          This letter  responda to our recent telephone conversations
     regarding sine phosphating on carbon'steel and the relationship
     of this operation to the  Agency's Hazardous Waste No. FOOf     -
     (wastewater treatment sludges froa electroplating operational*

          There are several processes which are exempt from the
     P006 listing, one of which is fine plating (aegregated baaie)
     on carbon steel.   Since the  Agency's current definition of    >'-
     electroplating includes phoaphatJCa^rocaaaes, the exemption
     for sine plating  on  carbon steel['*mti&.'applies ,to; sine,;- ',v.;-,'. ;w^':"
     phosphating on carbon ateal.   This exemption applies only
<«•   if the wastestream from the  sine phosphating process is not
^   comingled with any other  hasardoua waate.   If the wastestream
2   that you are describing is sine  phosphating on earboft steel
x:   and is segregated -  i.e., it is  not. eomingled^with wastewaters
.*   from any other processes  that contain hazardous constituents,
.2   then the Agency considers the waate to be  exempt from BPA*a
a   F006 Hasardous waste .listing and therefore not..•'»Ijhsjted;':V-v*{\.,- s
x   hasardous waste under the Federal Hasardous Wsate Nanagement........
£   System.  Was tea falling under thia category may be hajuJled
^   as non-ha«ardoua  providing that  the generator has fulfilled

J,   charactristics, (ignitability, corraivity^ reactivity^ and
\   EP tpxiclty), identified  under S261.20 of  the 1CXA regulationa.
