FOREWORD
Under a series of documents exchange agreements with environmental
agencies in other countries, EPA is building a collection of
environmental reports issued by foreign governments and international
organizations. This is the seventh in a series of announcements of
foreign documents received.
The original documents can be obtained through the Library Systems
Branch (see back page for order form). More detailed English
abstracts can be provided when required. Full text translations,
which are expensive, sffould be requested only when essential for
operation of EPA programs. Translation Services Requisition Form
#1350-1 is used to request translations.
A computerized search system is being developed which will allow

This series, which is devoted to summaries of government reports
and concentrated on the legislative, economic and social aspects,
supplements foreign scientific and technical literature abstracts

The law empowers the Belgian government to take steps to prohibit
or control atmospheric pollution by requiring the use of antipollution devices.
The law defines pollution as any discharge into the air that is liable to have
a deleterious effect on human health, on animals or plants, or to cause damage
to monuments or scenic landscape. The Minister of Health is responsible for
coordinating activities with other agencies, for the analysis of emitted sub-
stances, for researching the effects of air pollution and means for curbing it,
and for educating the public on antipollution measures. The law further provides
for the banning of unsuitable devices and sets penalties for violations.

Articles 364 and 574 of .this decree extend its provisions to cover
the handling of zinc and lead ores and to the manufacture, assembly, and distri-

This decree bans the throwing or abandoning on public roads of any
object that may emit smoke or steam. It also requires that motor vehicles be
maintained and operated in such a way as not to spread oil and other combustibles
in an unacceptable manner or to emit smoke that may impair traffic safety or
disturb other road users. The degree also sets penalties for violations.

Act, "relating to ambient air quality and to the control of air
pollution," empowers the Minister of Fisheries and Forestry to establish,
operate, and maintain a system of air pollution monitoring stations throughout
Canada, to collect air pollution data for publication, conduct research and
draw up plans for the control and abatement of air pollution. The act also au-
thorizes the Governor in Council to prescribe as national ambient air quality
objectives those formulated by the Minister and to establish national emission
standards and set standards for fuels and additives used in the operation of
federal enterprises.

Schedule E of this regulation defines crankc'ase emissions, ex-
haust emissions, and evaporative emissions. It proscribes the discharge of
crankcase emissions into the atmosphere and limits evaporative emissions from
a gasoline-powered light-duty vehicle to 6 grams of hydrocarbons. The regula-
tion further limits hydrocarbon exhaust emissions to 2.2 grams per mile for a
light-duty vehicle and 275 parts per million by volume for a heavy-duty vehicle
and 1.5 percent per volume for a heavy-duty vehicle. The opacity of the ex-
haust emissions of a diesel-powered vehicle should not exceed 40 percent during
acceleration and 20 percent during lugging. The regulation also provides for
the determination of compliance by means of approved test methods.

This Act empowers the Lieutenant Governor in Council to make
regulations for the control of air pollution. These regulations may prescribe
the permissible density of air pollution, prohibit or limit any type of in-
cineration, as well as control the operation of internal combustion engines.
The Act provides that the Minister of Health may assist municipal officials in
developing appropriate programs, investigate problems of pollution control, and

This letter, dated Aug 4, 1965, from the Minister of the Interior,
to prefects, emphasizes-the extent of the powers vested in them, in collabora-
tion with local authorities, to prevent air pollution. The letter points up
the advantage of immediacy that local authorities havein the detection and re-
porting of incidents of excessive air pollution.

Minister for Equipment and Housing, requires that the mass of carbon monoxide
and ..hydro carbons contained in the exhaust gases from motor vehicles equipped

a total authorized loaded weight not exceeding 3.5 metric tons, must not exceed,

This order of Nov 12, 1965, issued by the Minister of Public
Works and Transport, requires that automotive engines be designed, constructed,
adjusted, maintained and operated in such a way as not to cause the emission of
harmful or unpleasant exhausts. The order proscribes, with appropriate excep-
tions, dense exhaust discharges while the vehicle is in motion or parked and
specifies an opacity-test procedure for new-model vehicles. It further sets
emission thresholds for various categories of motor vehicles.

This decree, No. 65-965, dated Sep 17, 1965-, authorizes the
Minister of Public Health and Population and the Minister of Industry to issue
specifications for the manufacture, importation and sale in France of equipment
that produces heat by combustion. The decree grants to the prefect the author-
ity to take corrective action in the event of noncompliance. It also makes
provisions for the establishment of special air-pollution-free zones and the
setting of emission threshold within them.

This order issued Mar 31, 1969 by the Minister for Social Affairs
and by the Minister for Equipment and Housing requires that motor vehicles,
subject to the provisions of the Traffic Code, equipped with four-stroke gaso-
line engines not exceeding 3.5 metric tons authorized total weight when loaded
must be adjusted and maintained in such a way as not to discharge, when idling
without a load, exhaust gases having a carbon monoxide content exceeding 4.5
percent by volume. This order is not applicable to vehicles whose power does
not exceed one horsepower. The order further sets standards and methods for
the testing of vehicles for exhaust emissions.

