These programs are managed by the Registration Division, Office of Pesticide Programs, Office of Pesticides and Toxic Substances, Environmental Protection Agency (EPA). This listing is intended to give the dates and status of a chemical and is updated annually. Users of this document are encouraged to contact the appropriate PM or Branch Chief, as noted, if they have any questions or corrections regarding the entries in this listing. Sections of the law referred to in this document are from the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) as amended 7 U.S.C. Section 136. All chemicals are listed by the names under which they were or are being reviewed. Other widely used common or chemical names may also appear in the Index. SPECIAL REVIEW PROCESS On November 27, 1985, the Agency promulgated a final rule which sets forth new criteria for the initiation of a Special Review. These criteria asure that the determination of whether or not a pesticide poses an unreasonable risk will be based both on the toxic effects associated with the pesticide and the actual or projected exposure of humans and nontarget organisms to the pesticide. ------- The criteria for initiating a Special Review of pesticide uses include: 1. Acute toxicity to humans or domestic animals. 2. The potential of adverse chronic effects in humans. 3. Hazards to nontarget organisms. 4. Separate criteria for hazards to threatened or endangered species. 5. An "other adverse effects" criterion which would permit the Agency to initiate a Special Review in circumstances where potential risks may not be anticipated by the specific criteria. When the Agency concludes tentatively that effects data, together with preliminary information on exposure, indicate that a risk criterion may have been met, registrants receive private notification that the Agency is considering issuing a Notice of Special Review. Issuance of the private notification will be deemed to be the commencement of the pre-Special Review phase of the process. The registrant has 30 days to dispute the validity of the Agency's conclusions. If, after notification to the registrants, the Agency tentatively determines that use of the pesticide does not pose a significant risk, a Federal Register notice is issued which explains the Agency's determination that the use of the pesticide does not pose a significant risk. This notice also announces the availability of the public docket, which includes the pre-Special Review notification and all written information received in response to the noti- fication. The notice will also solicit public comment on the Agency's determination. Following the public comment period, the Agency will make a final decision whether to initiate a Special Review. If the Agency determines that a significant risk may be associated with a pesticide use, a Notice of Special Review will be published in the Federal Register. This notice describes the Agency's reasons for the determination of significantrisk,the assumptions and data used in the analysis, the nature and strength of the conclusions, and will announce the availability of the pre-Special Review docket. The Notice will also solicit public comment and request additional information on the pesticide. If the Agency determines that a pesticide may pose a significant risk and decides to initiate the Special Review process, a Current Benefits Review is also initiated. After the Notice of Special Review is issued, the Agency may meet with interested parties to discuss the Agency's risk concerns and available options to reduce the potential risk to health or the environment. The Agency will conduct a comprehensive Risk/Benefit analysis of each use of the pesticide ii ------- which is subject to Special Review. Potential risks are evaluated by considering factors such as: --the nature of any adverse effect; --the magnitude of exposure of humans and other nontarget organisms; and —the size of the population at risk. The benefits of use are also evaluated by including the availability, efficacy, and cost of alternative control methods. If the registrants voluntarily amend their registrations in a manner which would reduce the risks associated with continued use to acceptable levels, a Notice of Preliminary Determination is published in the Federal Register describing the Agency's previous risk concerns and giving the basis for the Agency's proposed voluntary resolution of these concerns. If the registrants have not offered voluntarily to amend the terms and conditions of registration in a manner which would reduce the risks to an acceptable level, the Agency will issue a Notice of Preliminary Determination setting forth regulatory measures necessary to reduce risks to an acceptable level and a proposed notice of intent to cancel, deny, or reclassify registration implementing these measures. The Agency will issue its preliminary determination for publica- tion in the Federal Register and provide an opportunity for public comment. If the Agency proposed to issue a cancellation, denial, or reclassification notice, that pro- posal is submitted to the Scientific Advisory Panel (SAP) for comment on the Agency's scien- tific rationale. At the same time, the Agency submits the proposed notice to the United States Department of Agriculture (USDA) for comment, especially on the benefits issues and agricultural impacts. After evaluating all comments received