                                BACKGROUND 1NPCSMATION:
                        NKTION&L PRIORITIES LIST, FINAL RDLE

        The U.S. Environmental Protection Agency  (EPA) is adding 29 proposed sites
    (including 27 Federal facility sites)  to the National Priorities List (NPL)  and
   expanding 1 final Federal facility site.  Of the States and territories, 16 are
   adding sites  to the NPL in a final rule published in the Federal Register in
   mid-November.   California  leads with 5 new final sites,  followed by, New York
   with 4.  The number of final sites now totals  1,010 including 79 in the Federal
   facility section.

        Of the States  and territories,  seven  have no sites on the new final NPL:
   American Samoa,  Commonwealth of the  Northern  Mariana Islands,  the District of
   Columbia, Hawaii,  Nevada,  Trust Territory of the  Pacific  Islands,  and  the
   Virgin  Islands.    New Jersey  has the  largest number  of final  sites  (103),
   followed by  Pennsylvania  (87),  New  York  (78), Michigan  (68),  and California
    (66).

        Proposed sites now total 209 including 38 in the Federal facility section.
   Final  and proposed sites total  1,219.  New Jersey has the  largest number of
   final  and proposed sites  (109),  followed by  Pennsylvania (97)  and California
    (91).

        The NPL  identifies abandoned or  uncontrolled hazardous  waste sites that
   warrant further investigation  to determine if long-term "remedial action" is
   necessary.     Sites  on  the  NPL  are  eligible  for such action under  the
   Comprehensive Environmental Response,  Compensation, and  Liability  Act  (CERCLA),
   enacted  on  December 11,  1980,  as  amended  by the Superfund  Amendments and
   Reauthorization  Act (SARA), enacted on October 17,  1986.   SARA authorizes  a
   "Hazardous Substances  Superfund" totaling $8.5 billion  over 5  years to pay
   costs not assumed  by responsible parties.   EPA has  the primary responsibility
   for managing cleanup and enforcement activities under Superfund.

        This document  provides background information on  the final  rule and the
   following lists:

        -  The 29  sites being added to  the  final NPL arranged alphabetically by
           State.

        -  The distribution  of all sites by  State arranged by the  number  of new
           final sites.
   Contents of Rule

        Of the 29 sites being added to the NPL,  27 are Federal facility sites and
   have scores of 28.50 or above on the Hazard Ranking System (HRS),  a numerically
   based system designed  to evaluate the relative risks posed by a  site to human
   health or  the  environment.   The two remaining sites being added to  the NPL—
   Forest Glen Mobile  Hone Subdivision,   Niagara  Falls,  New York,  and  Radium
   Chemical Co.,  Inc.,  New York City,  New York — were  proposed for the  NPL on
   August 16,  1989 (54 FR 33846)  on  the basis of Section 300.66  (b) (4)   of the
   National  Contingency   Plan,  the  Federal  regulation  by  which  CERCIA  is

implemented.   Under this section, a site can be placed on the NPL  if  (1)  the
Agency  for  Toxic   Substances  and  Disease  Registry  (ATSDR)   of   the  U.S.
Department of  Health and  Human Services has  issued a public health advisory
reconmending that people be  removed  from the site,  (2) EPA determines that the
site poses a significant threat to public health,  and (3)  EPA anticipates that
it will be more cost-effective to use its remedial authority (available only at
NPL sites) than its emergency removal authority to respond to the site.

     On February 10, 1989,  ATSDR issued  a health  advisory warning that the
Radium Chemical site poses a significant threat to public health because of the
possible release of radium-226.

     On July 31, 1989, ATSDR issued a health advisory warning that residents of
the Forest Glen Mobile Home Subdivision may be at risk because of the potential
for exposure through direct  contact  to,  or  ingestion of,  contaminants found in
soil at the site.

     The two sites have HRS scores below 28.50 and are in the last group of the
NPL.

HRS Effective Date

     On December 23,  1988  (53 FR  51962), EPA proposed revisions to the HRS in
response to CERCIA Section 105 (c) (1), added by SARA, which provides that EPA
should revise  the HRS by  October 17, 1988  (24 months after  the enactment of
SARA).  The revised HRS  is scheduled to be published in the Federal Register in
1990.  Until then,  EPA  is  continuing to propose and promulgate sites using the
current HRS,  in accordance  with CERCLA Section 105  (c) (1)  and Congressional
intent (see 54 FR 13296, March 31,  1989).   EPA plans to  take final action on
all sites now in proposed status before the effective date of the revised HRS.