This law, No. 61-842, dated Aug 2, 1961, requires that all build-
ings, industrial, commercial, handicraft, or agricultural establishments,
vehicles or other movable objects, be constructed, operated or used by natural
or legal persons in such a manner as to prevent pollution of the atmosphere
and the discharge of odors which constitute a public nuisance or a menace to
health. Implementing decrees will set permissible limitations on discharge
into the atmosphere of smoke, soot, dust, poisonous gases and of corrosive,
malodorous, or radioactive substances. The law grants to the prefect extensive
authority to take measures to eliminate serious dangers of nuisances to health
or comfort.

of the dust, soot, and tar content of waste fumes from central heating plants
with a nominal heating capacity of more than 20,000 kilocalories per hour; the
second on the determination of these substances in waste fumes from home furnaces

The 45 articles of this law spell out the tasks and obligations
of the Confederation as well as those of the Cantons and sets forth measures
for implementation of the law, including coercive and expropriation measures.
The law covers inter-Cantonal and international waters, the control of discharge
from industry, agriculture, boats, etc., and measures to treat wastes in order
to assure water purity. It also deals with pollutants, reservoirs, the dispo-
sition of solid waste, debris accumulating near hydroelectric centers, and the
protection of subterranean waters. It covers Federal subsidies as well as

The Clean Air Act authorizes the Minister of the Environment to
make regulations providing for maximum density levels of air contaminants in
Alberta and authorizes his director of pollution control to approve all plans
for the construction of any structure which might be a source of air pollution.
The director may order construction stopped in the case of deviation from ap-
proved plans, issue emission control orders, and direct limitation or stoppage
of pollutant emissions. The Minister of the Environment may close plants con-
stituting a health problem. The Environment Act establishes a provincial de-
partment to handle matters concerning: conservation and use of natural resources,
prevention and control of their pollution, prevention and control of noise levels,
economic factors and other activities adversely affecting natural resources, and
the preservation of natural resources for their esthetic value.

This Act is designed "to provide for the abatement and control of
pollution of air, soil and water and for the conservation and use of water as a
natural resource of the province; to provide an aid towards the centralization
and coordination of multiform controls over the use of water generally by the
creation of an authority as an arm of government." The Minister of Mines,
Agriculture and Resources is charged with the administration of this Act. The
Lieutenant Governor in Council is granted the power, hereunder, to issue regu-
lations for the inspecting and testing of soil, air, and bodies of water, to
set pollution standards, to make rules on sewage and industrial waste effluents,
to conduct investigations of complaints of air and water pollution, and to pro-
vide for water-use licenses. Contamination by radioactive substances also come
under the purview of this Act.

Minister in the Executive Council may direct the Nova Scotia Water Resources

Under the provisions of this Act, the Minister of the Environment
is responsible for the protection and conservation of the natural environment
and the air, land, and water of the Province. His duty is to investigate
problems of pollution, waste management, waste disposal, and litter management
and disposal; to conduct research pertinent to contaminants and pollution; to
collect and publish relevant data; and to enter into agreements for the protec-
tion and conservation of the environment. The Act specifies the amount of con-
taminants that may be added to the environment and prohibits the construction
or modification of plants and processes likely to contaminate the environment,
without approval of such plans. It further requires motors and motor vehicles
to be equipped with anti-pollution devices. The Environmental Council is di-
rected to advise the Minister on current research.

The Baden-Wuerttemberg law on protection against air pollution,
noise and vibrations (immission protection law) of February 4, 1964, amended
February 6, 1970 (GB1. S. 55; GB1. S. Ill) requires proprietors and operators
of facilities that can cause air, noise or vibration pollution to conduct ac-
tivities associated with these facilities in such a manner that the population
is not exposed to such pollutions to the extent that the state of technology
and economic circumstances reasonably permit. This legislation contains defini
tions, implementing ordinances, monitoring procedures, health hazards measure-
ments, and regulations pertinent to trade secrets and violations. The law enters
into force one month following promulgation.

The Lower Saxony state law for protection against air pollution,
noise and vibration (immission protection law) of January 6, 1966 (GVB1. S. 1)
provides that the State Ministry may take the following measures to ensure that
the owners and operators of facilities build, operate, and maintain them so as
not to expose the population to excessive levels of air pollution and noise:
require the facilities to meet certain technical standards, have them measure
emission and immission levels according to prescribed procedures, set emission
thresholds, limit the use of certain types of fuels during periods of severe
pollution, and restrict the operation of facilities in respect to time and place.
The law provides for administrative monitoring, designates responsible offices,
sets measurement standards, and establishes penalties for violations.

The North Rhine-Westphalia Law for protection against air pollu-
tion, noise and vibration -- immission protection law in the promulgation version
of April 1, 1970' (GV NW S. 283) obligates operators of facilities that can cause
air pollution and excessive noise to set up, run and maintain these facilities
so as to protect the population from such hazards to the extent that technology
and the nature of the facilities allow. The State government may require builders
of such facilities to adhere to special construction codes and operators to under-
take pollution measurements, abide by pollution standards, limit the use of certain
fuels, and to change times and, in the case of mobile facilities, the place of
operation. The law allows competent authorities to make exceptions. It further
provides for administrative monitoring and for pollution measures.
