Owners or operators of facilities in states with only Phase I authorization
are required to submit financial instruments as per Part 264 Subpart H only
prior to the final permit decision.* It would be inappropriate to impose
financial requirements through the initial permit application procedure since
there would not be an applicable Part 264 or Part 265 standard in effect.
However, owners and operators should be required to specify in their Part B
applications what mechanisms they intend to use to satisfy the financial
requirements. This will help in obtaining public acceptance of the facility.
* This applies to Phase I status without financial responsibility requirements
only until.January 31, 1986, when all interim authorizations for the pre-HSWA
program will terminate.

In view of the above, we are advising the Regions as
follows: Owners or operators in States with only Phase I
authorization should be required to specify, as part of their
Part B applications, the mechanisms they intend to use to satisfy
the financial requirements. The instruments must be submitted
to the Regional Administrator prior to final permit decision.
We strongly recommend that owners and operators be informed
of the advisability of establishing financial instruments prior
to public notice of the draft permit.
