§§261.31 and 261.32 lists of hazardous waste.  This  does  not  include  paint
wastes meeting the Part 261 criteria for hazardous waste  and  which  have  been
used, reused, recycled or reclaimed.

Dear Mr. Quinn:

     As discussed  in  «ur telephone conversation on 1/20/30,
paint wastes  (both  from  manufacture and use) have been temporarily
suspense} froiri the  lists of hazardous ..fl<5tes (SS261.31 and
261.32) until further evaluation is ma^e on the hazardousness
of these wasitec.   Therefore,, as indicate^ by 40 CFE 4614,
January 16, 19C1,  (copy  enclosed), all paint wastes except
ns provicpf! b»»low  which  are hazardous* and which are used,
reur^c", recycled or r<»cli»inied (UK-*) <\re currently excluded
from regulation under Parts 262 through 2G6 or Parts 122
