KCSTINS
Sites are placed en the NFL primarily en the basis of their scores
using the Hazard Ranking System (HRS) , a numerically based system
designed to evaluate the relative risks posed by a site to human health
or the environment. An HRS score of 28.50 was selected as the cut-off
point for the first proposed NFL to identify at least 400 sites, the
minimum specified by CERCIA. On December 23, 1988 (53 FR (51962) ,
EPA proposed revisions to the HRS in response to CERdA Section 105 (c)
(i) , added in SARA. On February 8, 1989 (54 FR 6153) , EPA extended the
comment period on the proposal an additional 30 days to March 23, 1989.
EPA anticipates making final decisions on all sites proposed under the
current HRS before the effective date of the revised HRS.
CERdA also allows States or Territories to designate one top-priority
site and requires those sites to be included in the first 100 sites on
the NFL regardless of score. Of the 57 States and Territories, 38 have
designated top-priority sites. Six of these sites have been deleted from
the NFL. Of the remaining top-priority sites, 10 are included in the
first 100 on the basis of their scores. The remaining 22 have scores
that would not place them in the top 100. They are included at the bottom
of the first 100 sites. Of the 22, 7 have scores below 28.50.
On September 16, 1985 (50 FR 37624) , EPA adopted an amendment to the
National Contingency Plan (NCP) , the Federal regulation by which
CERCLA is implemented. Wider Section 300. 66 (b) (4) of the NCP, a site can
be included on the NFL if it meets these three requirements:
o The Agency for Toxic Substances and Disease Registry (ATSDR)
of the U.S. Centers for Disease Control has issued a health advisory
that recommends removing people from the site.
o EPA determines the site poses a significant threat to public health.
o EPA anticipates it will be more cost-effective to use its remedial
authority than to use its emergency removal authority to respond
to the site.
The Lansdowne Radiation Site in lansdowne, PA, was placed on the NFL
on September 16, 1985 (FR 50 37630) on the basis of an ATSDR advisory.
It has an HRS score of less than 28.50 and is at the end of the list.
CERCIA restricts EPA's authority to respond to certain sites by
expressly excluding some substances — petroleum, for example — from the
definition of "release. " In addition, as a matter of policy, EPA may
choose not to use CERCIA because the Federal government can undertake or
enforce cleanup under other laws, thus preserving the Superfund for
sites where no other law is available. However, if EPA later determines
that sites not listed as a matter of policy are not being properly responded
to, it may consider placing them on the NFL.

EPA nay delete a proposed or final NFL site if it determines that no
further response is required to protect human health or the environment.
Under Section 300. 66 (c) (7) of the NCP (50 FR 47912, November 20, 1985) , a
site may be deleted where no further response is appropriate if EPA determines
that one of the following criteria has been met:
o EPA, in consultation with the State, has determined that responsible
or other parties have implemented ail appropriate response action
required.
o EPA, in consultation with the State, has determined that all
appropriate Superfund-f inanced response under CERCIA has been
implemented, and that no further response by responsible parties
is
o Based on a remedial investigation, EPA, in consultation with the
State, has determined that the release poses no significant threat
to public health or the environment, and, therefore, remedial
measures are not appropriate.
Since 1986, EPA has followed these procedures for deleting a site
from the NFL:
o The Regional Administrator approves a "close-out report" which
establishes that all appropriate response action has been taken
or that no action is required
o The Regional Office obtains State concurrence
o EPA publishes a notice of intent to delete in the Federal Register
and in a major newspaper near the community involved. A public
comment period is provided.
o EPA responds to the comments and, if the site continues to warrant
deletion, publishes a deletion notice in the Federal Register.

Sites that have been deleted from the NFL remain eligible for further
Superfund-financed remedial actions in the unlikely event that conditions in
the future warrant such action.
As of March 22, 1989, 26 sites nave been deleted from the NPL. The
first five were deleted as follows:
o December 30, 1982 (47 FR 58476) : 5 sites previously announced were
not included in first proposed NPL, 1 of which (Butler Mine Tunnel,
Pittston, PA) was later proposed again and added to the NPL.
o September 8, 1983 (48 FR 40658) : 1 site in first proposed NPL was
not included in the original NPL.
The remaining 21 sites were deleted in subsequent final rules (see
page S-43) .