from the USDA, the SAP, and the public on the proposed action, the Agency will modify the proposal where appropriate prior to issuance as a final action. A Notice of Final Determination is published in the Federal Register, along with a Notice of Intent to Cancel, Deny, or Reclassify Registration if required to implement the determination. Any such notice becomes effective by operation of law unless the registrant makes the necessary corrections or a hearing is timely requested by a person adversely affected by the notice. REGISTRATION STANDARDS The Registration Standards program is EPA's approach to the reassessment and rereglstra- tion of pesticide products as mandated by Congress in PIPRA Section 3 (g). The reassessment involves a thorough review of the scientific data base underlying pesticide registrations and an identification of essential but missing scientific studies which may not have been required when the product was initially registered. It may also require new testing or retesting to ensure the safety of the compound by contemporary scientific standards. ill ------- The standards process involves making broad regulatory decisions at one time for a group of pesticide products containing the same active ingredient, rather than on a product-by- product basis. About 600 active ingredients, representing 48,139 currently-registered products could potentially require Registration Standard review. However, given assump- tions about chemicals not requiring review due to voluntary cancellations, suspensions, and other reasons, the actual number of standards to be developed is substantially less than that. This approach to reregistration is intended to simplify and streamline the regulatory process for both the Agency and pesticide registrants and to assure the public that all registrations are supported by a complete and valid scientific data base. To establish the sequence of processing the approximate 600 active ingredients through the Registration Standard review, active ingredients that have similar use(s) have been clustered into 48 groups. The groups are being processed in a sequence resulting from their ranking in an equation based on production, human exposure, and ecological exposure factors. The ranking scheme was developed based on consideration of market competition, availability of in-depth data on alternatives should the need for a Special Review arise, and efficient use of EPA resources. Each standard explains EPA's regulatory position on the use of the active ingredient in all pesticide products containing that same chemical. The standard contains an analysis of the data on which the regulatory position is based, describes the rationale for the regulatory position, and states the conditions that must be met to obtain pesticide product registration. The relationship of the Registration Standards process with the Special Review process is that if the analysis of the data shows that a Special Review criterion has been met, then the standard is issued announcing that a Special Review will be initiated for some or all of the uses of the chemical and a proposed regulatory decision will be issued. Registration Standards are developed in three phases: (1) Data Gathering, (2) Data Evaluation, and (3) Regulatory Position Development followed by the issuance of the Registration Standard Guidance Package. For convenience, phases 2 and 3 are combined in this report and the issued documents are identified separately in the attached listing. (1) Data Gathering; The bibliography consists of all data in Agency files pertaining to the chemical,exceptEhat in most cases efficacy data are not listed. The bibliography will also include any government studies (such as NCI studies) which have been conducted on the chemical and other relevant material identified by Agency scientists. Agency scientists identify which studies should be reviewed; after which, hard copy of all requested studies are retrieved from Agency files and provided to Agency scientists for review. The data gathering phase lasts about five months. iv ------- Once the data-gathering phase is completed, and the use information is developed, the data evaluation phase is ready to begin. (2) Data Evaluation; At the onset of the Data Evaluation phase, the Project Support Team, which consists of all Agency staff involved in the Registration Standard review (Regis- tration/reregistration Product Manager, use experts, data retrieval experts, and Agency scientists) meet to exchange information regarding the chemical from a regulatory and scientific perspective. This meeting is designed to provide a context in which the scien- tists conduct their review. Knowledge of the regulatory history, the growth patterns of the chemical's use, general understanding of the completeness of the data base, and discussion of any past regulatory/health problems will help focus the review and increase the scientists' effectiveness. With this perspective, scientists review data in each of five disciplines: product chemistry, environmental fate, residue chemistry, toxicology, and ecological effects. Efficacy data are reviewed only for products which control infectious microorganisms and the growth of aflatoxins. The scientists document their review of each study which they consider relevant, prepare a summary of what is known about the chemical in their respective discipline. Scientists also