     As you know, in  early  July the FY 1987 SPMS measures, copy
attached, were transmitted  to the  Regions.  These regtiire
guarterly targets for inspections  (R/E-2).  The Assistant
Administrator fo^Solid  Waste and  Emergency Response (AA-OSWER)
must present negotiated  targets to the Administrator by .
September 1.  To assure  that this  is  met,  we need negotiated
FY  1987 inspection  (R/E-2)  targets, by gya.;rte^ (^tandard-
tjire^month^guajrjtej^sj , by August 12»^^1«?e-?eque^artr--that~you pro-
vTxJe~Tfa~r7je*ts~~by August 8, which may be negotiated as necessary by
August  12.  Further negotiations between Regions and Headquarters
on  these  targets may occur  in the latter part of August. We
request your  targets even  though OMSE will not provide forms until
August  8.
       •
      Please note  that the  number of facilities inspected,' :
rather  than the number of  inspections, are targetted.  For
land disposal  facilities subject to.ground-water monitoring,
the FY  1987 RCRA  Implementation Plan  (RIP) (pertinent pages
attached) requires  annual  inspections (RIP pp. 12 - 13).
This requirement  applies to operating, closed and closing
facilities  (i.e.,  facilities that retained and lost interim
status.   For  treatment, storage and disposal facilities
that are not  such land disposal facilities,  RCRA section  3007(e)
and the FY 1987 RIP  (pp. 13 -  14) require that all  such
 facilities not inspected in FY 1986 be  inspected in FY 1987.
 In addition,  the FY  1987 RIP (p.  13)  requires that  non-land
disposal, facilities  receive an inspection within 12 months of
 receiving a permit and that closing facilities be inspected,
 regardless of whether inspected in FY 1986.  Finally, EPA'
 must annually inspect all  Federal, State  and local  facilities
 for the treatment, storage and disposal of hazardous waste*
 (RCRA section 3007(c),(d);.FY  1987 RIP  p.  12);  this requirement
 is not satisfied by  a State  inspection.   We  expect  to compare
 your targets to information  contained in  HWDMS  and  the  FY 1987
 budget.

     Significant non-complier enforcement  (R/E  4)  targets
will be addressed in October/ 1986.

     Please send your proposed targets  to  the Assistant
Administrator for the Office of Solid Waste  and Emergency
Response, the Director, Office of Waste Programs Enforcement
and to Lorraine Smith, RCRA Enforcement Division,  Office of
Waste Programs Enforcement.
