How Can We Protect the Environment from

Thousands of Leaking Underground Tanks?

     That's the basic challenge facing the Environmental Pro-
     tection Agency as we implement a nationwide program
     for underground storage tanks (USTs). It's a unique
challenge. And it calls for a new management approach.

The Facts:
There are nearly 2 million underground storage tanks now reg-
ulated by EPA, and thousands of them are leaking.
Tanks are located at over 750,000 sites in 3,000 counties and
56 States and territories.
Nearly all sites have the potential to contaminate ground water
or cause fires and explosions.

The Problem:
How can we successfully manage an UST program covering
nearly 2 million tanks at over 750,000 sites?

The Solution:
Use a widescale management process that has proven its
success in the business world .

The UST Franchise Network consists of
EPA headquarters, the 10 EPA Regional
Offices, 56 States and Trust Territories,
3,000 local offices, and over 750,000
tank facilities.
Franchising: A Commitment to

Cooperation
     This brochure explains EPA's franchising system and how
     you — as State UST officials — can benefit from this new
     approach. As part of an active, nationwide network, you
will find extensive support services that will help you meet the
unique regulatory challenges posed by underground
storage tanks.
   Franchising works by using the strengths and knowledge of
both the franchisees —who directly run the business daily -
and the franchiser— who delivers national advertising, policy
and crucial support services. The central element in the suc-
cess of franchising is the cooperation of these two key players.
EPA is now joining in a cooperative enterprise with State gov-
ernments to develop franchises that specialize in marketing
good tank management and regulatory compliance to the ulti-
mate "customers," the hundreds of thousands of tank owners
and operators.

Franchising: Cooperative Action to Protect

the Environment

      New problems call for new solutions. The immense num-
      ber of underground tanks and sites now subject to
      Federal or State regulations has prompted EPA to
develop an innovative way to implement the LIST program.
In responding to this unique regulatory challenge, EPA has
decided to emulate the commercial success of franchising.
   Facing the same basic problems of servicing huge num-
bers of varied customers nationwide, national franchises have
been successfully marketing everything from hamburgers to
real estate for decades. We can do much the same thing to
market the LIST program to our "customers," the hundreds of
thousands of tank owners  and operators.
   All franchises face the same basic questions:
• How to provide and maintain services at thousands of
locations?
• How to find improved methods of doing hundreds of
different operational tasks?
   Answers to these questions come from identifying separate
responsibilities for the franchiser and for those running individ-
ual franchises. Here's how it will work for us:
• Responsibilities will be clearly defined for States —who run
their own "stores" — and for EPA — who  provides a multitude
of support services.
• State "stores" will design LIST programs to fit the unique
needs of the customers.
• EPA will take the lead in seeking and providing training, an
essential element for running a successful UST franchise.
• EPA will conduct research on better technology and
management methods that will benefit both States and their
customers.
   These responsibilities are discussed more fully in the
following pages, but you can see why cooperation is so
important.
             Commitment
          to Cooperation
We think of the UST program as a
cooperative venture between the States
and EPA to bring about compliance with
the UST regulations in the most efficient
manner possible. We want to find new
ways to encourage voluntary compliance,
to reward initiative and innovation,
and to seek daily improvements in
performance. Enforcement will, however,
be an essential part of a franchised UST
program, because some customers will
not comply with the regulations.

As a franchiser, EPA's overriding concern
is to help you — State UST officials —
market a practical, workable regulatory
program to customers who own and
operate USTs. We can succeed only if
you are successful. The effectiveness of
franchising will be seen as more and
more customers "buy into " the program
each year — and increasingly more and
more USTs will be properly managed.
Your Responsibilities at the State  Level

      Although EPA will support State programs in every way
      possible right from the start, the daily business of State
      "stores" rests entirely with you. As State UST officials
running the franchise's stores, you are the most critical link to
the customer. You have the demanding job of convincing our
customers — the owners and  operators of USTs — that they
need to prevent and correct tank leaks. Compliance assistance
and enforcement are the primary products for sale on your
store's shelves.
    The success of the UST franchise depends on knowing what
your customers want and  need. Your direct contact and knowl-
edge provides the best source of vital information about the
customers.
    Exposed to your customers' daily operational problems,
you can identify opportunities for improving performance more
readily than EPA can. You  can respond to immediate problems
and try out new ideas. And you will always have ready access
to EPA's expertise by working with Regional Offices in joint
problem solving.
    While getting key support services from EPA, you can run
effective and innovative programs that respond to the specific
characteristics of customers in your State. Ultimately, we can
share your successes with other UST franchises to our mutual
benefit.
    Franchising emphasizes the reciprocal basis of successful
business ventures. Each of the key participants in this joint
venture plays an important part:
• State UST Officials
• EPA's Regional Offices
• EPA's National Headquarters