identify gaps in the data base which should be filled to enable a complete scientific assessment to be made. While the 40 CFR Part 158 guidelines* (currently proposed) are used as guidance to make the determination of data gaps, each chemical is reviewed individually to determine, given its particular use patterns and what is already nown about it, what additional data are needed. If the resulting data needs differ from those in the Guidelines, the scientist provides written justification for the deviation. Depending on the size of the data base involved in the review, this phase usually lasts from six to ten months. (3) Development of Regulatory Position and Issuance of Guidance Package; Once the Science reviewis completed and scientists haverecommended which additional data they believe are necessary to complete the review, the Project Support Team reconvenes to identify the appropriate regulatory position for the chemical (that is, what percent active ingredient, formulations, uses, etc. are registrable under the Standard and whether regulatory restrictions such as label warnings or use by certified applicators only are required). They also develop the rationale for the regulatory position and determine the data requirements which need to be imposed to complete the review. Included in this phase is the tolerance reassessment which may result in the initiation of rulemaking to increase or decrease tolerance levels. A document summarizing these findings, including the proposed regulatory position and rationale, data requirements, scientific summaries, and bibliography, is then circulated to support team members and Agency management for review. 'See p. vi for specific citation. ------- After the document Is approved, study reviews and science summaries are placed in Agency records for retrieval during subsequent reviews of the chemical (e.g., registration amendments) as their availability is expected to expedite the processing of future reviews. Copies of the study reviews and the science summaries are available through OPP's Freedom of Information Section. The regulatory position/rationale, data requirements, and. bibliography are sent to the registrant In a document known as a Guidance Package which cites the authority of Section 3(c)(2)(B) and Section 3 (g) of FIPRA. Reregistration occurs when the registrant agrees to comply with the data requirements, submits an updated Confidential Statement of Formula if needed, agrees to comply with any regulatory restrictions placed on the chemical, agrees to compensate other registrants for data considered relevant to the Standard, and provides labelling reflecting completion of any product chemistry and acute toxicity data requirements. Issuance of the Standard; The standard is issued to the registrants and made available to the public through the National Technical Information Service, 5285 Port Royal Road, Springfield, VA 22152, telephone 703-487-4650. THE DATA CALL-IN PROGRAM The Data Call-in Program requires existing registrants of active pesticide chemicals to provide the Agency with needed studies under Section 3(c)(2)(B) of FIFRA. Such studies, including chronic toxicology, product chemistry, residue and environmental fate data are an integral part of the data base used .to reassess each chemical during the reregistration process or to resolve special concerns such as whether the chemical enters groundwaters. The purpose of Data Call-in is to assure that these data are available or well underway before the pesticide chemical is reassessed for reregistration under Section 3(g) or other purposes. The four types of long-term toxlcological data which have been traditionally requested consist of Chronic Feeding, Oncogenicity, Reproduction and Teratogenicity (informally referred to as the CORT studies). These studies are described in the Toxicology Data Requirements' part of the "Pesticide Registration: Proposed Data Requirements" regulation.* The product chemistry, residue, and environmental fate studies are also described in this regulation. *The Pesticide Registration Guidelines were reproposed as Part 158, 40 CFR on November 24, 1982, in 47 Federal Register 53192. vi ------- Under the Data Call-in Program, the Agency: (1) determines which types of data are required for each chemical, based on its use patterns and other factors; (2) identifies those test categories with no valid data submitted; and (3) ensures that studies are initiated by registrants of the pesticide to fill those data gaps. In general, the sequence of processing the active ingredients through the Data Call-in Process is based on the priority cluster ranking in which active ingredients that have a similar use(s) are clustered into about 50 groups and the groups are processed in sequence. A notice of the availability of the final cluster ranking was published in the Federal Register, *»7 PR 3770, January 24, 1982. The cluster ranking is not followed when special concerns arise about a chemical or a particular group of chemicals. During PY 85, the program will be focused on processing the remaining food-use chemicals. In each Notice, the registrant can request the Agency to exempt or waive any or all of the specified data requirements. Registrants may request changes of or exemptions from the data requirements because: 1. They believe they are a formulator or end-user. 2. They determine that their chemical involves only minor exposure and production. In addition, registrants may cite economic factors as precluding its capacity to incur the costs of testing. 