In addition, EPA has published notices of intent to delete a number
of sites (see page S-45).

In June 1988, EPA proposed dropping 30 previously proposed sites
from the NFL because they are subject to the corrective action authorities
of Subtitle C of the Resource Conservation and Recovery Act. Final action
has not yet been taken on these sites.
DESCRIPTIONS OF LISTS
Sites on the NFL are ordered according to their scores on the HRS,
except for top-priority sites and sites involving an ATSDR advisory. The
Federal facility sites are in a separate section. The HRS is a screening
tool designed to take into account a standard set of factors related to
risks from potential or actual migration of substances through ground water,
surface water, and air. Ordering by HRS scores serves primarily informa-
tional purposes. EPA and the States use the scores along with other
information to determine priorities for conducting detailed investigations
to determine if further response actions 'are needed.
The sites on the NFL are in groups of 50 (except for the last group).
The range within most of the groups is 1 to 4 points. EPA considers sites
within a group to represent approximately the same potent led threat to
public health, welfare, or the environment. For convenience, the sites are
numbered. In the Federal section of the NFL, the sites are ordered by
groups corresponding to the groups of 50 on the NPL. That is, a Federal
facility site designated as Gr 12 would have an HRS score within the range
of scores covered by the 12th group of 50 sites on the final NPL. Proposed
sites are assigned to groups in the same way.

Each entry on the NFL contains the name of the site, the State and
city or county in which it is located, and the corresponding EPA Region.
(In cases where a site name has been condensed for lack of space, complete
names are given in the list by State starting on page S-55.)
Each entry is also accompanied by one or more notations referencing
activities under way at the site at the time. the list was prepared. Five
categories are used to designate the type of response under way. One or
more categories may apply to each site. The five are:
R Federal and/or State Response includes sites at which EPA or
State agencies have started or completed response actions.
F Federal Enforcement includes sites where 1) the Department
of Justice has filed a civil complaint (including cost-recovery
actions) or issued an administrative order under CERCLA or RCRA
2) a Federal court has mandated some form of response action
following a judicial proceeding, or 3) EPA has obligated funds
for an enforcement-lead remedial investigation/feasibility study.
S State Enforcement includes sites where 1) a State has filed a
civil complaint or iggnoH an admini ^r^tive order under CERCLA or
RCRA, 2) a State court has mandated some form of response action
following a judicial proceeding, or 3) a State has obligated funds
for an enforcement-lead remedial investigation/feasibility study.
V Voluntary or Negotiated Response includes sites where responsible
parties have started or completed response actions pursuant to
settlement agreements or consent decrees to which EPA or the
State is a party.
D Category To Be Determined includes all sites not listed in any
other category. A wide range of activities may be in progress
at sites in this category. EPA or a State may be evaluating the
type of response action to undertake, or an enforcement case may
be under consideration. Responsible parties may be undertaking
response actions that are not covered by a consent decree or an
order.
Essentially the same response categories are assigned for Federal
sites as for non-Federal sites. A Federal agency response is indicated
by the (R) category. When the (R) category does not apply, other Federal
agency activities at that site, such as evaluating the appropriate response
to undertake, are indicated by the (D) category.
Many sites are cleaned up in stages or "operable units" — that is,
a discrete field activity done as part of the entire site cleanup that
significantly decreases or eliminates contamination, threat of contamination,
or pathway of exposure. One or more operable units may be necessary
before EPA will consider the cleanup of a hazardous waste site completed.
The status of Superfund-f inanced field activities under way or completed
at a site, as well as the status where responsible parties are conducting
cleanup activities under a consent decree, court order, or an administrative