What EPA Does for State Franchises

At the Regional Level
      Perhaps the best way to begin defining EPA's respon-
      sibilities is to say what the Regional Offices will not be
      doing:
• They won't run the LIST program for the State.
• They won't dictate behavior at the State level.
• They won't second-guess individual State decisions.
   As in our State Program Approval regulations, the
emphasis is on meeting objectives of the whole program. Be-
cause there is no one way to meet these objectives, you will be
free to find the best way to run your own "store" as long as
the program objectives are met by 1998.
   To help you, the Regional Offices will:
• Work with  you in a cooperative spirit to develop a program
that will meet the national goals and objectives.
• Listen carefully to you to learn what you need to improve per-
formance in  your State program and work together with you to
accomplish your goal.
• Identify special problems that EPA can solve through its
nationwide access to expertise.
• Promote efficient, innovative management practices
discovered at sites in your franchise.
• Help you identify crucial training needs.
• Assist you  in developing program workplans, as well as
award and oversee grants and cooperative agreements.
• Identify specific areas where a State's performance is below
par and work with you to find ways to improve that
performance.
• Evaluate overall program effectiveness with you to identify
needed improvements.
• Allocate monetary resources to  augment strengths and
promote a base, while carefully balancing the use of resources
nationwide.
• Provide enforcement support to achieve effective program
compliance.
As State UST officials, you will be
the source of most of the ideas for
improvement and new services. If you
succeed, the Regions will succeed. By
listening to you and providing you with
all possible assistance to get the job
done, the Regional Offices will play a
crucial part in continuously improving
your performance.

responsibilities for States and EPA
underscores why the ultimate success
of the UST franchise depends on a
commitment to cooperation between
States and EPA.
At the Headquarters Level
      Because Headquarters will give a great deal of autonomy
      to the Regional Offices— for example, the Regional Of-
      fices will approve State programs —the bottom line task
for Headquarters is finding ways to improve the performance
of the entire franchise. What does this mean? EPA Head-
quarters will:
• Develop realistic national policies and standards, carefully
considering information from you and the Regional Offices.
• Obtain grant, contractor, and travel funding to support you
and the Regional Offices.
• Work with Regional Offices to thoroughly understand the
needs of your State UST  program so that we can help you
improve the quality and productivity of your work.
• Fund and manage research to solve program  problems you
encounter.
• Provide training aids that enable you to do your job better,
especially as you help tank owners and operators in the daily
work of managing their tanks.
• Transfer technology and expertise throughout the country,
convene workgroups to deal with critical operational issues,
and encourage communication between State and Regional
UST officials.
• Provide the equivalent  of "national advertising" for the fran-
chise through effective outreach materials and other outreach
activities.

much larger public — all Americans, who
want and need their environment
protected.
Looking to the Future:

Franchising and the Environment

     Franchising the LIST program provides a unique
     cooperative venture for EPA and State governments.
     Building a franchise with a solid reputation will take time.
Today's successful  franchises have been built over ten, twenty,
and thirty years. We can't expect to have a perfect program in
place everywhere within a year or two. We will have to set a
pattern of success  and constant improvement. We're deter-
mined to accomplish this task and to do it well. EPA will build
trust in the franchise by providing effective support services
and useful management tools.
   Only a franchise approach will allow us to deal effectively
with the management challenges expected over the next
five years: well over 200,000 releases from USTs; perhaps
250,000 closures;  new tank installations in the hundreds of
thousands.
   We will need the decentralized, flexible system that
franchising presents to recognize the unique needs of vastly
different States and the considerable differences within any
single State.
   As with the successful franchising of fast foods or real es-
tate, EPA's franchising will be aimed at helping our customers,
the owners and operators of USTs. For ground water to be
protected and sites to be cleaned up, owners and operators
   must comply with the UST regulations. We want to do
    everything we can  for customers to "buy" our sound tank
         management practices that will protect ground
            water, prevent fires and explosions,  and clean up
              contaminated sites.
