. The 89
million pieces of lawn and garden equipment
in the U.S. now emit about 5% of total VOC
emissions.
Also in May, we issued final regulations to
reduce NOx emissions from large diesel
engines used in nonroad construction and
farm equipment. These standards will result
in NOx reductions of 37% per engine when
they go into effect in 1996. These engines
currently contribute over 9% of total national
NOx emissions from all sources.
In late October we issued proposed
standards to control emissions from marine
pleasure craft, such as outboard motors. The
proposed standards would begin phasing in
with engines produced in 1998 and would
reduce VOC emissions from gasoline
outboard and personal watercraft engines by
about 75%. They would reduce NOx
emissions from diesel marine engines by
about 37%.
Other mobile-source actions include the
following:
In May we issued final rules establishing
procedures to test for potential health effects
of existing and new motor vehicle fuels and
fuel additives.

In June we issued final rules which
established for the first time emission
standards for gaseous fueled motor vehicles
(e.g., natural gas, propane).
In October we issued interim regulations
requiring that all gasoline sold in the U.S.
contain deposit-reducing detergents
beginning in January 1995.
Atmospheric Programs
All Acid Rain Program Phase I permits for
sulfur dioxide and nitrogen oxides have now
been issued, and 95% of all Phase I continuous
monitor systems have been certified.
Four new Methane control programs were
launched - Landfill, and Coalbed Methane
Outreach, Agstar, and Ruminant Livestock
Methane programs. These voluntary efforts
encourage reductions of methane (a
greenhouse gas) from several livestock
industries, coal mining, natural gas and
landfill gas recovery operations.
Carbon dioxide emissions (a greenhouse gas)
were targeted with the kickoff of the Energy
Star Showcase Buildings Program, an effort to
accelerate energy efficiency upgrades in 25
charter buildings. These voluntary showcase
upgrades will be complete in one year and are
targeting a 40% reduction in energy usage.
Future Activities
As the list in the next section shows, EPA has
made great progress in carrying out the Clean
Air Act. However, much remains to be done if
the Act's health and environmental goals are
to be achieved. EPA must issue dozens of
additional regulations, guidance documents,
and studies and reports over the next several
years. The largest group of remaining
rulemakings will be those controlling air-
toxics emissions. Other significant actions will
include final rulemakings on emissions
standards for non-road engines, emissions
standards for municipal and medical waste
combustion, enhanced emissions monitoring,
Federal operating permits, and new-source
review simplification. The Agency also must
accelerate and expand a host of activities to
ensure that EPA and states are implementing
and enforcing the Act effectively. For
example, EPA must assess hundreds of SIP
revisions, as well as 120 state and local permit
programs, and provide technical assistance to
states and sources. The list following this
section shows most of the significant actions
expected within the next two years.
As Clean Air Act implementation enters the
critical phase of State implementation, the
issue of timeliness takes on new importance.
This Administration is aware of how
important it is to get the Federal framework
right, and to provide the right kind of
guidance and support to the states. We also
understand how important timeliness is to the
states: the gridlock of the past has already
delayed key Federal elements far too long.
Over the past two years, we have broken the
regulatory gridlock in a number of areas
critical to providing states the necessary
support, and we intend to do an even better
job in the future, so that states and industries
will have the information they need, when
they need it, to plan for compliance in the
most effective way.
One key element the states need in crafting
effective, efficient compliance program is the
flexibility to use market-based methods in
ways that reduce costs while assuring that the
environmental goals are met. One of the
principal themes of this Administration is that
a healthy environment and a strong economy
are not only compatible but essential to each
other, and that the appropriate use of market-
based regulatory approaches can enhance this
compatibility by providing flexibility and
incentives for technological innovation. The
acid rain program, which will achieve its first
emissions reductions in January 1995, is the
flagship program in this area, and is already

widely viewed as the model for market-based
environmental programs both here and
overseas. The lessons learned in that program
were generalized in the economic incentives
rule, which shows states and industries how
to make wider use of incentive-based
approaches that encourage advanced
technologies that both save money and make
it possible to get more environmental results.
The experience gained in both these programs
was put to further use by providing assistance
to the California South Coast Air Quality
Management District to establish an
innovative NOx trading program for smog
control; this program is being closely watched
as a possible model for other areas. We intend
to continue making the use of such
approaches a centrally important tool in
helping the states plan for meeting the
ambitious goals of the Clean Air Act. We
believe that the combination of flexibility and
timeliness of Federal support will prove to be
the twin keys to success as the implementation
of the Clean Air Act enters this next, critical
stage.