3. They wish to remove all registered uses which Involve food crops/products and/or significant repeated exposure to humans and the environment. 4. They believe the data requirements do not apply to the registered uses of their product(s). If the Agency does not grant the change(s) or exemption(s), the registrants must arrange to comply with the Notice. If a registrant does not respond or comply with the Data Call-in Notice, the Agency issues an Administrative Notice (NOIS-Notice Of Intent to ^Suspend) compelling the registrant to stop distributing the particular pesticide product(s) until compliance with the Notice occurs. The actual effect of a NOIS is to put a registration "on hold" until such time as the registrant wishes to comply with the notice and make his registration active. Any such NOIS issued under Section 3(c)(2)(B) is rescinded when the Agency is informed and agrees that compliance occurs. Such NOIS's never, independently, result in cancellations and are therefore clearly different from the PIPRA Section 6 suspensions which can later become cancellations and cause the withdrawal of pesticide products from the market. This report gives the status of chemicals and clusters being processed through Data Call-in. The status includes whether a Notice or equivalent has been issued and whether the Agency has reached a final decision on all the waivers, exemptions, cancellations, commitments and offers received from registrants. vii ------- OTHER REGISTRATION ACTIVITIES* Included for the first time in this report are registration activities that have previously been included in the Registraton Division's FY Annual Report; thus, the reporting period for these registration activities is 10/1/86 through 9/30/87. The activities included are: Pesticide Program Accomplishments; Pesticide Program Final Decisions; New Chemicals Regis- tered; Number of Active Registrations; Tolerances for Regional Registrations; and Genetically Altered and Nonindigenous Microbial Pesticides. (1) Pesticide Program Accomplishments (PPAs) in FY 87; At the end of FY 87, the Old Chemical, Amendment,New Use and Emergency Exemption PPAs had exceeded the Integrated Work Plan End of Year accomplishments target. The decline in receipts in the New Chemical, Experimental Use Permit (EUP), Temporary Tolerance, Tolerance and Inert PPAs accounted for, in large measure, their shortfall against target accomplishments. The New Biochemical and Special Local Need (SLN) targets were higher than actual receipts. The average turnaround time for completion of application reviews exceeded the target in the New Chemical, Old Chemical, EUP, Temporary Tolerance and Inert PPAs. (Refer to the table under this caption.) (2) Strategic Planning and Management System (SPMS) Accomplishments in FY 87; These are Agency measures andinclude only the Final Decisionforeach activeingredient, product or application as appropriate. This decision could be one of registration, conditional regis- tration, withdrawal, denial, granting, or issuing. (Refer to the table under this caption). (3) New Chemicals Registered in FY 87; A.total of nine new chemicals were registered between 10/1/86 and 9/30/87.(Refer to the table under this caption.) (4) Number of Active Registrations; The number of products registered under FIFRA stands at 48,139 as of 9/30/87.(Refer to the table under this caption.) (5) Tolerances Established for Regional Registrations Issued in FY 87; Tolerances for regional registrations are usually established underthe auspicesofthe IR-4 Minor Use program. The IR-4 Minor Use program which is supported by USDA provides natonal leadership, coordination, and a focal point for pesticide clearance of commodities that do not offer an adequate monetary incentive for the pesticide industry to pursue the necessary tolerances on their own. The regional registrations are those that are limited to specific geographic areas, usually involving one or a few states. (Refer to the table under this caption.) *Thissection,"OtherRegistration Activities" during prior years had previously been included in the Registration Division's Annual Report. These clusters are the same as described in the Federal Register notice on November 14, 1980 (45 FR 75488) follows: An explanation of terms used to describethe status of a chemical is as "Letter issued (date)": The notice/notification or equivalent was issued to indicate existing chronic data gaps. "Decision reached": The Agency has evaluated all the responses from registrants reques- ting exemptions, waivers, commitments, offers to cost share, cancel- lations, suspensions, etc. and has issued final decisions on the data required and status of all registrations containing the chemical. The terms "chronic data being generated" or "chronic data waiver or defer- ral" are self explanatory. "Chronic data base complete" may mean that the data were available, recently submitted, or certain data require- ments have been waived. The terms "cancelled", "suspended", and "no current registrations" mean that there are no known active registra- tions of the chemicals. The term "Defer requirements to Standard" means that the standard is planned to be developed within two years hence and the chronic requirements will be addressed in the standard.