order, is indicated with a cleanup status cede. Planning or engineering
studies do not receive a cleanup status code, nor does a simple action
such as constructing a fence. Three cleanup status codes are used. (Only
one code can be used at a site because the codes are mutually exclusive. )
The three codes are:
I implementation activities are under way for one or more
operable units. Field work is in progress at the site,
but no operable units are completed.
O Implementation activities are completed for one or more (but
not all) operable units. Some field work has been completed,
but additional work is necessary.
C Implementation activities are completed for all operable units.
All actions agreed upon for remedial action at the site have been
completed, and work has started to monitor the effectiveness of
the cleanup. Further site activities could occur if EPA considers
them- necessary.
The last section of this document contains a list of all proposed
and final NPL sites arranged alphabetically by State. Each entry includes
the date the site was proposed or announced and, when appropriate, the
date the site was placed on the final NPL. NPL ranking is given for
final sites and group number for proposed sites and Federal facility
sites. In cases where a site name has been condensed in other lists for
lack of space, more complete names are provided. Also noted are instances
where a site name has been changed subsequent to proposal.
NPL PR3POSALS/PRCHDLGATIQN8
EPA published the first NPL of 406 hazardous waste sites on September
8, 1983. It was the result of EPA's consideration of comments received on
the 419 sites proposed in December 1982 and March 1983. (Before formal
rulemaking was instituted, EPA had announced two preliminary lists — the
Interim Priorities List (IPL) in October 1981 and the Expanded Eligibility
List (EEL) in July 1982.)
CERCXA requires the NPL to be updated annually. Since September 1983,
505 sites have been added to the original final NPL and 19 sites have been
deleted, for a total of 892. Adding the 273 sites in the proposed category
gives a total of 1,165 final and proposed sites. Except for the IPL and
EEL, all NPL actions were published in the Federal Register (see page S-14) .
HCRA FR Notices (June-August 1988)
In mid-1988, EPA published two Federal Register notices involving
the listing of sites subject to Subtitle C of the Resource Conservation and
Recovery Act (RCRA) , which, regulates facilities involved in hazardous wastes
activities. On June 24, 1988 (53 FR 23978), EPA:
o Reproposed 13 sites previously proposed for the NPL during
1983-85 in the first 4 NPL updates.

o Proposed to drop 30 previously proposed RCRA sites from the NFL.
o Expanded and clarified the categories of RCRA sites that should
be placed on the NFL.
On August 9, 1988 (53 PR 30002), EPA published two NEL/RCRA policy
notices that:
o Expanded and clarified how EPA determines that the owner/operator
of a RCRA facility is unwilling to perform corrective action,
and therefore the facility should be placed on the NFL.
o Requested comments on additional criteria for EPA to determine when
an owner/operator of a RCRA facility is unable to pay for corrective
action, and therefore the facility should be placed on the NFL.
Proposed update #7 (June 1988)
NFL Update #7, proposed on June 24, 1988 (53 FR 23988), consisted of
229 sites, including 14 Federal facility sites. Update #7 included sites
from 43 of the 50 States, the District of Columbia and six territories.
California led with 25 sites, followed by Pennsylvania with 17 and
Washington with 15. Alaska proposed its first site.
o March 1989
- 64 sites, including 2 Federal facility sites, received no comments
and were added to the final NFL

Proposed Rule (July 1987)
On July 22, 1987 (52 FR 27643) EPA reproposed seven Federal facility
sites because it appeared that the areas evaluated for the NFL included
areas subject to the corrective action authorities of RCRA Subtitle C. The
RCRA units can still be included in calculation of the MRS scores for these
sites, which is consistent with the RCRA/Federal facilities policy proposed
on May 13, 1987 (52 FR 17991). The seven reproposed Federal facility sites
(listed alphabetically by State) are:
o Anniston Army Depot (Southeast Industrial Area), Anniston, AL
o Dover Air Force Base, Dover, DE
o Joliet Army Ammunition Plant (Load-Assembly-Packing Area), Joliet, IL
o Savanna Army Depot Activity, Savanna, IL
